  1. Thanks Rory. If I send it GNDD to get there Monday 9am, would that still be within the courts timescale. The guy I spoke to the other week at the courts, said it had to be in by June 1st (sunday), but because it fell on a weekend it would be June 2nd (Monday)......does this mean by close of business that day?
  2. I have been ill in bed all week & haven't been able to get to the post office to send the defence to the court. Please could someone tell me whats the best thing to do: The court said that my defence had to be in by Monday June 2nd. Should I try & complete it online with MCOL or send it tomorrow GNDD. If I send it GNDD does it need to be there for Saturday morning or Monday 9am. I don't think that the courts will be there on a saturday morning. If it gets there by 9am Monday is that within the timescale that the court mentioned.

  4. If issue date on a claim form is April 25th is it 28 days from that date for a defence to be sent in by or is it April 25th + 5 days + 28 days. Its just that on the back of the claim form it mentions an extra 5 days from issue date

  10. Received this letter today from Weightmans: Dear Sir, Please note this matter has now been transferred to our commercial dispute resolution department as you are disputing our clients claim. We note the content of your request for information and write to advise that we consider your request for a reply within 14 days to be unreasonable. We confirm that we will respond to your Part 18 request within the course of the next 14 days and confirm that we will agree to a reasonable extension thereafter for you to file a full & proper defence. Please could someone help me on what I need to do.....

  14. Received a letter from Scotcall today...... Creditor: Scottish Power Dear Sir, Your above oustanding debt has now been placed with 'Scotcall'. Failure to pay or contact us within 7 days of the date of this letter will result in your account being passed to our field reps to arrange a doorstep call. Firstly I wasn't aware that I owed Scottish Power anything, as we currently pay by direct debit. Secondly I don't want to deal with Scotcall.... I know I can't CCA Scotcall, so how do I deal with this please?

  19. Ok, so I don't need to send the letter above that 42man posted as the 40 days has now expired. Just template 2. I also need to commence proceedings against them (Data Protection Act Non-Compliance - Particulars of Claim).... I have just read through the link you posted, how do I start these proceedings?
  20. Which letter do you mean? Is it the LBA or the one 42man posted? What do you mean Rory?
  21. The 40 days expired on the 11 May, I have posted a letter before action to them as well.
  22. Do I also need to send a letter telling them that the agreement is unenforceable as its not a CCA but an application form?
  23. No its very hard to read. I cannot see anywhere APR, Credit limit, repayment date on the application form. What letter can I send them?
