  1. This is a classic case for contacting you card company and saying "somone has debited my account without my authority" surely?

  3. Ok, after discussing with their sols they've broken down the costs as: The original amount Court fees internest since we started court action the interest amounts to £10 Am I right in saying they have to pay the interest as i have calculated over the last 6 years?
  4. Now I'm confused. Did MCOL. Got to the allocation questionairre which I sent off, with the fee. Then they paid up, but they paid a bizarre amount. It seems to me it is £500 odd short if i include interest and all court fee's. Would I be correct in saying once it is at this stage they must pay the full disputed amount, plus interest, plus all my court fee's (including the fee for the allocation questionairre?) Hope someone can help me.
  5. I tried searching site:www.consumeractiongroup.co.uk "credit card" interest - Google Search but got no luck I'm sure I read you can charge the credit card company the rate they're charging you (instead of 8% on the "shedule of charges" spreadsheet) Can someone confirm this is true?

  8. WHO GIVES YOU EXTRA! Started the action on the 26th of April. Whew, it takes a while - 68 days. The last day to file their defence was Monday. They paid in full yesterday (Friday). No letter, no phonecall, just two random odd payments in my bank over two days. Didn't even realise they'd paid up. Ok, now it gets comical. Since I started court action they've charged me again. So I phoned them. ME "Hello I recently took you to court and won my bank charges back, since then you've charged me again. Can I get this refunded please to save us both time and money." HFAX "I don't see that will be a problem, let me check with my team leader". HFAX "Oh sorry, it seems you'll have to take us back to court to claim that money back" Ok so the whole process starts again, what a barrel of laughs. It's £39 but stuff it, im doing it anyway. It's my goddam money. Anyone shed any light as to how long after winning court action their bank account was closed? I'm just preparing myself.

    IANAL They would do this only after sucessful court action imo. Their excuse being you haven't paid the charges as per their terms - you broke the terms of contract and they no longer want you as a customer...They also might not... As another poster said, if you offer to pay X per month they could take you to court, but if it's a reasonable payment (based on your financial situation) then it'll get thrown out. Don't be put off, you've got a lot less to gain than lose...I'm in the same boat as you
  13. I sent this, and got my statements three days later - didn't have to jump through any crazy hoops. What I neglected to tell them is the entity im pursuing in court will be them
