  3. I don't know about BOS specifically but some banks are doing this... It's not difficult though to open a new account (known by those around here as a parachute account just in case they do) http://www.moneysavingexpert.com/ has a good section on the best accounts around at the moment... Take a good look around the site (in particular the faqs - http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?f=5 ) and make sure you know what you are getting involved in and the arguments that you can use against the banks and what they will try to argue in defence... If you have any questions post them up here and someone will undoubtedly help you... But ATEOTD you must remember that this is your fight and only you can make decisions with regards to what you are going to do... But there are lots of people here to help and support you whatever you decide to do...
  4. I agree that they will be stopped from issuing penalties so long as this campaign reaches a critical mass... Which I do believe will happen... I don't think that anyone here will let them continue to get away with this...

  6. To avoid taking another thread completely off-topic... What is the consensus of opinion as to what will happen once the OFT investigates banks (and not credit card companies) ? Personally I think that a compromise will be reached with the banks agreeing to amend their T&C's and to stop using penalty charges without any admission of concious knowledge of breaching the law in return for some kind of amnesty or limit on liability for previous indiscretions... What do you think ?

  8. Going further and further OT but... I presume you are refering to similarities between the 'Legislative and Regulatory Reform Bill' and Hitlers Enabling Act ? If not, you should check it out... It is an astounding piece of legislation that just shows the contempt this government has for parliamentary democracy...
  9. And you think that the banks won't negotiate some kind of deal ? It's a huge loss to them... If a deal is not done limiting the banks losses then it could easily bankrupt them... Potentially £3 billion / year back to 1915... Certainly a minimum £18 billion over the last 6 years... Remember Nick Leeson ? Brought down Barings over a £200 million hole in the accounts (ok that grew to £800 million once they had unwound the positions he held but the market took advantage of knowing that they had to clear-down his positions...)
  10. Think you're mistaken... There are plenty of laws that have been brought in to conteract case-law... What you may mean is that they shouldn't by convention back-date laws. But as we know this present government has no idea about working within constitutional conventions... Let me give you an example which covers both... The recent budget that changed the laws regarding trusts... This was not announced in the budget speech (it was tucked away in the small print) and yet it was both the most far-reaching part of the budget and it also acted retrospectively...

  12. Personally I'm not sure they won't strike some sort of deal to introduce some kind of protective law at the same time as abolishing their charges... £3 BILLION can produce a lot of brown paper bags... Or am I just being cynical ?

  16. The individual is also acting illegally... Part of the T&C's (and we all know how the banks & their employees like their T&C's...) state that unless a bank employee notifies site staff of their status then their access to and use of this site is unauthorised and as such is an offence under s1 Computer Misuse Act

  19. Unfortunately HMRC aren't necessarily the most organised people in the world ! It's not unknown for things to go missing... Only last week Mrs Dinghy got a request regarding a companies submission last year for 2004/05 that had gone amiss ! (and as previously stated submission deadline was extended this year to tomorrow... ) Apparently duplicate P60's can now be issued so long as they are clearly labelled as duplicates... They have to provide you a P45... Have they given you any reason why they haven't provided this ? They are legally obligated to provide a P45... Inform your tax office they have refused to provide you with one and find out if they have filed their copy of it... What pay-period does your last pay-slip show ? (ie week 52 or month 12 or something previous to that ?)
