I have proof of delivery of a CCA request on March 4th... No acknowledgement of CCA request from them but 2 more threatograms sent from them to me!!!
Good advice to mark your envelope with "payment enclosed"... after all, they only want your money, not your soul?

They've totally ignored me so far so I don't suppose there's any reason to expect that'll change anytime soon.
I presume an unenforcable CCA is a COMPLETE defence? It looks unlikely that any paperwork is going to surface at all.

I just sent the IN DISPUTE letter 1st class recorded.
If the account is officially in dispute i.e. no CCA supplied, does that mean that Lowells can't proceed with the bankruptcy demand?

The amount they claim I owe them is less than £1800, is almost certainly statute barred and is now in dispute as no CCA provided so I know they're urinating in to a stiff North-Westerly!!!

I'm popping down the post office in a minute to dispatch the Curlyben letter just to cover myself.
I'm filing all letters in a folder to take to court with me and I'm pretty sure the judge will take a dim view of the scare tactics used by this crew!
Do you know if RED have a legal obligation to respond to the CC re the Set Aside hearing? Surely they can't ignore the County Court?!

I presume my local County Court will have written to RED to inform them of the Set Aside hearing?
What's really making me angry is the fact that they are totally ignoring my letters!!!

They are in default by 12+2+8 days right now and I have a date at court for set aside of SD coming up soon.
Should I wait for the 30 days before sending the letter you suggested?

Well, having completely ignored my CCA request, I have this morning received a letter from RED to inform me that "The time limit set by the Court for responding to the Statutory Demand has now expired" and then (in a box in bold type) THIS IS YOUR FINAL OPPORTUNITY TO PREVENT A BANKRUPTCY PETITION BEING PRESENTED. Phone us etc...
Do these cretins only send post OUT? Do they EVER read post that comes IN?
Advice anyone?

Hi I keep getting text messages from a company called RED saying you must call Red urgently today on tel 0113 308 6110.
I have never heard from them before and tried texting them and calling but no answer?
Are they are genuine debt company or not??????
DO NOT PHONE OR CONTACT THIS COMPANY!!!
They specialise in Statute Barred and unenforcable debts which they buy in for very few pence in the pound and then phish or threaten people in order to make loadsa money!!!
Search the forum and you will find lots of people having problems with this DCA (They go under "trading styles" i.e. aliases such as Lowells/Lowell Portfolio 1/Hampsons Solicitors and RED debt Collection).
If or when they write to you, come back and you'll get some great support and advice....
The best advice for now is in bold red letters at the top of this post!!! :grin:

I think I get your drift...
If forumreg has an apology and SD withdrawal from a different "company" but the SD was issued by a the same company under one of it's trading "styles", does that invalidate either the SD or the SD withdrawal?
Does that make any sense whatsoever?!!! Sorry to be thick, I'm losing myself on this one!!!

Now you've put it that way, I think you may have a point, maybe one of the more experienced folks on here may have an opinion, ODC possibly?
I would have thought that the judge would take a dim view of one company issuing the SD and another one apologising (let's HOPE so!!!).

Lowell use "trading styles" such as RED, Portfolio1 etc. so I would think it doesn't matter which name is on the apology as they are one and the same.
My hearing's in a couple of weeks and I still have heard nothing at all re my CCA request, not even an acknowledgement of receipt (and they're 12+2+7 days in default now).
Good Luck at the hearing and I'll wait with baited breath for the result.

Well now, I've had another letter from these guys and its a beauty! It starts:
"We are in receipt of your request for a copy of your credit agreement in accordance with section 78(1) of the Consumer Credit Act 1974"
I didn't send them a CCA request.
"We are also in receipt of the prescribed fee from you"
No, they aren't.
It then goes on to say they will endevour to comply in 12 days but that is dependant on receipt of information from the original creditor, and so on. The original creditor hasn't been able to comply with a cca request for someting like 3 years!
I think YOU maybe got MY letter!!!???
I sent these "people" a CCA request and £1 and I've heard NOTHING since!!!
Ah well, they're in default by 12+6 days now....
