  1. Ok here's where I need some expert help. Recieved my s.a.r bundle from Capquest . They have emailed Amex to remind them of my cca request .So yes they are in default.I have a copy of a letter dated January 2008 saying they sold the debt in December 2006.A copy of my original application, No payments have been paid with request to this account , since I reckon 2001 direct to Amex as thats when I lost my job. Ok no CCA as yet , but any suggestions please......
  2. well done , it seems that Capquest have gone quiet with me , awaiting SAR request and the two cca requests I sent , still waiting (one not fully compiled with and the other way over time) and then like you egg....
  3. Well done Norwich , it shows if you keep at it - you will win. When you say ppi against littlewoods , was this against the catologue or credit card /barclaycard? With regard to mine I have had a standard letter saying they are looking into it. see what happens , thats why I am interested to hear if anyone has been down the same road against littlewoods for ppi reclaim.
  4. I would pass your case on to the FO as I think if any one has a case of misselling its yours , what Littlewoods will have done is sent you a standard letter , I would complain to the FO and take it from there . But dont give up!
  5. Yeah it would be interesting o know what happened after Capquest sent the debt back to OC , as if Capquest felt they couldnt collect what hope would the original creditor have ?
  6. Hi there - I did agree to the insurance , the costs were monthly as a percentage of your balance . I cancelled last year due to the fact as I was ill for a short time and called up to enquire , and was told that as I had that illness previously it would not be covered (type of MRSA , infection - which put me in hospital twice) so no point having this policy as I was paying around £25 per month on each account (three accounts) , paid this for two - three years. So was quite mad about it , anyway I suddenly thought this month about it (Lost money) . I have now written a letter with all my current and previous account numbers on and sent special delivery. So I was wondering if anyone else had tried to claim back via shop direct group . The way I see it is , the insurance would only pay out if I died or were made redundant from work.

Hi upon reading other peoples threads - I wonder if I have a case to reclaim , I have and had since 2005 three accounts with Shop direct which owns the above brands .The accounts are not in arrears and well run , last year I cancelled the insurance on all bar one , which I forgot until last month when I also cancelled the insurance with Additions , as I felt it was a waste of time. Do you think I have a chance in reclaiming any back? Has anyone else had success claiming from these companies? Thanks!
  8. reading with interest as I am still waiting for Capquest to come up with the CCA re egg , my account with them was closed seven years ago , wonder what the chances are turning up with the paperwork?
  9. My friend has a £4k loan with HSBC with insurance of around £800 ish . Question is he is not english took the loan out in 2006 , when they gave him a graduate loan and account (dunno why as he's not at uni , on a student visa)and working part time . I read the insurance and can't see how it would be of any use to him. The loan is half way through the term . Would he be able to cancel the insurance and claim the insuance back ? When they offered him the loan he had only been in the uk 10 months - I can't believe how easy it was to get ! Any advice?
  10. Yeah it was a credit card , so I will now report this to trading standards - as it was Capquest I asked though do I still send to Brighton or Capquests local trading standards? Do I also send Capquest a letter telling them they have now defaulted on my request? ( I have seen a letter in the libaray )

Sent a CCA request and recieved a reply on 28th December , standard letter saying they will get back to me etc. I realise 12 days + 30 then they are in default , would that have included bank holidays and weekends? Because if thats the case I recjon they are out of time , and what would be my next move?

Well I hope they resolve for you , mind you the first time my limit was reduced I called up to change my address and they put me on hold - never said they were doing a credit check and then she come back on and said my limit had been dropped ! I was so embarrassed , the new limit was under my balance to which I asked if I were going to be charged or penalised for , and she said no. A credit card I had (closed and paid in full!) dropped my limit , never told me twice and sent a letter confirming this two weeks later! Yes they can do what they want . Like you and many people here I used Next as it has been a good way of building a good credit history again if run correct. But I think this year anyone with a less than 'good' credit report will find that limits are dropped , interest increased or accounts closed altogether.

I had this problem with Next - my limit has gone between £4K down to £800 and up again , this has happened about six times in the last year despite having a 100% record with them for five years! I was told by a lady at Next that they have implemented a new system which checks peoples credit files every three - six months and will reduce limits on accounts or even close , as in your case . I can understand your frustration and if you want to know what Next have on you , maybe send a subject access request , although this will cost you £10.
  14. I have drafted a letter quoting the data protection 1998 and the infomation commisioners advice. Now I will send by recorded again , saying that they know who I am and if they still mess me about I will not correspond anymore and will regard any alleged accounts in dispute and will report to the information commisioners office straight away. Wonder why they wanted a photcopy of a driving license or passport........................mmmm
  15. Thank's - spoken to the information commisoners this morning . What they have said is that Capquest should treat my request as complete info they have on me with all accounts and info on there systems . They also said that they can ask for extra i.d - but as I haven't got a driving license I will just have too send a utility bill. They also said the 40 days start when they have complete info too start and that if Capquest get silly to go back and they will take up on my behalf. I did think this request would be straight forward and that I would recieve all the info and be able to start to resolve!
  16. HELP! Capquest are a joke - I have recieved a reply to my S.A.R from these people , I gave them account numbers I was aware of but also made it plain that they should release all info they have irespective of which accounts , I sent the templete from the libarary. I enclosed ten pounds.. They have replied saying they can comply per account , I have to enclose £10.00 and photocopy driving license and a document which links me to my address. Have I done this right ????- shouldnt they comply with everything on there systems without indivdual account numbers - I have already sent a chq (not cashed - and from a friends account). Surely they know who I am from the correspondence and letters they have sent me. Whats going on , I thought this would be so straight forward. Has any one got any suggestions? Where do I stand , cos if I send as they want , more info , they are only going to send the S.A.R for one account. please anyone..I need to reply asap

  18. Thanks - I have put a letter together outlineing what they should be doing and how as per my original request they have to comply fully . I have also said that once they produce the report they should not then come back and say 'oh we have another alleged debt of yours'. Funny you say about that they are in default - another ten days and they will be in default on another cca I requested. And with the original request here I have written saying that they never fully complied and am still awaiting infomation - lets see what happens.
  19. Ok , I am writing a letter to send back to them reminding them that a S.A.R should show ALL the details they hold on me ,with any accounts - I am also giving reference numbers where I have. Anyone any pointers to how I can word the offical bits?
  20. Well I wrote off asking for S.A.R with Capquest - just recieved a letter asking me to supply account numbers saying they need this info to be able to generate the report? I sent £10 - I supplied addresses for the last six years. Have I missed something out? I know I have been told , but should'nt Capquest produce ANY accounts or details about me? Any advice on writing back - has anyone ever had this before? If I send any account munbers I know of - how do I know there may not be more accounts on the system? They want me to call by the end of the week otherwise they can not assist me. I never imagined this would be long winded........
  21. Thank's - first I will reite a letter to Callcredit asking why its still showing and why they have not responded within there messging system. see what reply I get. I notice though on the summary page , it shows no 'active' default only when you look at credit agreements , I thought maybe it was a mistake until checkmyfile.com give me my monthly update and it was still being reported by callcredit. They must have a different system to Equifax or Experian. I also notice that some credit companies actually take a feed every month from your credit file when they update , so they can see your file without doing a credit search. Do anyone know more about how this works?

Sounds a very interesting point this - so many horror stories you read about , baliffs flexing there powers and the police just going along with it .I'm with everyone on this - I could do Northumbia or any other forces if it helps , once the official letter is drawn up , and it will be interesting to see how mush the chiefs differ!
  23. Back to the same - CallCredit are still showing the default , which should have came off on December 14th 2007. Equifax and Experian , it is not showing on . On my summary with Checkmyfile.com , its also showing , I have queried this with Callcredit through the message system over a week ago and had no reply - any idea if I am within my rights and if I should now write to them quoteing any legislation?
  24. No , my windows look out to the back and there is no way he can get there!Its only my front door , which actually comes straight into my sitting room , where my tv etc is on show. Can he insist to meet me ? Will he charge for this visit? If i open the door , he could then try and walk in? I mean , I was genuinely unaware of this debt , and will pay - I am trying now to sort my life out (thanks to this forum - which helps you take control) but I do not want him to make a fool of me!
  25. Hi there - I think that only applies to credit agreements I think , council tax , after a liabilty order has been issued is always collectable (if I am wrong please tell me). Anyway a update I am liable as it was in my name and the company I worked for do not trade anymore. I fired off the letter this morning , no reply.I called the baliff who wants to meet me Monday - I told him fine , but he's not coming in my house and I will pay over installments! Also asked the council too send me statements to see how the cost added up.
