Hi, I sent off the SAR request to Halifax CC and the first letter they sent back was the £5 per statement request, I wrote again and said I didnt want the statements, I just wanted a list of the charges and they could take the maximum £10 fee from my account if they wished. A couple more weeks after the second letter they sent me a bundle of statements but said they would 'waive the charge as a gesture of goodwill' They are very slow responding, they made an offer to me in the process of one years worth of fees which was about £300, I rejected so they came back with half the fees and I rejected again. I made the claim on moneyclaim and the 28th day is today. I rang the legal services at halifax last week to make sure they got my POC for the claim and they had got it but hadnt referenced it to my original letters so didn't know it was due. He said they were going to settle and would write in a few days. They haven't so I'm just itching to press that 'Judgement by default' button on moneyclaim which is avilable from tomorrow. I think that like all the other banks, they're short staffed to deal with the mountain of claims and they've got loads of temps in who don't know what their doing yet.   2. Hi, I had the same situation with halifax. I had 2 accounts with halifax in my own name. Then I made one of them a joint account with my girlfriend at the time. We split up and closed the joint account a couple of years ago. Recently I started a claim on both accounts, the joint account had about £800 of charges some of which was when it was a joint account and some was from before. All the correspondance letters from the bank were addressed to both myself and ex (much to the delight of my new girlfriend!), and after the LBA letter they replied saying that they would be settling by cheque for the full amount of this account and they would be paying the settlement for my other account into the account as it was still open. The letter said that by banking the cheque I was accepting their settlement etc. But no mention of both of us needing to agree etc. 2 days later they paid both amounts into my active account (even though they told me it would be a cheque). I thought I might have trouble because it was only me and not both parties, but it wasn't a problem at all. Apparently some banks use that as a delaying tactic such as saying any settlements need to be signed by both parties or you can only claim 50% of the charges etc but some (including halifax) seem to be ok.
  3. Thanks for the quick reply. I want to get the default removed, thats probably more important to me than the money. I've heard that they may insist on offsetting any reclaimed charges from the 'unpaid balance' even though it was a 'full and final settlement' that I made to them originally. It was a while ago so don't have the paperwork to prove though. The original card limit was only £1000 and it increased to over £1500 due to the charges. I must have paid around another £500-700 as well so maybe there is quite a lot to be reclaimed. I'll send off the first letter and see what comes back.
  4. Hi, Sorry if this has been answered before but I have searched and couldn't find anything. My question is: I had a credit card account with Bank of Scotland a couple of years ago and after falling behind with payments the account balance spiralled with the charges and was eventually passed to a debt collection agency. After a couple of months making small payments to the debt agency, they called and said if I settled 'today' they could accept a lower settlement amount of £1000 (the full balance was nearly £1500 at the time). I managed to get £1000 and pay the debt off in full. I know that a great deal of thedebt was made up from unfair charges, but I want to know if I can still clim for them even though the account was only partially paid off. My Experian report shows the account as defaulted and current status as satisfied. I would like to reclaim any charges and also get them to remove the adverse default. Please can anyone advise where I stand with making a claim for the charges and/or removal of default. Thanks
