  1. oh dear, just out of interest did they pay up the full 8% interest? i'm having a bit of a battle to get it (see thread) congrats on winning tho.
  2. ok let me see if i have this right, on the spreadsheet there is the column with 8% on penalties and the column that says 8% on interest on penalties (in yellow). This is one i sent and that i am claiming along with the other charges (blue). the obnoxious man is mixing up the daily rate with these (I believe) and therefore i should get all the four totals added together. Yes? surprisingly the office is closed so will have to have a go in the morning!
  3. ok i think i have a problem -just had a phone call from someone claiming to be a senior manager who has recinded the agreement previously done for half of the 8% interest £223. he tried to tell me that the 8% is only from the date of issue to the date of settlement - 5 days. about £4 for over £2000 claim, the spreadsheet works on the whole amount, who is right, i copied the template about the s69 county court act that states from 2000 until date judgement. very patronising man!!!!!!!!!
  4. there was a dispute over exactly when the 6 years started. They said the issue date, I said the prelim letter date, in the end we have agreed a figure and the money should be in by Monday at the latest. then I can go shopping for that window, patio and pay off some other bills. now on to capital one.................
  5. yes yes yes, letter from halifax offering the whole amount (bar the 8% interest, no mention of that) and costs. the letter states it will cost more to defend than to pay, without admission of liability, purely commercial etc.... so they will put the money in sometime over the next five days. do i let them off with the 8%? or not. can a moderator change the title to ***WON*** please
  6. got the paperwork from the courts back today. deemed served on the 17th. no money in my account yet though, but watch this space...............
  7. ooops too late now - just got back from filing claim at court. this morning got another letter offering £450 - ah no sorry. bit scarey really taking a bank to court !!!!!
  8. finally got the rest of the statements, going to add them up now. money money money.........
  9. ok had a cash flow problem so couldnt file claim, but i can now and have got the pdf N1 form mostly filled in. on the value bit, do i put the monies as itemised or just one lump sum including the court fees and 8% interest? going to hand it in tomorrow.
  10. just rang them, a nice man karl johnson rang back to say this is it take it or leave it, so.......... see you in court then. He did say that other people have the same complaint - I just bet there are!!!!!! strange though he couldnt seem to give me a breakdown of the charges.
  11. today got a letter from robert udy offering £272 because they have now dropped their charges to £12. nope i want my £789 back, although i will tell them they can give it to my account as a partial payment.
  12. finally got two years worth of statements - apparently the others are coming in drips and drabs! so far over £200 in unauthorised overdraft fees and unpaid cheques. I can claim these back cant I?
  13. is there anyone who can give me advise on the default problem. the letter is very much in jargon, but it seems to say it was my own fault and i was warned if i couldnt meet the contractual obligations i would be defaulted.
  14. update. got a letter offering £150. I dont think so.............. Is there a template letter somewhere on here that shows me how to word it so I accept the money but not as a full and final settlement. Does it need to be a legal statement i have to send, then i can use the £150 to take them to court to get the rest.........
  15. well got a letter from tesco totally denying all responsibility for anything so off to court i need to go, bad news is that i have to wait for payday before i can afford it. is asking for the defaults to be removed going to be a problem? as the letter says that it wont remove it until the account is cleared, which is going to be a while as i can only afford £10 a month. any advise please............
  16. oops just rechecked the letters that i have on file that i sent to mint and tesco and i have just noticed that they are the lba letters. this means that i didnt ever send the prelim ones. not sure what i do now. do i let them have the 28 days they would have had if i had got it right or the carry on with the 14 days (tomorrow)and just put in a moneyclaim straight away?

  18. i'm sending my mint and tesco lba letters tomorrow, will be following you as you seem to be about 2 weeks ahead of me.

  20. well there was no response at all from the prelim letter, so today i am doing the lba in preparation for tomorrow when the 14 days are up.
  21. well nothing except the standard letter so the lba is going in the post tonight
  22. well today i got the "sorry not happy, have a leaflet, get back to you sometime" letter. funny thing is, both written and signed by the same woman Amanda Hickman. guess who is going to get the lba letters in one weeks time? i'm not very patient at this waiting game tho.
