  1. Went to court with Citi Cards today for a full hearing, but the judge decided to put a stay on our claim until 31st January 2007 pending other cases being heard and the Circuit Judge making a decision on how to proceed.

Have just got back from the Court, the Judge has put a stay on the case until 31/01/07 the reason given that there are numerous cases like ours and the District Judge will be giving directions on how to deal with them all. Judge said that they are likely to have a block hearing of a few cases at the same time, one of which may be ours, he has another case this afternoon against Nat West which he is also going to put a stay on.Looked like this Judge had only just had the case allocated to him as he said that if he had seen the case earlier he wouldnt have let it get to the hearing stage. I tried to appeal against the stay order, but he was having none of it. He kept mentioning that we must have got the idea of claiming the charges from somewhere, possibly the Consumer Action Group, and he said that people shouldnt just jump on the bandwagon, think he was trying to say that he thought people were using this as a get rich quick scheme, tried to explain that this was not so in my case but he just carried on and ordered the stay. Citis Barrister tried the NI case route, but again the Judge was having none of that saying that was a diffferent court in a different county with different legislations. So that was a waste of my time and again a waste of court resources. Tried to point out that the Banks were generally settling before Court, to get the Judge to see that the Banks are wasting Court time but I think he got the impression I thought Citi should have settled mine. I then explained that I was more than prepared to see this case through the courts when the stay has been lifted. Brain or any other expert witnesses were not there today, just the Barrister

  5. I am due in Court with Citi cards next week, they havent offered me any payments with their defence or settlement figure, so it looks like I will be sitting with them next week.

I am due in court a week on Monday, I see that you are all sending PMs on this subject could someone pm me with any helpful tips, obviously dont want to say too much here as dont want to give Citi Cards any insight on what we are planning. They have been right b*****ds over my case just ignore everything and carry on to Court, well I aint frightened of seeing you in Court Citi Cards! Karen29 - I will pm you as it looks like you are in the same area as I am, might even see you in Court. I have to go out until later today so will reply to any messages this evening. Cheers Guys.

This case is one of many hundreds being issued all over the country presumably as a result of the actions of a pressure group and it is in interests of Justice for a consistent approach to be taken and 2. The Designated Civil Judge anticipates trying a batch of such cases early in 2007 as test cases. IT IS ORDERED THAT 1. The hearing on 9 October is vacated. 2. This case is stayed to 31 January 2007 when it will be reviewed by District Judge ------- and either stayed or directions will be given 3. Any party affected by this Order may apply within 7 days to vary or set it aside. What is my next step, do I send the letter asking for it to be set aside or do I have to fill in the Court form for this and pay the £35.00. I am thinking of doing the letter route, any advice? I have also posted this in the general section under "stays are still coming" thread

  10. Hi Andy Dont think anyone has had their charges back from Egg they seem determined to drag it out. I am due in Court on 9th October see my thread Not such an Egg Head Good luck with your claim, keep at it, it will be a lonh haul but worth it in the end
  11. No unfortunately not, would have loved to be a fly on the wall though Dont know about the interest yet Louise will wait and see exactly how much the cheque is for and can then work it out and let you know.
  12. Hi Sarah Yep loads of us have filed a claim at the County Court, Lloyds solicitors play along and usually end up offering a settlement after the allocation questionnaire has been sent in. On my claim when they sent in their allocation questionnaire with a tick in the "1 month extra time box" to allow for trying to settle out of court and then the settlement offer arrived shortly after that. They then have to pay you the 8% interest that you added to your claim when it went to the court and also your court costs and the cost of the allocation questionnaire, so you get a bit extra if it does go that far.
  13. Have had a letter from the Court saying that the Bailiffs have got my money from Lloyds, the cheque will be sent to me when it has cleared through the Court. Will be sending a donation to the site when I have received it. Have you got anywhere with your judgement Louise?
  14. Hi Sarah3891 No-one has actually gone to court yet all settled before hand. It doesnt matter what the amount is,as you say its the principle,they took your money you are entitled to it back. There is always a risk it may go to Cout, highly unlikely, although I think we shouldnt get too complacent about it. My suggestion is go for it, with a small amount they probably wont put up too much of a fight. Have a parachute account as they could close the one you are claiming for, they did with me. Good luck
  15. Just to let you know i have now received from Egg the papers which they are going to rely on in court, these should have been filed by the 17th July but Egg have only just done their bit. In the bundle of papers there were copy statements and also copy agreement and a screen shot of the opening of my account, nowhere on any of these can I see that I requested the CCP insurance they reckon I authorised them to take.The Court date is still on for the 9th October, I have replied to the Court letter asking if I would be willing to adjourn until early 2007 to allow the judge to see the outcome of other bank charge cases that are scheduled. I have obviously replied that I am not willing to wait that long but as yet I havent had a reply. Egg certainly drag these cases out, sorry to hear you have had to withdraw your Claim Jasmin, thinking of how they dragged your case out and have treated you makes me more determined to get the b*****ds
  16. Hi Received from the Court this morning an order for a stay until 30th September to enable the parties to attempt settlement. This is obviously due to MJ ticking the allow 1 month extra box on the AQ owing to the fact they have invited us to a meeting with them in London to discuss our claim. Have had great advice from BF on replying to their invitation. I have posted my letter and also listed my requirements regarding the meeting to MJ but Ms Leeson was away until 30th August and am still waiting on her reply. Will keep you posted on how things progress.

Have just received a letter from the local court which says "Having read the Court file and a letter from the Defendants dated 26/7 Judge ---- has directed that I write to both parties with the following reply: The designated Civil Judge anticipates hearing some bank charges cases in early 2007. Do the parties agree that the hearing on 6th October 2006 should be adjourned pending the trial of those cases?" I am going to say no to the adjournement, but no doubt Egg will jump at the chance to delay matters further. Anyone else had a letter like this? It isnt an order for a stay but wouldnt be surprised if it becomes one when Egg agree to the adjournement, will then have to appeal I guess.
  18. Hi Louise, I just waited until MCOL would let me continue with the warrant. This was only a couple of days after the judgement had been issued, didnt see why I should give Lloyds anymore time they have messed me about so much, couldnt wait to send the bailiffs in, according to the MCOL site they have now instructed the Bailiffs. Dont give them too long, they have kept you waiting long enough to get your money back

After receiving my copy statements for a mortgage account, which is no longer active, I sent a request for repayment of charges on 22nd June to which i had a s*d off reply to on 13th July, I then sent a LBA to which I had no response, so I filed a claim with MCOL on 2nd August for the repayment of £400 charges + £44.74 int +£50 court fees, this was not acknowledged by Lloyds so I issued a judgement against them. I have now issued a warrant against them for the money + bailiff fees through MCOL. Hopefully will be getting the money through shortly now. Would love to be a fly on the wall when the heavies come calling! Lloyds must be a bit busy to have allowed this one to slip through.Will send a donation when this one is completed.

I am in the process of trying to compile a letter to MJ answering their replies to the points I had raised in a previous letter and also regarding their invitation to meet up with me to "discuss the issues in an attempt to bring all of the matters between you and the Bank to a resolution" This will be quite involved as it is not only a case of trying to get my charges back, it also involves many other issues which I have complained about, including one for some sort of compensation for the closure of my business due to the escalating charges being added to the account which made it impossible for me to carry on. I am not sure if I should agree to a meeting with them. I had asked Lloyds on several occasions to enter into a dialogue with me but they have ignored these requests and have obviously got MJ to offer a meeting instead. There again if it went to court and I had declined a meeting, would a judge take a dim view of this. Again if any mods would like to see the letter I have received and give me some much needed advice I would be grateful.
  21. Hi. The documents I sent to the court were a witness statement setting out all the details of what I was claiming and why, also details, dates and outcomes of all my letters to Egg starting with the DPA request up to and including the Allocation Questionnaire. Copies of all letters sent to Egg, replies from them, all e-mails to and from Egg, Spreadsheet of charges taken, Court claim form and correspondence to and from Courts. In short this means everything that you have sent or received relating to your claim. You also have to send a copy of everything to Egg as well as to the Court. Its damn annoying when we manage to collate and send in all our information and then Egg (with the number of staff they employ))turn round and tell the court,on two seperate occasions, that they are having trouble getting all their documents from archive.Obviously more time delaying tactics.Hope this helps you and good luck, keep us posted
  22. Hi Have posted my update with egg on my thread "not such an egg head" which shows how Egg are not complying with the order from the court by not submitting their documents. More delaying tactics methinks!

No havent been assasinated by Egg have been away and then had great problems with broadband connection, but that seems to be sorted out at last, so here is the latest.Had a letter from local County Court on 6th July giving a court date for 9th October also had an order to get all documents I want to rely on in Court and a signed witness statement to the Court by 17th July, which I have done. Have heard nothing from Egg so dont know if they are intending to go to court or what, Part of the order was to send copies of supporting docs to each party, I sent copies to Egg, but have not received any of their supporting documents, I have just rung the court and Egg wrote to them on 17th July asking for more time to submit their documents as they were having trouble getting them from archive, they then wrote again on the 28th July still having problems, it has now gone to the Judge who is going to make a decision on this, they have a backlog at the Court at the moment but will let me know the judges decision as soon as he has made it, so watch this space. As far as the termination of our account on the 12th July is concerned, I have e-mailed Egg many times asking for the reasons why but all I get is an automated response saying it has been passed to the Borrowing Team, the account is still active and the payments still being taken by Egg through Direct Debit monthly .
  25. hI. sorry havent been around but have been away and then had huge problems with our internet connections, alll sorted now so will now put you up to date. Have this morning received a letter from MJ suggesting a meeting in London at their offices, this letter is a long one and apart from the meeting it deals with other issues regarding our claim so I wont reproduce it on site, if any mods would like me to pm them a copy so they could give me their views on it let me know. They are inviting me to a meeeting to discuss my claim for the repayment of the charges taken and also I presume for the consquential closure of my business because of the escalating charges. I would like some advise on how I should deal with this, has anyone else been offered a meeting? I will put an explanation in the pm regarding the other details as they are quite complicated.
