  1. righty-ho folks ! recieved my 'general form of judgement or order ' a few days ago and i would like it deciphered if possible . it reads as follows :- IT IS ORDERED THAT 1. this claim is stayed until one calendar month after final judgement in the test cases (including any appeal) or 31st october 2008 , whichever is the sooner. 2.either party may upon notice to the other apply to lift the stay at any stage up to the earliest of the two dates provided for in paragraph 1 above. 3. if no application is made to lift the stay or seek furthurdirections before the earliest of the 2 dates provided for in para 1 above the claim shall stand dismissed without furthur order. 4.because this order has been made without considering representations from the parties , the parties have the right to apply to have the order set aside , varied or stayed. a party wishing to make an application must send or deliver the application to the court(together with the appropriate fee) to arrive within 14 days of service of this order. i understand i can apply to have the stay lifted ( which im not keen on ) but paragraph 3 scares me! does it mean my claim will be dismissed if i mererly wait for the test case and do nothing before then ? cheers , lost.
  2. hi again folks ! right , my claim was deemed to be served on 21 july , i take it this is the date of service from which abbey have 28 days to file a defence. by my calculations this gives them up until saturday 18 august to do so . ive recieved / heard nothing so far . i read elsewhere on the site that my local court has put a stay on all claims the last few days . i recieved my letter from abbey stating their intentions to stay my claim but again i have recieved/heard nothing official since. simple question(s) :- should i request judgement if ive heard nothing by saturday . should i be putting my bundle together now ? thanks in advance !
  3. update :- abbey to defend all of the claim. " the defendant has 28days from the date of service of the claim form with particulars of claim , or of the particulars of claim , to file a defence "
  4. thanks jo ! yer a good'un i have everything together i think , 3 x n1 + charges schedule + £120. i will be making my little visit to the court tomorrow. thanks again .
  5. right , the day has come to file my claim and im stuck already ! question 1 - the abbey deposited £415 into my account a couple of weeks ago. is it ok to use my original figures whilst filling in the n1 form but just put a '-415' under the 'value' section of the form and ammend my total mentioning that these charges have just been refunded ? 2 - when did the money become owed to me ? was it the date of first charge or when i discovered the charges were unlawfull ? im going to look really stupid for the next few weeks. plus my bums starting to twitch a bit. cheers !
  6. thanks for that ! ive done a hell of a lot of reading on this site (hours + days spent!) but instead of clearing some things up it has sometimes caused a big jumbly mess in my head. its nice to get another opinion on things. thanks again!
  7. hi again!! well , ive still never filed my claim yet so i popped down to the local court the other day to get the relevent paperwork and also in to my local abbey branch to ask them the date i opened my account to complete the information on the n1 form. then , hey presto ! £415appears in my account a day later followed by a what i assume to be a standard letter assuring me of their full investigation and gesture of goodwill etc.. blah....blah.... yawn. question :- can i just file my claim now deducting the gog (£415) without further correspondence from myself or is it best to send them a letter of some kind? if i send them a letter does it mean i have to give them further notice of my filing a claim or will i just send them a letter AFTER ive filed my claim telling them so and that ive deducted the gog from my balance? cheers folks !

  9. well folks , i too recieved the spreadsheet (jan 04 - dec 06) and its where most of my charges were taken. i put them all on my summary using the 28th of each month as the date as this seems to be the date for nigh on the rest of them. ive just sent it off today . hope i havent dropped a clanger already !
  10. ok folks , the fun starts here ! statements finally received ,(i had to play hell on the phone twice) ,along with a letter saying sorry for the delay and they will refund my tenner (goodwill eh ! are they going soft ?) charges amount to £4000+ and i will be claiming back to 1999. standard refund request letter to be sent recorded delivery tommorow.
  11. hi ! ive had similar problems , ive already sent 2 letters to halifax with no acknowledgement whatsoever (30 days gone) ,so i phoned them yesterday to be told they had no records of my letters or cheque ,even though they were signed for ! i was then told they would be re-ordered and there is a standard 21 day waiting limit for all statement requests , so i told them i would be complaining to the information commisioner if i never recieved them in the next 10 days. his reply was "i really cant see the point in complaining as we have done nothing wrong " it went a little quiet when i told him it was a breach of the d.p.a. i await with baited breath.

  13. hi welshy ! the same thing just happened to me so i prepared a letter to send back complaining about the loss of my cheque and their negligence and to sort it out etc. etc. . ive just arrived in from work and theres a pile of statements from the last year on the doormat waiting for my undivided attention i never got a chance to send out the letter i made , i also got the impression they arent really ' on the ball ' as the letter i received today which was from a different member of staff , actually acknowledged my cheque i now have 3 years statements , 99 ,00 & 06 . £1300+ so far and 5 years left to count ! ( the bad old days ) im starting to feel a strange form of excitement !

A little update..... just recieved my first letter back from abbey containing an authorisation form. it basically tells me to send a cheque for £10 to obtain my statements! they obviously 'forgot' i sent it over 2 weeks ago! what a bunch of ****ers !! funny thing is the letter come from a bradford address whereas i sent my letters (2 of em) to my local branch (tyne & wear) I managed to get statements from my local branch 6 yrs ago when i needed them to get a financial pummeling off an ex (lovely lass !) , so i didnt expect it to be a problem. never mind! ill ring them tommorow 18 days to go.......

  16. Hi folks ! Well ... ive now been waiting for nearly 2 weeks for the arrival of my statements with no acknowledgement nor cheque cashed. Today , i have drafted a little reminder for them to be sent tomorrow. Lets hope it gives them a little nudge . ;-) In the meantime , ive just so happened to stumble across a nice little bundle of statements dated 1998-2001 with a charge count of over £500 ! (nice timing!) . Surely noones going to tell me i CANT put these in my claim when i get round to it ? .... are they ? Does the ' 6 years ' lark only apply to the amount of back dated information you are legally entitled to ask for ? ...or is it something to do with the courts? To put it simpler , can i claim back 8 years as long as i already have the information at hand as evidence? cheers , mick.
  17. Just thought id better pop in here and introduce myself. Im about to start claims against halifax and abbey and have recently sent my first letters requesting statements. Ive already spent quite a lot of time reading all the info off the site so i feel im pretty well prepared for what might lie ahead , though a little nervous! I would like to thank everyone who has put time and effort into supplying all this usefull information for the likes of me (factory worker -not known for legal and documentation expertise ) and others who may be feeling a little out of their depth. Ill start my threads in the relevant sections when ive recieved my statements and hopefully if i do need a little help it wont be far away! Cheers , Mick.
