  1. I am currently on the website acknowledging the claim forms now & want to defend. Is it just the acknowledgement of service form I click on?....what happens next?

Thanks Rory I now understand why a full defence is better.....I just got a little worried about it earlier as I thought if I fully defend the claim & it goes to court would the judge not think that I have been wasting time when I knew that I owed money to them and I would be asked the question ' why did you fully defend when you knew that you owed money to HFC in the first place.
  3. Excellent I will log on tomorrow morning & acknowledge the forms. Rory, im sorry to drive you mad, but if I defend in full is it not saying that I don't owe them any money. I have never been in this situation before & am so nervous.
  4. Right....I thought that you defend in full if you don't agree that you owe the money and partially defend if you owe money but not the figure they are claiming, which is my case :o
  5. Rory, just for my own knowledge, why is it better to defend in full if you know what I mean?

  8. Received another letter from Cabots: Dear xxxx We write further to your request for information under sections 77 and/or 78 of the consumer credit act 1974. Although Cabot has requested the information, the original lender is experiencing a delay in retrieving the information from its archives. We shall send the information to you as soon as we receive it. We will as a gesture of goodwill put your account on hold until we receive further communication from the original lender. Absolute garbage....

  10. Never received the call that they promised for today, personally I think they were just fishing around trying to find out what my intentions were & planning to do with regards to the court claim.....

  12. Received another letter from Cabots saying they are not entitled to provide me with a cca but will look into it and they should be able to provide me with it within 7 days. However if they are unable to provide it within the 7 days they will write again....
  13. No phone call from Weightmans so far today. Doesn't surprise me though!!!

  16. I find this very strange....yesterday they said that they had/were issuing legal proceedings and didn't have to speak to HFC. Today they have spoken to HFC and then rang me to discuss it.......what they playing at??
  17. Update.....just received a phone call from Weightmans. They had spoken to HFC who said that they had not received any letter or correspondence regarding my SAR & wasn't aware of any dispute. I told them that I have proof that my SAR was signed for on xxxxxx & I have received a partial response from HFC..... They said 'Oh', I can't understand why HFC have said that then. I said 'not my problem'. Weightmans are going to speak to HFC & get back to me....
  18. Is it 14 days from date of issue to acknowledge the claim, its just that it mentions something about a further 5 days on the form from date of issue?
  19. Just to confirm: 1) Sending letter to HFC regarding lack of information that they have sent me 2) Letter to Weightmans regarding account in dispute 3) Letter to Weightmans requesting for information. Do I also need to acknowledge the court claim?
  20. What happens there then? Is that something that we will deal with at a later stage?
  21. With regards to the particular of claim, the figures don't seem to add up. If I add up amount claimed + court costs + solicitors fees its different to the particular of claim section......is this a mistake on there behalf?

  24. Particulars of Claim Breach of agreement pursuant to the consumer credit act 1974. (1) The defendant entered into a written agreement with the claimant. This agreement is regulated by the consumer credit act 1974. (2) The defendant is indebted to the claimant in the sum of £17543.41 and in respect of the said agreement under account number xxxxxxxxx and maintained by the defendant at the Claimants branch and the sum of £2793.52 in respect of costs under the said agreement. (3) In breach of the said agreement, the defendant failed to make payment in accordance with the agreed payment terms and the claimant issued and served a default notice upon the defendant and pursuant to section 87(i) of the consumer credit act 1974. (4) By letter from the claimant to the defendant, the claimant demanded repayment of the said sum, but the defendant has failed to repay the sais sum. (5) In the premises, the defendant is indebted to the claimant in the sum of £20,336.93.(6) The claimant therefore claims the balance under the agreement.
