  1. I hope you had a good time in moscow, thanks for replying and remembering me I honestly thought this had stopped, the defence was filed and I heard nothing so the claim was stayed. The claimants went for summary judgement because apparently they hadn't received a defence, so it the stay has been lifted and it has been sent. I hadn't received a notice of assignment at all from 1st credit but all of a sudden a very doctored fake looking one arrived. It doesn't compare at all to any letter from the bank, the masthead is very different. Can I counter claim them? Originally there was some doubt about the particulars. Thanks once again.   2. [ Hi, I am being taken to court by Ist credit/LCS and I strongly believe that they have faked a letter from the bank. The court case is for an overdraft.
  3. well after getting the court case postponed i now have to appear next Monday. I haven't been provided with a default notice, but apparently the original creditors can confirm the default date! There is a form of notice of assignment from the bank, but I strongly suspect it has been forged because it doesn't look like other letters and insignia the bank has sent before. And the original PCOS was a bit strange. PLease could some one help me through this as i need to send my defence into them on monday, i am also trying to write a dissertation! Many, many thanks.
  4. I saw the pdf was called audrey, I love a nickname within a nickname! Should I alert someone to the viability of the form, I have posted a thread on the secured loans forum but no one has replied. I had no ised when I signed the cost of the loan because I didn't see the agreement before I signed so it wasn't until way afterwards I realised. Any help is so appreciated and when the ppi is paid back I will most definately donate to CAG. Hepburn.

The wrong apr on the agreement worries me though, there must be something i can do either void it or make it unenforcable. It is more than a little error. Thanks. PS. are you caling me Audrey?   7. On the loan agreement it states the APR as 15.7! I couldn't get it to match either, what is what made wonder if it was actually enforcable.
  8. Nope still stressed!! When I received the letter I couldn't understand what they were saying. I am guessing they after a signature, they have sent me absolutely no docs at all, just a letter saying they could get a summary judgement. I don't see why I should reply really, but I'll send a letter just saying that it doesn't need to be signed. Unless you think I should add more. Thanks for the reply.
  9. Hi I have posted this agreement on another thread because I have started to claim back the PPI. When we took out the loan we were told it would be for 7 years, it wasn;t until we asked for a settlemant figure that we realised it wasn't. At the time of getting it we were desperately naive and needed money, also had two kids in the room with us. If on the form the true amount of what we were paying back was visible we wouldn't have signed. The cost of credit isn't visible and I think the APR is incorrect, could someone help me with this.   10. Sostressed under a different name! I didn't receive anything from the court after I sent the defence, but on the 29th March 2010 received a letter from the new solicitors acting for 1st credit explaining how they had received a copy of the defence from the court and it is not signed. It should be and could I send a signed copy. The defence was sent nearly a year ago?????????????
  11. I used the single payment calc sticky at the top and it's showing that I have paid 8,004 in ppi interest , I can't quite get my head around adding the 8% to each payment.
  12. Would I not be adding the interest I have paid onto this -15.7 %? PPI+ interest + 8% Yet again thanks for the time that you take to look at this.
  13. Thanks for posting that, so if my agreement only states the amount borrowed and not the amount including interest it could be unenforcable? Sorry to be acting a bit stupid I am just trying to be clear. What are my next steps then, bearing in mind it is secured Thanks again.

  15. WOW that looks fantastic, thanks again. Just want to sort out the agreement, it does state the amount of credit but only the purs cash amount, not the interest on it. But does provide a schedule of payment.
  16. Any thoughts DX, does it look enforcable. I make the ppi repayment about £22,000 does this seem right or way too high. Thanks.

  18. I know we only realised when we asked for a settlement figure what was going on. I know we were desperate and stupid. We were told on the phone it was for 7 years - actually seven years to pay off the loan and the rest of our lives the interest! No figure indicating how much interest only APR. And amount of credit.
  19. Thanks for the quick response, on a bank hol! The refinancing was for other loans and cc's, this loan seemes like a good idea. It doesn't list ppi per month it was an up front one, we pay £329 a month. (it's a killer)

Hi, I have read lots of these threads, it's heartwarming to see these leaches having to pay back the money they conned people out of I have sent my first letter and received a response of 'we are looking into it it' after 3 days. I am not expecting to have this resolved quickly. I keep coming up with 2 figures that the repayment should be could someone help please? loan 1,220.65 refinancing 19,389.35 ppi (optional!) 7,541.26 other charges (!) 400 total 28,551.26 the interest is 15.7 and first payment was in January 2003. 240 payments!!!!! I would like to make this unenforcable becaus ethe length of the loan was a total con. Thanks.
  21. First post is a big congratlations from me. I'm about to file on MCOL against the Halifax. Don't really want to give them 8 weeks, i got a few days before the charges were taken away.
