  1. I dont think its come from anywhere, Its a typing error when they input the amount on the computer. They clearly put the point in the wrong place. I assume therefor that no one is actually 20 grand short unless of course your the bank manager who is scratching his head wandering where it has gone
  2. Is it issued by the council under the 1991 Road Traffic Act or by the Police. Yellow lines are usually the police or traffic wardens and its a different Act of parliament
  3. My daugter has just had 20 grand credited to her account by mistake. She put in a cheque for 200 pound last week and they have obviously typed it in wrong. any sensible ideas. Telling them would obviously be the the right thing to do but there must be an opportunity to make a bit of mischief before she gives it back

  5. There is loads of issues here. The 1991 RTA states that the PCN must include details of where (Address) to make informal representations. It dosnt say that, it just says you can make them. They are also confusing the complicated issue of liability for the ticket. The liability lies with the owner and not with the registered keeper. All the gumph about the registered keeper being able to appeal etc etc is plainly wrong. A number of previous judgements by the parking ajudicators have made this point. Have a good read thru the thread I put a link to earlier. on that thread there are links to all sorts of test cases. There are more than enough errors on this ticket to warrant an appeal both informally and formally to the parking ajudicators. Also remember in the recent test case at high court Barnet V Moses the judge stated that the issue of prejudice against the motorist is irrelevant. In the past the councils were saying that yes their PCN were slightly wrong but there was no prejudice caused. The judge blew that out of the water. Either the PCN is correct or it isnt

  8. 2 things No colour of vehicle. No contravention code on ticket.   11. Im a little concerned thats whats happened. Strangely though this is a couple of years old and he has never received a statement or any corres. and barclaycard state the account dosnt exhist. I was hoping to sort this out without spending another 10 quid on a SAR. Sorry for the minor hijacking will start thread if it gets interesting
  12. Also having had a close look at the photo are you sure you are in the box junction !! It looks to me that the diaganal lines end before your wheels. They dont continue on. It may be a fault with the marking but thats not your problem Have a look at the other side of the road. there is certainly a difference.
  13. If you were in the right hand lane and you exit from the box junction was clear then you have every right to enter the box juction. If after entering the white van pushed in from the right forcing you to the left where you couldnt then exit then I think thats a reasnoble excuse. The offence is entering the box junction when the exit isnt clear unless of course you were turning right and your exit was blocked by oncoming traffic. I would certainly appeal I think you have a case But its only my opinion
  14. worth asking. You could inform them that if they wont supply a car you will be hiring one and adding it to the bill.
  15. Directions hearing has been set for 25th October. Same day and time as my daughters so its gonna be a family day out looking at the court list there is about 20 bank charges cases all on the same day. Any one else at Kingston County court next wednesday !!!

Just sent a CCA request to cabot and barclaycard for a debt that a family member knows nothing about. they never had a barclaycard although I did apply some years ago but cancelled the agreement before any documentation arrived. Certainly never had a card or spent anything on it. barclaycard deny they exhist and they say the acount number doesnt exhist. Interesting to see what happens. Ill start own thread if it gets interesting
  17. They did this to my daughter and i wrote a scathing letter to them telling them they wernt going to scare me off with their bullying. I quoted the banking code and after about 5 days I got a very apologetic letter saying they would put the matter on hold until after the court case
  18. something similar happened to my son last year. A notice arrived from the council stating unless he paid £90 the matter was being referred to the bailieff and registered as a civil debt. The fact that he received the ticket was not in dispute but he had not received any communication notice to owner etc etc I contacted Northampton county court where the debts are registered and they informed me that when it is regestered they send a form to the registered keeper who can then attend any court and dispute the facts. One of the grounds for dispute is that no Notice to owner was received. If the court agrees then the council have to start from the NTO stage again. Perhaps thats what your daughter did when she went to a court. I would write to the council and officially ask to see Copy of ticket Photo of it on her car Copy of Notice to owner Copy of charge certificate Dont give up you will win in the end.   19. Barclays defended and AQ completed and sent in. They have very kindly credited the account with 260.00 without any mention of it being in settlement just being the difference between 12.00 and 20.00 They gave me no choice of accepting it or not just credited the account. I think I will write to the court stating the claim has been part settled but the case for the rest goes on. Re the microfishe issue. I will write to Barclaycard and remind them that in light of the decision re Abbeys microfishe best they coff up with the missing 2 years ASAP.
  20. Rather quick reply to complaint They will not be taking any action on the account until after the court case. Well they wont have to after cause it will be 800.00 in credit ! 10 days to court and counting
  21. AC This is a standard template letter from Barclays. Ive had one myself after they failed to acknowledge MCOL. I accepted and the money was in the bank within a couple of days. They will then get a formal setaside and eventually settled. It saves them looking amauter and having a judgement against them I would say they have got absolutely no chance of getting a stay based on the fact they didnt turn up but you are basically arguing a matter of principle which will mean you are gonna wait for the money. In the end of the day you have won. Its an easy sum to do. Can you afford to wait another couple of months for the money if you can, go for it, If you cant accept their offer. You could accept the settlement without the confidentiality. Whatever you decide must be correct for your circumstances. Apart from that well done great effort and a jolly good read. Hope the money makes a big difference.
