DPA letters sent to GE for Dorothy Perkins and Burtons Accounts, have just received the replies from both stating:- "As we have previously provided you with a complete transaction history in the form of your monthly statements we are not obliged to repeat these details in a Data Protection disclosure. I will respond to your request for disclosure by the 6th May 2006 but this will not include a transaction history. If you do not wish me to proceed or wish to request copy statements instead please let me know. Copy statements carry a charge of £0.50 per copy. Therefore please let me know by return, if you still require this information or whether you wish me to destroy/return your payment. If no response is received, your payment will be banked and the report compiled. Anyone come across this one, not sure what to reply and am wondering what the report they are going to compile will be, any advise greatly appreciated.
  2. Hi scotia Cant help at the moment but egg did same to me we have statements with 6 months gap before ppi kicks in since then its accumulated £1804 ,in 6 years,they also owe us £420 in unlawful charges,we sent 1st letter giving them 14 days to refund or court action, will keep you posted

Hi all, Recieved standard letter from David Just yesterday, and same cr-- from Jean Campbell today,we are sending letter before action today and will keep you posted,one thing thats cropped up is, because we didnt need to apply for our statements ,as we already had them, we have no notes on manual intervention.We are thinking of asking for statments on our active account going back to when account opened in 1981(keep them busy), and the same on the account we are sending the letter before action on,We know we have charges on these accounts prior to the 6 years but not how much. Any advise on the manual intervention side and also the going back to the year dot on the statement side. Light the green touch paper and stand well back!!

Have sent the £5000 claim into Lloyds and have this morning received a letter of acknowledgment stating they will be in touch within 5 days!. we are going with your suggestion over the £12000 claim and hoping that Lloyds will pursue us. Sorry for posting this on someone elses thread, will go back to our own now.

Hi Ant I had two accounts one which was closed in 2003 with a fee and charges balance of just under £5000 at time of closure, which left me with the one account which is still active and to date has accrued fees and charges of £17,000, by coincidence the overdraft on this account is on its limit of £17,000. We are chasing the bank for the smaller amount of £5000 hoping that they will take retalliation in calling in the active account and wanting repayment of the overdraft, we can then put in our defence for the charges and fees incurred on this account, which is mostly what has pushed the overdraft to its limit. It has been mentioned to me that it may be an idea to split the fees up into specific charges i.e overlimit, returned cheque and dishonoured direct debits etc as a way of keeping the claims under £5000.00, dont know if this is an ideal solution just a mention in case it is of any help to you.

Hi all,Had the standard junk letter from them,we come against another problem with egg im not sure what to do with?credit card protection insurence dont remember ever taking or asking for it but its there can i do anything about it,I rang them and stoped it last month but they still took it from my account

My wife had various store cards etc,now we are trying with get back fees etc.after the shock of working out Lloydes acounts,we thought nothing else would supprise us till we came to read through capital one statments. She told me she had not used the card for years,but i never give up i sent a dpa letter with £10 & id. To my surprise when the statements came she had only spent £11 in may 2000 which put the card a little over her £200 limit,£15 fee was added for over limit, she paid off some money each month seems to be late sometimes so they charged £15 fee. Shes not used the card since.The shock came with the statments we owe (rip off one)£883.06.Interresting bit in nov04 balance of 636.63 statement reads (good will gesture £90)underneath was overlimit charge £20 & under that late payment charge£20.no other gestures were made?in amongst the statments is a pile of papers i would describe as a diary,recording a log of actions carried out eg broken promise, letter sent, phone calls,etc.We used your spreadsheet and calculated they owe us £2395.29 including interest,we sent 1st letter in onweds will keep you updated
  10. We have now worked out on one account charges of £4371.04, so have sent off first letter to Lloyds. Still have other account open. Full of charges and fees (Approx £12K). So up to its limit on overdraft. Light the Green touch paper and stand well back!!!!!!!!
  11. We have been clobbered by egg since 2001, for Credit Card Payment Protector, which we are sure we have not signed/asked for. Being Self Employed can they do this? Any advice would be appreciated.

  13. Received the same Pre-marked envelope, DSAR in red last week. They must be getting so many, they are actually treating it seriously now!

Egg have their 14 day Court Letter and reply from them is usual, waffle about "if you are unhappy etc go to the ombudsman" They are going to get a letter from me now saying pay up or I will and go to court, they only owe me £420, so they could double that amount Ombudsmans fee £370 Court Fee £20 My interest £45+ Its their choice
  15. Hi Princess You seem quite knowledgeable on this one. Citicard are refusing to send DPA request and are still asking for two forms of ID. Can they do this. They are also saying the letter is wrong etc. We sent back telling them we were not prepared to fill out forms, and we have sent the £10.
  16. Jolly good luck to you, we are going for them as soon as we can sort it all out. Up to £17K and still counting. They are real nasties. We are hoping they will chase us for overdraft which amount to same as charges. We are fed up with the bullying tactics they use. We're just a small family firm trying to make a living. There must be hundreds more out there like us.
  17. How can you be accused of paying late when the payment is for charges that you were not invoiced for in the first place? Am I missing something here? Surely the unlawful charging aspect still applies to a business account, especially if it is in the individual persons name, whether he is trading as or not? Anyone out there know the answer for def? And anyone out there know the answer to "how much are we letting ourselves in for if we lose on a big one (OVER £5k).
  18. Thanks Bankfodder Any advice out there on this one? As you know we are into charges up to £17K with Lloyds, over three accounts and bad insurance on a loan. What does the team think would be the best way to get the ball rolling on this one. We have requested Statements on the third Account and had no reply yet, but we have the other two accounts already worked out. I see from other people with over £5K that advice is to split them up. We could probably do this, but it would mean doing it about 5 times, and I think maybe the court would not like it much. If the team have any knowledge of how much this could cost, we might consider the big one, or even using a legal man for it. (In which case we would go for compensation for stress, worry etc as well. Other option of course is to leave the overdraft to run over and then announce to them that we are not going to use the account any more and they can chase us, which would result in a court case against us. We would then put in a counterclaim, which amounts to the same as what we owe on the overdraft. So as you can see, there would be no overdraft if these charges had not been levied in the first place. The more we read on here, the more we think maybe a counterclaim would be the answer, but if the charges are guaranteed to be X amount then we would be willing to take the chance. Don’t really think Lloyds would want this one going to court. Do you?

Hi all, Hows this, rang Egg yesterday asking for statements, they said that there would be a fee, :o I then informed them that under the DPA I was entitled to the statements foc, the statements have now arrived this morning at no cost to me. I have now looked through them and sent Egg the Request for Payment Charges letter, will keep you posted as to how I get on. Still plodding on with Lloyds, are up to £17,000 charges so far on the two accounts we have with them.

Thanks, would just like to verify if the £5000 should include the interest as part of the claim, or is the interest in addition to claim, which would make it a claim for up to £5K without the costs and interest. Sorry but must get this one right before attempting the big one. Also, in the event of losing, are the costs for larger claims likely to go above the £750 mentioned in another case on here? We are considering going for the £12K in one hit, but realise that this would incur costs, but if we won it would be worth it.

The figures quoted for the two accounts were the totals for all the banking charges we have incurred, not the overdraft, sorry if I confused you, I too am confused We will recalculate the figures to six years prior to the date we put the claim in. Do you ask for compensation as well as the charges and interest when you are claiming?
  22. We have now completed the Spreadsheets, these are for the two bank accounts we were running, one closed in July 2003 when it almalgamated with our other account which is still active. The unauthorised borrowing, unpaid cheque and returned items fees for the 6 years previous to closure is £4365.00 + interest. The account which is still active has a total for the same charges of a massive £12982.50 plus interest. The Bank insisted that we move the overdraft facility on this account over to a Loan, we were left with no choice but to go down this road, as we were told that if we did not our account would be closed and we would have to repay the total borrowing within 14 days, there was an arrangement fee of £450.00 which was added to the Loan and also taken out of our bank account, so we have paid £900.00 for a £450.00 fee, this figure is included in the spreadsheet. Having looked over these figures etc we see that at one time over a period of three consecutive days we have been charged £340 for returned items, included in this amount was a charge of £100 with a description of "Recredited Twice", we cant find anything credited twice so are not really sure what this means, anyone out there help? :? We have decided to go ahead and see what we can do to recover some if not all of these charges, do you think we should submit a seperate claim for each account, as the figure for the two combined would be a very large amount.
  23. This is for bounced cheques and direct debits. Once they get their teeth into you they don't let go. It is entirely their fault that the account went over. At one point the amount £6.61, and they don't tell you before they do it. ALSO they dont clear your paying-in, even when its cash, for at least 3-4 days, and cheques cannot be guaranteed for about 2 weeks according to them. But they did take their interest on the overdraft which had to be increased to cover their charges, usual thing from what I have read on here so far.
  24. Yes, the bulk of it in the last 15 months, because they kept charging for lots of items around £20 to £60, and at £35 a time. The only reason we were in this mess is the bank charges, if they had not charged these amounts we would not have had to have any overdraft. Think you will find that we are only the tip of the iceberg on business accounts. A small business cannot carry this kind of unfair charging.
  25. Having now calculated that our claim will be upwards of £13,000 we think we may go for it one in one hit. Has anyone any advice, has it been done before. The Spreadsheet was excellent for working out the interest. Many thanks.
