  3. Thanks so much I wasn't aware of that. Brill hol but back to earth with a bump now. Dad in coronary care, lives on coast so just setting off there in a bit. Think will accept their offer, it's more than they offered at start which was zilch, then £1900 now it amounts to about £4700 so can't complain at that. Believe it when see it though. Thanks everyone, must dash now. xx
  4. Hi Guys! I'm back off hols and seems lot gone on in Halifax dapt. whilst been away. Posted a letter B4 I left stating that I wouldn't accept their partial offer of £1900 and to now refer all matters to their legal department. They completely ignored this and paid into my account anyway , I checked today. I have had letter from court saying that Halifax have acknowledged and intend to defend all of my claim. Another letter came from Halifax now offering to pay another £2900 which is just £800 short of my claim in full. They say they'll not pay this and will defend this part of the claim in court because it is in excess of 6 yrs ago and something to do with 'The Limitation Act 1980'. I'm over the moon at this extra offer and am thinking of accepting this, don't fancy going to a court hearing. If I can't defend my clain I will have to pay all their legal charges so seems a big risk or is it another bluff our way out letter? Any advice please?
  5. :) All packed up and ready to fly. Rejection letter posted although was very tempting to go away with £1900. If only............... Will be re-charged and raring to come back to battle in 2 weeks. Speak to everyone then for updates. x X x
  6. Dursary, I've wrote the letter but used template 5. Is this right? Daren't spend any money. Just changed the returning cheque bit to " I instruct you to not credit my account". Thought I'd better make them aware in customer services that I'd commenced legal action. They must be really behind with all the paperwork.
  7. Thankyou so much Dursary, my stomach was churning, have so much to do today, just panicked. Their timing is brilliant. Will get it done now then back to ironing and packing. They know how to play mind games don't they.
  8. HELP guys!! Receieved a letter this morning from Halifax stating as a goodwill gesture they will pay £1900 into my account but is a final settlement of my complaint against them. With interest the amount is 5,400 so whart now? Don't want it but fly tomorrow. Tried ringing the number, no-one there. Well stressed now, please help. Do I write a letter declining?
  9. Western Isles will be beautiful! Went to lakes last year and that was still gorgeous even in rain. Anyway, off to work now...last day! Counting the hrs down.
  10. :o Phoned the court this morning. Halifax have not sent acknowledgement as yet, have til next Thursday. Looks like I'll be phoning from Greece to find out.
  11. I know this may sound thick but can you not accept the deposit as partial payment and still pursue for full amount?
  12. 5 weeks????? WOW!! That's a holiday. Claim issued 10-7-07. Deemed served 12-7-07. Halifax now have til 26th July to reply, oh my God I'm on holiday!! Did I mention that. What now? Do I have to phone courts from hols? Knew this would happen. Will it wait til I get back. I suppose have to expect they will acknowledge looking at everyone elses experiences.
  13. I only have statements that go back as far as Jan 2000 so I suppose it's 7 yrs. Filed N1 last Tuesday ar County Court. Not heard a thing as yet. 5 days to hols! That'll stop me becoming obsessed with this claim.
  14. Hi Sanand! I filed N1 also in Rotherham County Court last Tuesday and have not heard a sausage yet. Just over a week but go away on Sunday for 2 weeks. Reading what you lot have gone through I think I am glad going away. Least menacing halifax can't harass with me phone call offers if I'm outta country.
  15. Thanks for reassurance. Will keep you all posted if I hear anything before I go away. Just worrying that all the forms will filled correctly. Had no idea when bank account was opened just a good idea of the year. Do I have to keep ringing the courts or do they let you know if defendant acknowledges?

  18. Finally finished filling in the N1 x3. Phew!! Delivering to court first thing in the morning. Hope it's all ok, wasn't sure when account opened so it's just an estimate from when I started work ( a long time ago LOL). The daily interest worked out £1.19 if I've understood it correctly. Does that sound right? Oh well, done now. Relieved I'm actually filing papers before go on hols.Only 12 days to go. May come back to some good news hopefully , it'll be first time my credit card has been nil balance if I do. Dare I get excited? Anyway, night night sweet dreams everyone. x
  19. YIKES!! Got the forms, following the N1 hard copy version as template. When it says to enter the dai rate of interest, how much is that? I knew I'd get stuck. H..E...L...P...P.PPP.

  22. aagghh!!!! don't scare me moneyhelp!! Hang on... 12th next week so they'll have my 2nd letter well before then. Surely?? Gosh don't you have to be patient, this is so frustrating.
  23. Start calculating the interest charges in preparation for court and you'll been even more giddy!!
