  1. Bugger it, I am going to send a letter back saying, "cheers for the application form, however it isn't a cca. Ta muchly, you have until the 18th to send me a true copy of the CCA, if not then I will tell you where to whistle."
  2. Thanks, nope that is the way it came, I am scanning it correctly it is just a really shoddy copy of the original application form. No prescribed terms/conditions on it. Even says it is an application (from what I can make out on the form)

  4. I'm sorry I cannot seem to make it any bigger. Someone who knows what they are doing is welcome to copy the picture in the thread and blow it up if they want to and then re-post it.

I forgot to mention that this letter above pertains to the company with which I had this experience last thursday: I phoned a DCA (CFS in Dunfermline), now I know I shouldn't have but I did, they left me a message about the full and final settlement figure I offered. The girl who answered wasn't sure about what I was asking about, and remember at this stage I had been firm but polite. She (attempted) to put me on hold, but didn't quite manage it, and said to her supervisor "This woman is a f*****g nightmare. She is being and absolute a***hole and she now wants a copy of her signed cca, whatever that is." I heard her supervisor say "well just get her off the phone then". So the young lass comes back and before she can say anything I said "Hello this is the nightmare here, can I please speak to your supervisor NOW!" She absolutely died on the phone, she said "Em yes, ok." tried to put me on hold again, failed to and I heard her say "Oh f**k she heard me!" The supervisor waffled on about how it wasn't acceptable, but to be honest its the best laugh I have had all week. I am going to write to the company about the fact that I overheard her, but the lass must be mortified now!

  8. Inspired I have drafted this letter to Corporate Financial Services. Dear Mr Glover, Having reviewed the above account I have pleasure to send you the invoice for the payments now due for dealing with this matter, totalling £299. A breakdown can be found on the back of this letter. To prevent legal action being taken it is essential that you settle this debt without delay Mr Glover. Payment should be submitted in full to myself within 7 days from the date of this letter, failure to contact my office and confirm payment has been made will result in legal proceedings being instigated without further notice. I would like to draw to your attention that if legal action is taken, not only may this effect any future credit applications you make elsewhere, but any legal costs incurred are usually payable by the debtor. To make payment please send a cheque, quoting the legal case number on the back to the above address. Basically their letter to me, sent back with MY charges on them.
  9. No its still with bank of scotland. I asked them for a CCA and that is what they sent me. I will try and make it bigger. Will post it up when I have ok.
  10. Its not a collection agency, its bank of scotland credit card. Scanned copy, and if you can read any details (name address etc) dont worry, they are all different now.
  11. I wrote to a credit card company asking for a CCA. The 12+2 is not up until 18th of july but they have sent me back a letter which says: Dear Miss XXXX (obviously that is my real name ) Thank you for your statutory request for information with respect to the above agreement. Enclosed is a copy of the executed agreement. As at the date of this letter: 1) The balance of the account is £1796.61 2) The credit limit is £1500.00 3) The current interest rates are 20.83% per annum for purchases, 20.83% per annum for balance transfers, 20% for cheques and 20% for cash advances (19.9% apr). 4) The arrears on the account are £141.21 5) The amount currently payable by you to reach us by 4th July is £36.03 6) Further payments will be payable each month at the rate of 2% of the balance outstanding or £5, whichever is more. Please note that the information we have provided you with is all the information we are required to provide you with Under Section 78 of the Consumer Credit Act. Yours faithfully, blah blah blah and they have sent me a recent copy of a credit card agreement which is unsigned and a poor copy of my original application form which is signed. Now I have looked through and surely if they have just sent the application form which has no prescribed terms on it that is not my CCA. Am I right? I can scan a copy of what they have sent me if it helps.
  12. Can I ask for any amount claimed to be refunded by means of a cheque rather than placed back into my account, if I won?
  13. I have received that form and tried to get them to take the details over the phone number I was given in the letter I received, for the Financial Hardship Group. However they will not accept them. I have asked why and they said that they cannot deal with my case as I am now within my overdraft (having opened a parachute account with another bank and am using that for my banking now) and so they will not take my SOA. I asked if I posted it in would it be looked at and they have said that it wont. I now have the court papers and would like some advice as to how to fill them in correctly.
  14. Hi, I have written my two letters to HSBC, as I am suffering from financial hardship due to disability and my partner walking out on me in september. In the second letter I gave them until wednesday to reply with a satisfactory answer. I received a letter on saturday which says, "Dear Miss XXXX Thank you for your letter received 12th June 2008. As explained in our letter dated 4th June 2008, for us to help you with your current financial circumstances we need a detailed breakdown of your finances. Our previous letter contained an income and expenditure form which we requested that you complete and contact our Financial Guidance Team (FGT). For our FGT to assess your circumstances it is important that they know full finacial picture. Once they have assessed your situation they will determine the most effective way to assist you. I have enclosed a further copy of our leaflet "Putting your finances in order." which contains the income and expenditure form. Once you have completed the form please contact our FGT on 0845 XXX XXXX (monday to friday 8am to 6pm). Should you choose not to complete the form or contact us as requested, I can confirm that the Bank will not be able to assist you any further with regard to your financial hardship. Your claim will remain registered and on hold pending the outcome of the leagal proceedings between the bank and the OFT" Despite me having already tried to give them a SOA before I sent the second letter, which they were not interested in, and another 45 minute phone call this morning where I spoke to 5 different people, none of which were interested in taking my incomings and outgoings, I have ended up nowhere. All I was offered was a managed loan, which I am not prepared to take. I am prepared to take this to court, and would like assistance to fill in forms, moral support etc. I am not prepared to write to the bank again, I have followed the template letters twice, have made numerous phone calls to them and am being fobbed off.
