  2. I need some advice please. Immediately after I put a claim into the court last year, HSBC continued to make charges but instead of calling them notified fees and charges, they began calling them arrangement fees. Was that a crafty tactic on their part, and can I now put a claim in for those charges? I left the bank some months later but they had deducted quite a few hundred pounds again up to that point in the form of these arrangement fees.
  3. Can anyone help me????? As I have already said, dated 11th Sept I received a response letter of the court to the letter I sent asking to have any stay lifted. In that I was told that the application for the stay to be removed has been refused. Dated 15th Aug, I had a letter off the court stating that the claim be stayed with immediate effect, pending the ultimate determination of the commercial court litigation, and then said what to do if I wanted to apply to have the stay lifted. After sending my letter asking appealing to the judge to continue with my case, and after having it refused, I came to the conclusion that it was a waste of time continuing. However, on 21st September I received a letter of DG Solicitors saying that they were going to apply to the court for an order to stay the action until resolution of the banks proceedings with the OFT. How can the court tell me my case has been stayed, when its not until weeks later that I get a letter of the solicitors telling me that they are going to apply for a stay? I really dont understand.

Hi, Well I am really confused now, I wrote to Judge Hickingbottom in Cardiff Court asking for any stay on my case to be lifted (as I have already said before) and as you all know from my previous posts, I was refused. In the last couple of days, I have had a letter of DG Solicitors, telling me that they intend asking for the case to be stayed. I was under the impression that my case had been stayed along with everyone elses. Why would the judge refuse my request (on the grounds of financial difficulty) when at that time, he had not even had a letter of the solicitor requesting a stay? I am really confused now.

I just want to say, I rang and asked Cardiff Court if there was a fee to pay if I want to ask for the stay to be lifted and I was told to send a letter first (asking for the stay to be lifted) and if not successful then send in an N244 form along with the fee payable. I was told that I would have to pay and that it had not be waived.
  6. Hi, Personally, I dont think its worth the effort. I wrote a very full, clear and personal letter to Judge Hickinbottom pouring out my heart and detailing my circumstances, but just got a letter back saying that the letter has been treated as if I had sent in the N244 form, and that my application has been rejected.
  7. I went to my bank to try to discuss my circumstances and the charges etc. I had a very patronising response from the HSBC manager I saw. He firmly told me that the fee situation was out of his hands and he couldnt help me and then tried to talk me into remortgaging with them, adding in all of the other money I owe on cards etc. If HSBC paid me back the money they took out of my account [EDIT] unlawfully, I wouldnt owe them anything and I wouldnt now be over my overdraft, and they wouldnt then be still taking charges off me. Last month, I went £1 over my agreed overdraft ((because of the charges they keep slapping on) and the bank charged me £75 for that.They have not been at all helpful, so I am closing my account with them and going to another bank. Not that other banks are any better, but I am going to one that has offered 0% overdraft for 12 months which will at least give me a fighting chance to pay some of the overdraft down enough so that I will not incur any more fees. I really need to get this all sorted out somehow, I was depending on getting my charges back. I feel that I am loosing a battle here, just like all of the others on here. What can we do????

  9. Credit Card claims can not be stayed as far as I am aware. It is only the bank claims. Smutley, I have just read that link and it makes very interesting reading. Does anyone know what is going on with claims through the FOS at all?
  10. Hi, it looks like there is no justice in Cardiff. I poured my heart out to that Judge in the letter I sent to him asking for the stay to be lifted, and it seems as though it was a complete waste of my time and efforts.

Well, I have just received a response back to my letter which explains that I am requesting the stay be lifted due to financial difficulties. Its on a form headed GENERAL FORM OF JUDGMENT OR ORDER and it reads Before DISTRICT JUDGE HENDICOTT siting at Cardiff County Court Civil Justice Centre. UPON READING the Claimants submissions objecting to the proposed order of stay IT IS ORDERED THAT 1 The submissions be treated as an application to remove the stay in the order of 15-Aug-2007 2 The application be refused. 3 As this application has been refunsed without a hearing, either party may apply fot the application to be reconsidered at an oralo hearing. Any such application shall be on notice, and is reserved to HHJ Hickinbottom or DJ Hendicott unless expressly released by either. What can I do now, is it worth my while asking for an oral hearing (send in the official form), or will I be wasting my time? Or does this mean that I would be welcomed to appear and put my points over orally? I can not add any more information to my application than what I have already given in the letter I sent in. I really need this cash. Any help or advice will be appreciated. (Incidently, my claim is against HSBC).

  13. Well I have no idea yet if he will ask to see me. What do I do if he doesnt, and he wont do anything about lifting the stay?
  14. Just wondering if anyone knows how long it will be before I get a reply to my letter, is there some kind of timescale? Im feeling a bit nervous about it now, I really hope the judge will lift the stay.
  15. Ok, Posted the letter to ask the judge to lift the stay today. I laid it on thick about the debt and circumstances and how terrible the bank has been. Just hope it works. I will let you know.
