  2. yer there seems to be a bit of confusion - fact is - you barly pay anything for when a bank charges you a fee - usually you are still in credit/in your overdraft but the credit card companies charge an APR on charges just like purchases - so infact take extra its Vampiresses template i used and just adjusted the APR to suit but yer, use the prelim letter but state how much interest they have already charged you also that what i did for Capital One this morning
  3. http://www.consumeractiongroup.co.uk/forum/bank-templates-library/ the excel spreadsheet lets you put in charges couple of things, if your balance got paid off in full after a charge you can only claim the interest up till the point when you balance is zero - this is what ive done anyway, becuase if your balance is zero there is no interest being added for the charge
  4. like i said, check your credit agreement it will state the intrest APR on charges if they refund the charges then why let them get away with the interest ? ie a £20 charge in early 2004 will have generated around £7 interest for them also at 15% APR - just amend the Intrest % in the Template available from the forum
  5. yup ask them to provide proof that you asked for the PPI - if they cannot prove it - claim it back also check the terms and conditions, charges are usually charged intrest at the purchase's rate - make sure you add this in ie a charge back in 2001 for £20 charged at 19.9% APR is a lot more than £20

  7. got the same bunch of info through today did you pay PPI ? can you see anywhere that states PPI in the data ? nope i cannot agreed lots of info what is "Special Credit Limit" ? £4000 mine reads they were listening to Disco Hits when they printed mine out btw

Capital One statements recieved via Special Delivery cannont find anywhere where i signed for payment protection - they enclosed a signed copy of the agreement - certainly not on the document i signed agreement states that charges will be charged intrest as if they were purchases at 19.9% obvoiusly this makes a big difference on my balance £220 has been charged at the 8% the interest is £23.51 but ive been charged it at 19.9% APR which makes it £58.49 what can i do about this ?
  10. joke company - first dpa appears to have arrived, returned cheque stating dpa is £10 funny that, i paid £5 last week and already have my statements
  11. no they dont, they have until 6th 28 days from date of service if im not mistaken, it doesnt matter if they leave it 13 days to acknowledge, the clock on the 28 days to file a defence starts running from when they are deemed to have recieved it - 2 days after issue
  12. reply to the letter, state the amount of debt is in dispute due to charges levied on the account, you will not be making any payments to the account until the matter is resolved take this letter to your branch, state you posted letters via Royal Mail which appear to have been undelivered, please can you put this in the internal mail system, ask for a reciept of the letter
  13. if they made you an offer before the lba stage you state you will accept the £X offered as partial payment but will be persuing the full balance, if nothing enters your account before the LBA 14 days is up - procede with the claim in full

  17. right, this debt is still being paid off via a accepted payment via a CCJ and i have already started a moneyclaim against GE Money i got a credit report the other day and spotted a company i didnt think i had a debt with i wasnt very organised when i aquired the ccj for this debt BUT i do still have the forms sent to me from court i assumed i was paying GE Money the CCJ - im not im paying a company called CL Finance here is a screenshot of the GE Money (Topman) entry on my credit record and here is the C L Finance i recieved a Topman statement on 23rd January 2006 the claim form from the court was issued on 27th February and i recieved a letter from Howard Cohen & Co on 20th March my point is, ive never recieved anything saying my debt was sold on, nor have i ever recieved a default from CL Finance, the first contact it appears they made was when i recieved claim forms, GE Money, C L Finance and Howard Cohen all seem to be linked as stated http://www.payplan.com/debt-library/miscellaneous.php now i know this is partly my fault but when your struggling with debt some stuff is hard work better frame of mind now and a lot more savvy thanks to this site so should i be asking C L Finance for copies of credit agreements and defaults ? and i assume i should continue paying my CCJ ?
  18. thinking of persuing this now, i just won my claim with them, never gave it a second thought that i was accumulating extra interest due to payments made only paying charges my question is halifax has just refunded my charges if rewrite my statements based on the intrest rates stated in my original agreement and DO NOT include the charges i will eventually arrive at the true figure i would have had if the charges were not added i assume it will mean pulling apart the terms and conditions on the credit agreement to arrive at a true interest figure, but ultimatly it will be worth the work i would say to do it AFTER you have been refunded for charges, becuase once refunded they are admitting these charges shouldnt have appeared on your statements ? views ?
  19. they can not make you pay more then you have send them a financial statement - stating income and expenditure then make them a pro-rater payment based on egg debt x available income and divide that figure by your total debt see here http://www.adviceguide.org.uk/d_basic_debt_advice.pdf
  20. available credit on my credit card just went up £400 but my balance doesnt seem to have changed - ill check later today but it seems they are in the process of paying out :D:D:D
