  1. Hi you have helped me before with a problem with bailiffs but now I have another problem.

     

    we had an outsatnding amount for which the bailiffs refused to set up a payment plan for and said they where going to call, anyway as my o/h suffers from depresion and is under a doctor with peoples help on here we wrote to them with the vunerable letter, they didn't send it back to the council but did agree a payment plan which was ok with us anyway this has now been cleared up but we have had this years sent to them now as the council wouldn't wait for us clear the other up and we couldn't aford both at the same time.

    I e-mailed the baliffs office and offered to carry on paying the £200 a month to clear this up they have replyed saying it is not acceptable and they will be calling at our home and will not be entering into any payment plan. we owe £900

     

    What can we do now? I'm sick of being on edge about all this not knowing when they are going to call.

    Do we have to resend the vunrable letter?

    What if they turn up today? we live on a main road next to a shop so will be embarrising not to let them in.

    Please can anyone help?

I have just had a look at the last warrant from when I set up the plan and the amount outstanding is the same as the one I have had today so they are saying they have had no payments at all even though I have prove they have I paid it at the tsb bank with the book they sent me. Why I should I have to pay £35 to sort out their error? Its not fair plus I can't afford it.

  3. I have a CCJ for a loan which i pay by instalments of £80.00 per month.

     

    I paid the 1st payment by phone then missed the 2nd because I couldn't get in touch with the company by phone, I wrote to them and asked for a payment book which they sent and I have made payments since, but the last payment was late by 2 weeks due to me being short of money at the time, this last payment was made 2 weeks ago and the next payment is due today which I was going to pay friday.

     

    Today I have recieved a warrant of execution by post giving me until the 28th sept to pay £737 to stop action as I have not paid the judgment.

     

    Is there anything I can do to stop this as I have not ignored them was just a little late paying I think they are being really unfair.

     

    They must have asked for the warrant after I had paid

     

    The judgment is for over £8000 and is with SCM solictors.

     

    I have never recieved any post from them I didn't even know I had a CCJ until I recieved a warrant of execution thats when I replied to the courts and got a payment plan but I have moved home so they must have sent the paperwork for the CCJ to my old address even though the 1st warrant came to my new address.

     

    Please can anyone help I am really worried the baliff is going to turn up.

  4. On the comments it says NOD? issued and on the same day Termination letter sent, should they have sent me a copy of this letter in the SAR?

     

     

    also it says they have done an arrestment? earlier on this year first I have heard about it, they have got me working somewhere I have never worked before and they are appling for a aoe I thought they had to take you to court first?

     

    Can anyone help?

    Just to let you no I sent both sar and cca request by recorded post with postal orders in different enverlopes on the 7th and received a reply from welcome dated the 9th thanking me for my letter making a sar request . they acknowledge receipt of the £11 processing fee and it is being proccessed.

     

    What about the cca this is not mentioned? shall I just sit and wait.

    And is it 12 working days or 12 days from when you posted?

  7. Hi everyone again I have already asked another question about welcome but as I was looking through some of the posts I noticed one was about unenforceable agreements so I thought I would have a look at mine.

    It is a secured loan agreement, I did already have a small loan with them and remember asking them if I could top it up by£ 500 so I could go away for a few days, they couldn’t do this but could do a secured loan for me. Me being stupid agreed to this and ended up taking a loan for £17000 instead.

    Anyway I’ve just had a look at the agreement and I have a blue copy which says on the top- copy of proposed credit agreement containing notice of your right to withdraw this has all details of the loan on it and says something about it has been given to you and you have at least a week to consider the terms before the actual agreement is sent to you, this is signed by myself and my partner and someone from welcome dated by all of us 03/08/07

    I also have a yellow agreement that says fixed sum loan agreement regulated by the consumer credit act 1974 with the exact same details and the same date as the blue copy 03/08/07. It must have been the kind of agreement where you write on one and it copies it through the paper because everything is the same even down to the dots.

    I can remember them giving me a cheque and this was put into my bank on the 06/08/07 as I have just checked my statements

    I also have a copy of the legal charge which is dated the 03/08/07

    They also added all the normal crap homecare etc which I already had from the last loan but they still added it.

    We went into their office to sign for this loan I can vaguely remember something being said about they can’t contact you for a week but can’t remember if this happened and this is the only paperwork I have.

    So what do you think is it unenforceable or not.

    I've printed them off and put both our names on them

    Just one question did they still hassle you while waiting for them? They keep sending us the odd letter but they keep ringing my o/h work every couple of weeks I did write to them about a year ago and ask them not to ring work as it is getting him in trouble but it has been passed on to a different department since then.

    Don't no about you but welcome was the biggest mistake of our life

    We intend staying here for a least another 4 years so say we had a meter fitted and cleared the debt and we asked them to change it back would they do it then or is it forever,

     

    sorry for all the questions but I don't think she would be happy if she found out about the meter and I can remember when I rang up e-on to tell them about the house they said they did know her and had a good relasionship with her.

    the debt is a combination from our old home and our new home they have put all our gas and electric together as one bill I did write to them a while back and ask them to bill us for our new home seperatly and set up a payment plan for the new address but they ignored this completly so I rang and they put everything together and wanted £70 a week.

     

    we only get a bill through email but i have never recieved a final bill from them for the last property. I can remember getting a welcome to your new home letter when we rang to tell them we had moved in but I can't remember if I agreed to have the debt combined, are they not supposed to do this?

    I owe over £2000 in gas and electric arrears to e-on this is a combined debt for my previous property which I owned and the property I live in now which is privately rented.

    They have now sent this to their in-house debt collectors with a threat to come out and visit.

    I did set up a payment plan with e-on about 3 months ago but they wanted £70.00 a week, at the time I couldn’t afford this but it was the best they could offer.

    They sent me out a payment card to make payments at a pay point outlet.

    Does anyone no what will happen next by them?

    Could I start to make payments on the card? Would this stop them taking things further? I am in a better position to pay now even though £50 would have been better as my o/h hours have increased at work.

    I can’t have a pre payment meter fitted as I am scared they will tell the landlady and we don’t want the threat of being kicked out we went through loads of problems last year and are just settling down.

    We have a 12 year old daughter.

    Someone please help I am worried sick about this.

Just to let you know I wrote to natwest and asked them about stopping the charge and explained it would cause me hardship if they took the charge, but there reply was there was no error on their side so the charge stands. What I didn't realise until looking properly was I had 2 charges going out the second was from the same day for a second d/d they didn't pay so a total of £76 was taken from my account yesterday.

     

    So thats me skint now until next friday but they won't catch me out again as I am canceling every d/d I have with them. I have another account with Barclays which I don't use but their charge for returning a d/d is only £8.00 so I going to set up a transfer for money to be sent each week to cover the bills and I'm going to write to Natwest and tell them this.

     

    I am so angry I don't earn much and they have just taken half of it:mad:

  13. Hi I have just recieved my bank statement and I have a charge of £38 going out on 12th August for a unpaid dd.

    The dd was for £5.50 and there was just under £2.00 in the account (this was due to another charge that went out that I had forgot about) my wages went in the next day which have been doing for the last 6 years.

    Is it possible to stop them taking this charge it seems unfair for the sake of £3.50?

    I'm not very good on a phone so if anyone could help with a letter that would be great.

  14. I can't find all the paperwork I seem to have all the statements the last amount paid was in dec 02 the balance then was around the 500 mark the next bit of imformation is from 06 from a dca and it had shot up to over £1000 but i'm not 100% sure if I made a payment after dec 02.

     

    As for the other bit I agree with you but they think they are above the law so let them get on with it they are just hoping people will agree with it to get them of there back

  15. Thanks for the quick reply, So if it s/b and I send them a letter do you think they will stop adding interest or would they carry on forever.

     

    Oh and on another point don't no if this is of any interset to anyone but a known doorstop lender have started buying debts and are sending the callers out to knock on peoples doors and demanding payment if they can't pay they are giving them a loan to pay it back that way. I no someone who works for them and has just started to do this.
