  1. Just a quick question-

     

    Can debt collectors add interest?

    I'm just checking a old debt for a credit card which I think might be s/b or nearly, and by looking through some letters (I don't have them all) but have noticed that the debt is still rising one letter from 2006 is just over £1000 the most recent letter says around £1300.

  2. Hi I have had help from here before for other matters and do have quite a lot of debt that i'm am trying to sort, here is one that is quite a problem.

     

    We had a secured loan from welcome finance which turned into a unsecured loan when our home was repossessed last year, it took welcome a week to realise what had happened and kept ringing my sister until I spoke to them. we owe around £23000. The original loan was over 25 years when we took it out the payments were around £450 a month but we couldn't afford this so they did a new agreement which put them down to £250 I can't remember signing a new agreement for this but did sign something, I do keep all paperwork and could have a proper look if needed.

    We haven't paid anything to them for about 6 months as they are adding £220 a month interest on the loan plus made up fees for phonecalls, so really can't see the point as nothing is coming of the debt unless we pay more than £250 a month which we can't afford.

    We have today had a letter saying someone is coming out to see us if we don't ring them in the next 48 hours. I really don't know what to say to them I'm sure they won't accept £30 a month and it would be waste anyway as the debt will never be paid. I would love to sort this out and start to clear the debt but with all the interest I can't see how.

    We did get a default notice of them a while ago and it said the total payable if paid over the full term would have been over £70000.

     

    Is there anyone out there who could advise me on what to do?, I could have a look through the paperwork if needed for the proper figures.

    Just to let you know i sent the letter and have today received a reply saying they have noted what what said and have made a new payment plan for 3 months. I did ask them to send it back to the council but they have ignored this completly, but as I can afford the instalments shall I just accept this?. They haven't added any charges.

  5. yes we recieved both. I'm going to post your letter today and hopefully it will keep them of our backs for 2 weeks do i have to mention why he is vunerable our just copy it to the letter? I will also try to email it them but they only allow you 250 words so don't think it will fit. I will also send a copy to the council shall i mention this on the letter?

    All the correspondence does have my oh name on them and depression doesn't class as vunerable we looked in to it before. also i forgot to mention his grandma died last friday so is dad is here quite a lot at the min so this makes me more nervous of them calling.

     

    do you no how quick they will call or will we get time to make the full payment on the 22nd? we can not make it before then. would it worth while emailing them again and telling them we are going to clear it up on the 22nd and ask if they could wait until after that date or will they call just to add charges?

    We have a outstanding debt for council Tax that stands at £500 (was 800 to start with) which is with b&s which is only in my oh name. A arrangement was made to pay this by instalments of £150.00 per month by email with them. The last payment was not on time as we just didn't have the money, my oh has been on short hours since nov last year. We have emailed b&s to tell them and told them we will make the payment this friday and the following payment on the 22nd which will bring the account back upto date. this will them leave a final payment to be paid in august.

    B&s have emailed back to say the arrangment has been canceled and that at baliff will be coming to our home soon to resolve this matter.

    How can we stop them from calling? At a real push we could clear the full amount up on the 22nd which is only 14 days from now but how do we keep them away until then.

    My 12 year old daughter comes home from school and has to be in the house for a hour while waiting for us to get home from work and I am scared they will call while she is on her own.

    They have not been in the house before so no fees have been added at all. I know not to let them in but we live on a main road and when faced with a situation especaily my oh will end up letting them in ( he suffers from depression and can not cope with difficult situations).

    Please help I have to go to work this afternoon and I am scared they will call.

  8. not heard anything from them yet and its a year ago this week. we didn't give them a forwarding address but we are not hiding and are the electrol roll so we are not hard to find. we have only moved just down the road so we pass our old home all the time and the people that bought it got a real bargin, but it don't bother me anymore things had got so bad it was causing problems in our marrage and every penny we earn't went on trying to keep up with their ever increasing payments. I know they went bust just after taking our home so don't no if they will bother chasing for the shortfall but if they do we will go bankrupt so they are not having another payment out of us.

    It was the hardest thing we have ever done and we didn't get nuch support when we was going through it we could have cleared the arrears by borrowing of everyone if we really wanted to but their payments were getting so expensive we still wouldn't have kept up with it, so we decided to let it go and now a year down the line we are renting a nicer house for half the money and have our life back and most of all we are smiling again.

  9. I’m really worried about a friend at work she has had a repossession hearing for the end of this month.

    She has rung up the mortgage company in a panic and offered them full payment of around 400 pounds plus 350 pounds a month of the arrears they have told her this is ok but they will still go to court just to secure the deal, they even told her she didn’t have to bother going if she didn’t want to.

    She has filled the court papers in stating the same thing.

    I know she can’t afford this amount as her partner has lost his job and she only earns a small amount each week but she is making out it will all be ok.

    I lost my home last summer but she doesn’t know this and I didn’t really want to tell her as I wanted a fresh start without the thought that everyone was talking about me, but she is doing the same thing as I did not telling her o/h the full story, making out she can cope, offering more than she can afford and pretending everything is ok and I know she will lose the house eventually.

    How can I help her without interfering to much and having to tell her about what happened to me?

  10. We would also point out that the OFT say under their Debt Collection Guidance on statute barred debt that “it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period”.

     

     

    Call me silly but this is the bit that confuses me I have heard from them they have sent loads of letters I just not replied to them.

     

    The problem is they don't no where I am living at the minute as my home was repossessed last June, they have nearly caught up with me but only have half the address the town and postcode are wrong, the only reason I know about the letters is because the postman is my aunties best mate so i wanted to be 100% sure before contacting them.

  11. Hi everyone,

     

    I have been looking up about statue bared debts as I have a c/c from about 7 years ago for which I am being chased for.

     

    I understand that if you have not made a payment in 6 years it becomes s/b which I have not and I have not admitted the debt since defaulting.

     

    But I have have debt collectors chasing it all the time since defaulting (lowell bought the debt in 2006) I must have loads of letters from them, all of which I have ignored I have never had anyone at the door and never spoke to anyone on the phone.

     

    So is the debt statue bared even though they have been writing and ringing? or because they have been trying to contact me can they still take me to court? Lowell they are still threatning court action.

  12. Thanks again please don’t get annoyed but to just make sure before I start could you just confirm these points

    I should have been given two weeks notice from the date of the letter from the council to the bailiff calling is this the law?

    This call is classed as a first visit and those charges he charged was correct

    (Not sure what a redemption fee is)

    The second visit was with a van which he charged me 230 for but set up another arrangement (under his terms) according to the list of fees the council sent me they can charge you reasonable cost for one visit with a van

    The third visit was with a van again I was charged another 230 and another arrangement was set up, should he have taken my items then and not set up another agreement?

    I should have only been charged £1.00 max per card transaction even though it says 4% on their website and letters.

    Also one more sorry to be a pain but what do I do about payments do I still keep paying or stop for the moment.

    Again thanks I have to leave the computer now but will check back tomorrow so I can get the ball rolling.

    I didn't check if they had a certificate never thought to.

    I can't remember if I had notice of the first time they called with a van I don't think they did I have all the letters and notices they have sent me I will have a look to make sure, but I do know they defently didn't give me notice the second time as it was not that long ago.

    So what can I do about it the council are not interested and I don't know where to start with a letter?

    Also I thought the council had to give you two weeks notice that they had passed the debt on I only got 8 days from the date of the letter to them calling, this can be proved by dates on the letters I have.

    Because of the second debt they have put my payment up by £85 per month to £235 per month which I can not afford so I am frightened they will call again.

  14. Hi everyone I have a problem with b&s bailiffs so I am hoping someone can help.

    I have a debt for c/t which when passed to the bailiffs stood at 1276.25

    They turned up I let him in which I now was silly but I can’t turn the clock back. They charge me on that day – 61.00 levy fee 12.00 walking possession fee and 24.50 redemption fee.

    He tells me I have to make a payment of 73.00 and further payments of £200 a month which I told him I couldn’t afford but he just shrugged his shoulders.

    I make the £73 payment and then a £110 payment the following month but didn’t make anymore. I get home from work one day to find a note pushed through the door saying a bailiff removal team had called the balance now said I owe £1420.31 but it didn’t say anything about fees added I then make regular payments but was sometimes a little late but I always got in touch to explain and everything was ok then a payment was £10.00 short which wouldn’t have been but because of their 4 % charge for debit card payments I was a few pounds short in my bank so I thought it would be better to pay most of it and the 10.00 that it was short the following payday but a week later a bailiff turned up to remove my goods he stood there threatening and in the end I told him to take what he wanted he then gave me a removal letter which said he would accept £150 a month but had charged a 230 fee

    I have got an itemised statement from b&s its says I have paid a total of 1263.75 they have added 557.50 in fees which includes two van/abortive removal fees plus 30 in debit card fees and £701.25 has been paid to the council I still owe £600 which is 575.50 to council and £24 in fees.

    I have read that they can only charge you twice for a removal van and the second time they must take the items but I have been charged but they didn’t take the items in fact he didn’t have any intentions of doing, but I don’t know what I can actually do about it, could I get these fees back?

    Also when they sent the statement there is another debt been added for this year (this is because the council wouldn’t help me out even when I went to see them personally to explain I couldn’t pay bailiffs and this years at the same time) do they have to gain entry again for this other debt or can they just break in because they have entered for the last one?

    I’m really sorry for the long post and hope someone can help me sort this

  15. Right people I have been reading this forum for the last hour and I am getting more and more confused please can some explain what’s happening?

    Brian carter took me to court in 2004 to get a ccj for alliance and Leicester it was agreed for me to pay £30 per month, which I haven’t really kept to. Every so often they will apply to court for a warrant of execution I then make one payment plus the court fee and nothing is mentioned again for ages. The last time was in Nov 07. Everything including the court papers says Brian Carter & Co Solicitors. Where do I stand with this?

    The funny thing about all this is the amount was because of bank charges, which I am in the middle of claiming back, they want just over £300 and I want £3500.
