  2. Good afternoon, True to script I have just arrived home to an offer from HSBC for £1500 on an original claim of £1761..now £2293 with court fees and 8% int. Do I need to send a rejection letter to HSBC ? Do I send a copy to DG Sol.? I am going to carry on regardless.. I have a debt with HSBC ..part condition of acceptance was payment to a third party and cheque for residual amount to me..incidentally the debt agency they say the debt is with is different to the one I am paying!!..I have read on various threads that one should insist all monies are paid by cheque...I did not mention payment by cheque when I filed on MCOL but I have asked for payment by cheque in my correspondance with DG. Sol?.Is there anything more I can do to insist or is more than likely that HSBC will pay third party direct and give me what is left? kind regard jane.
  3. Good morning, I think you might have a better response to your question if you post it in the Debt collectors/General Debt forum. I read your post as Next have just issued a default against me, but thanks to advice,I am in the process of writing to them to ask them to remove it. In my case they do not have a Consumer Credit Agreement, so no agreement = no evidence of my signed consent to pass my data to a third party. Have you asked Next for a copy of the agreement? I am quite new to all this so others with more knowledge will probably reply if you do post again in the other forums. Good luck moving on..

  6. Good morning, Have finally started my own thread after weeks of reading...just beginning to feel I need my hand holding as I enter into the unknown !! This morning I received Notice of Transfer of Proceedings,Transferred to West London County Court, the next page is from Northampton County Court saying before District Judge Murdoch sitting at Northampton County Court without hearing is is ordered that:- 1. The filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise. Note. Any party affected by this order may under Rule 3.3 (5) apply to have it set aside, varied or stayed. Such a party must apply under rule 23.3 within 14 days of service of this order.Dated 4th July 2007. The third page is HSBCC s defence, which seems the standard defence. Advice what to do next would be very much appreciated... very many thanks... moving on.. ( on a less daunting note Thanks to this site, this morning Egg have refunded me £204.00 of charges after LBA..!!so when the monies arrive in my account a donation is on the way.)

  8. So today, Next have confirmed that they do not hold a signed credit agreement, but have entered a default entry on my credit reference file, is this usual? Moorcroft have sent me an application form for Argos?! moving on...

Good Afternoon, I have just received todays mail and am surprised (not) to find that one of my unsigned CCA request RD leters to GCC LTD (acting on behalf of Great universal cat.,) alleged debt has now been 'legally assigned' to Fredrickson Int. Ltd.!! Do I send a CCA request straight to F I Ltd and at the same time send one to Great Universal..? I sent the original CCA request on 31st May to GCC Ltd.,and as mentioned it was unsigned for. many thanks jane.
  10. Good morning... This mornings post brought confirmation from Moorcroft that they cannot supply signed credit agreement re.littlewoods extra.(returned po). Also from Moorcroft re; Argos..They are going to contact client and request relevant info. and want me to 'give an indication of information you will be providing, when giving evidence to the court...' ..'please confirm whether for example you did not receive the credit/goods ordered...' Im sure I have read that I do not reply to this? Now Reliable collections are acting on behalf of JD Williams.....They have sent me a 'true copy' of the agreement but it does not (according to them) have to have my date and signature on it ( blank copy of credit agreement sent). not sure what to do here..a while back I asked for charges and they refunded all the £12.00 charges back to my acount.. So as I have acknowledged this , the fact that they cannot supply a cca does it still mean I should carry on with the payment plan?? ( All other 6 RD letters now confirmed 'lost' by Royal Mail.. and will now re-send by special delivery...if funds allow)... regards Jane.

Hi Hopeful1, To be honest I am as excited about CAG as the post ..I just keep reading and reading and reading!!lol...I was meant to be going out on an errand but wanted to reply first!!..( I was meant to go over an hour ago!!lol) Thankyou so much for the very useful info. On this occasion i feel the CCA is legit., but I will double check..( but i do not have a scanner) the agreement was via the Woolwich bank, and has name address, amount, interest, monthly instalment ,APR, signatures and terms of loan on other side..... so me thinks their confident, quick reply, to an unsigned for RD letter says it all!! I have also read that banks are much more likely to produce the CCA request. Sorry to hear things aren't reading too well at the moment but keep hope hopeful1. kind regards moving on...
  12. So following on from above above, one of the non - delivered R/d letters must have been delivered, because today I received a CCA from Littlewoods personal loans.....the CCA looking all' present and correct' ( sent within the 12=2 time)......what are RM up to??!!.....
  13. I am so very sorry for confusing the issue.... just to clear my question up before i really do move on!!(to my own thread.!!) I am just adding the text 'Total charges' on my SOC .I had just put in the amount...I am not adding any more charges..... once again I am so sorry for the confusion and so very many thanks for your support.. you are both utterly brilliant.. kind regards moving on.....

Thanks for the quick reply Freakyleaky, and apologies to Lacey for jumping on your thread, but it is all so relevant...just one more thing I have just re-checked all my statements and 'total charges' is all they refer to apart from 3 recall s/o -dd..as my p.c skils are limited can I add these to my soc, by hand..(neatly!).. regards moving on...( I will start my own thread..but thankyou for now).Good luck Lacey, I am watching your thread with interest.
  15. ..I am just a little ahead of Lacey123 with my claim and have also not put the words 'Total charges' on the SOC which I have already sent to DG and the court!!! will the fact that I have not mentioned 'Total charges' put the claim in jepoardy.....what is the best way forward with this?! regards moving on...

Good morning Hopeful1, I was also wondering about RD, I did have a similar experience with a company that I asked for some info from, letter was sent by RD, this letter to was not signed for, but the company did respond to the letters content 2 weeks later!!..I will re-send the 6 letters by SD, just waiting for mon. for confirmation that RM have not been able to deliver..just wonder if it is possible to ask RM to cover the costs for special delivery as some form of compensation for the inconvenience??!! As far as post watching, today is also 12+2 days for Moorcroft re; Argos and Littlewoods Extra..no word as yet! I sometimes find myself at my front gate actually willing the postie along the road(I live at the end of a long road)!...makes a change from 3 years ago when I was literally hiding behind the door with ear plugs in so as not to hear the phone!!...if only I knew then what I am beginning to know and understand now..!! regards jane.

  18. Thankyou Buzby, I will write to request a copy of my credt files. No marriage, ex moved out approx three years ago, and is in rehab....He came off the joint tenancy this Feb. The Access card was issued along with the account. HSBC have totally ignored me so far, .... the claim is at the aknowledgement stage. I did not add payment requested by cheque in my POC, but, I have added a note and sent it with soc to DG Solicitors requesting to be paid by cheque.,do I need to insist now that the charges are not distributed upon refund or see what they say when they finally make an offer?   19. Thanks Buzby for your earlier reply and clearing that up for me.... I have just returned home and was about to ask a similar question to the one above...so I feel you have answered part of my question already!!( what supreme service..lol) I have just submitted a claim via MCOL for refund from HSBC, an outstanding debt is on the account, which is closed with the HSBC,this debt is now with a DCA called Interim Justica .The charges are double what I owe, and therefore with your advice hoped I would at least be able to get the remainder paid directly to myself. I have been paying off the outstanding debt via a Debt Repayment plan. Now, I have claimed back the charges in my name only ( my partner left me with £20,000 of debt and four young children,!) and as I was working the bank pursued myself for the debt. It has just occured to me that there was an Access card issued on the account...but I know it's in my ex-partners name...(the only one that was!!) and I am sure there is an outstanding balance on it.... I would just like to know whether HSBC are able to use the outstanding amount that I was hoping (really, really hoping !) I would receive to pay that debt also??? very many thanks jane
  20. Having got charges back,Barclaycard will not pay by cheque as 'I currently have an outstanding balance'...Is there any 'stronger' letter that I can write other than my request for them to pay me by cheque as it is my money!! which they haqve said no to!? Thank you in advance jane.
  21. Thanks Mm ,annoying to say the least... just a thought..possibly the DCA are realising what some RD items may contain and are ignoring them!! P.O. boxes making it easier to ignore I presume..!!! Still, Moorcroft have signed on the 1st June, and so far I have heard nothing that clock is still ticking for Argos and Littlewoods Extra... I first checked on-line yesterday and status was 'come back later' and then I called Royal mail this a.m....They said they were very sorry and post would be returned to sender by 18th ,but first I would have to put in a claim for lost items..confusing!!lol..I said I was very disappointed to have six letters not delivered..How can they explain that...He said ' perhaps the bag they were in was lost or damaged'...does not inspire much confidence now does it???!..So what to do now? jane.
  23. Good morning all... Have just checked with Royal mail and it would appear that 6!! of my CCA request letters have not been delivered i.e Royal mail have no signature confirming receipt.!! (some are p.o. box nos. which I am sure doesn't help.) Does this mean that the clock stops ticking and I should resend the letters?, seems special delivery is an option but that costs!!By my reckoning the twelve days would be up Wed/Thurs this week that is allowing for 2 days to deliver ,they were sent 30th May and a couple sent on 31st May...? regards Jane

  25. morning... Just a quick question Cap one have refunded difference between £20.00 and £12.00 to my acccount. This morning Barclaycard wrote with the exact same but have said that if my account is closed to send them bank details to refund me directly. As all these accounts are passed to DCA I assume they are classed as 'closed' with the original lender. I called Cap one and asked if they would refund the amount to my bank account they refused as I still have an outstanding balance!! confused?..Is there anything I can put in writing to request my money back!...just that every penny counts!!! regards moving on ( still no response from CCA requests sent...tick tock....
