  1. Hi, Ive finally received a letter from the court! Without wishing to sounds stupid! Is this the final court date where everyone goes to court, or is this something totatlly different? Many Thanks
  2. Thanks for everones help and advice. Its all been greatly appreciated. I will let you know how I get on. Heres a picture of the tree. The blue bags in the corner are already full of leaves. Im dreading the autumn if I cant get them to cut it back! Once again, Thanks for everyones help
  3. Hi, I was hoping someone may be able to help or been in a similar situation. I moved into my property In september. It backs onto a railway line. There is a huge tree with many many branchs overhanging into the garden. Some are so long that they take up half the garden. I contact Network Rail in May and they advised an inspector would have a look. Nothing was heard bu August so I gave them a call. I was advised that as there was no danger to the railway line they would not cut the branchs back. I queried this and they sent someone out for a second inspection. I found out today that they still wont do anything about it. Im aware by law I can cut back what overhangs and throw it back over, the problem being the branchs are so high up I wouldnt be able to do it myself. I advised network rail of this and they stated of I was going to hire someone in, I would have to apply for permission for them to enter railtrack property. Where do I stand? Am I going to have to foot a very large bill in relation to hiring someone in? Or is it uptoi network rails as its their tree? There is no proection order on the tree, I checked with the council. Any help greatly appreciated.
  4. Well made numerous calls yesterday, but no email. Was told it was sent to the wrong email address, and they would re-send it! Shocking Phoned up today and was told there is no-one in the office able to send emails on a weekend and will have to wait till Monday.
  5. Just contacted the debt recovery company and asked for them to email me a copy of the letter stating the balance was cleared in September. (Other letter is currently at mother in laws and shes on holiday!) Was told that if I dont get the letter today then then I will get it Monday. Was advised to send a copy of the email on to experian when it arrives and they will update my credit file! The cheek of it! Will be contacting them every hour until the email is received. I need this to get the loan accepted and if it wasnt for their poor service I wouldnt need to be waiting for this letter.

  7. Surlybonds, Thanks for the wonderful reply. I apologise for not replying sooner. There is some great points that you have mentioned there. Would you or anyone else be able to suggest how to put this in a letter to send off?
  8. Last year I had an outstanding balance of £1200 owing to a Debt Collection Company. Before I got my mortgage I paid off a £1200 debt in full and received a letter stating that the debt had been cleared. I spoke to them on the phone and was advised my credit file would be updated to reflect this. This was in Sept 2005. In November I applied to have my bank account upgraded from Visa Electron to Visa but was declined. I sent a copy of my credit file and a letter showing the debt had been cleared and was then accepted. Three months ago I got a copy of my credit report and it showed £1200 still outstanding. I contacted the debt collection company and they stated they would have my credit file updated to show the debt settleded. Last month I applied for a new bank account but was declined. I sent in a copy of my credit report and a copy of the letter showing the amount had been paid in full and was then accepted on appeal. I have no tried to get extra funds on my mortgage for home improvement but was told today I had been declined due to this pitstanding debt. I explained the situation and was told if I send a copy of the letter in showing it had been cleared then I will be accepted. Is there any action I can take against the debt collection company as this is now beyond a joke.
  9. Hi all, I sent the letter off to Sainsbury along with a £1 postal order. This was a CCA request. Yesterday I received a reply (two months later!) Is this right, they dont have to keep a copy of the default notice? Any advice on what steps to take next, or should it just be left. Many thanks

  12. Well I got my statements through today from the Abbey! After waiting three months, the grand total of my charges is £47! Letter asking for it back will be sent shortly!
  13. Just chased the Abbey up again. They contacted the archive department and they have received my email. Will have my statements in the next 5-7 days. Fingers crossed!
  14. Was thinking about that, but I already paid £20 to checkmyfile for the reports. Will leave it for the time being for checkmyfile to contact callcredit.
  15. Letter from Mr Udy received today stating that the remaining £162 was added correctly to the account and that he wont be completeing any more refunds. Too late Mr Udy, I filed my claim a few days ago.
  16. Right, Well I received no reply from barclaycard, So sent a letter to Callcredit along with a copy of the letter I posted to barclaycard and also a copy of my credit file. Chased Call Credit up a few times and was advised that they have 28 days to look into a dispute. The left it to the 26th day before they even looked at it! I then received a letter from Callcredit stating that they dont hold any information supplied by barclaycard. I tried to explain that I sent them a copy of my credit report confirming they did hold details but they were having none of it! Got in touch with checkmyfile.com who I purchased the report from, and they are going to deal direct with callcredit to resolve the issue. What a waste of space callcredit are. Will keep you all updated!

  20. I just left it afterwards. I have made so many calls chasing these statements up that its getting beyond a joke! Will leave it a couple of hours and then contact customer services to check they have got the email.
  21. Ok, Just to give you an update. Since my last post I have phoned Abbey numerous times chasing up my statements, each time being palmed off with a different story. I phoned on the 20th July and was informed they would be with me by the 26th July. Its the 1st August and still nothing so I phoned up customer services and gave a piece of my mind. As they couldnt palm me off with rubbish anymore I was given the direct number for the archive department to contact. Contacted the Archive department who informed me that I was sent a letter on the 12th July asking for the £10 fee!! I explained that I sent the £10 fee on the 5th May. I was told that this was for a SAR and dosent cover the cost of statements/ Well lucky for me I had the letter from Pam Speed in front of me dated 24 May stating that my £10 SAR fee had been forwared to the archive department to cover the cost of the statements. However, they couldnt find this letter on their system. Was told someone would look into it and get back in touch within 10 days. Isaid that wasnt good enough, that I would email them a copy of the letter and expect it to be sorted out sooner. Are these people jokers or what!
  22. Right, Im just getting my AQ ready to send off. When I sent my first letters to Barclays, I never included a statement of charges. Is this the right time to send one? Ive also read about people sending documents to the courts. Is this along with the AQ, or are they requested later on?
  23. What happens if you only receive part of the defence? When it gets to part 7 it stops half way through a sentance - looks like they have run out of room! Also, what is the "Liquidated damge clause"? This is mentioned a few times in the defence. Apart from that, just appears to be the bog standard.
