  1. Update - still no defence filed on MCOL - still no money paid into my account - Still some time to go yet but expect to see defence filed at some point as it pretty much appears to be the norm with NW!!
  2. Hi Like you - no defence filed as yet - no money paid back to my account!! I will be glad when all this is done, will end up with sack at work for doing nothing work related all day!!

Hi Just spoken to MCOL, no defence yet - the lady said I am well within my rights to seek judgment after midnight but suggested (not allowed to give advice) that I call them tomorrow to see if a defence has been submitted. Apparently, if I file for judgment and they have already filed a defence it will not allow me to continue. If it says 'Judgment Filed' and they file a defence on the same day as mine is actioned, theirs would be given priority!!!! Furthermore, it could delay things for various reasons, mainly to do with administration. So unless I hear anything sooner, looks like I've got to sit it out until mid morning tomorrow to find out whats actually happening!!

Hi thelegend, I know your 28 days are up today as well, are you just sitting back to see what happens or have you made a last ditch attempt to talk to the solicitors to see whats happening - keep thinking maybe I should phone them but then I dont want to remind them their deadline is today just incase they have forgotton!!! What are your thoughts here and are you pushing the judgment button at just gone midnight???
  5. Well finally at day 28 after Acknowledgement of Service!!! Nothing been paid in to my account as at 11am - MCOL still says acknowledged on 03/05/07, therefore no defence lodged as of yet - they have until midnight! Wondering if I should hit the judgment button at a second gone midnight or give them a further 24 hours as it states on MCOL "if defendant files a response with the court by 4pm on the same day as your request is processed the response will take priority". I have also read somewhere that if this happens it can lead to the case being delayed further!!! Any thoughts on this please?

Hi there, we are at exactly the same stage with dates, keep checking my account - still nothing - I know they have until midnight monday to file their defence but getting concerned now as it would appear that some have been paid out well before 28 days are up - keep thinking I have not done things to the letter and that will be their defence!!! Have you heard anymore yet?
  7. Lol - I apologise for my incorrect use of the English Language - correction - ends at midnight on that date! In my defence I would like to add that it is Friday and instead of relaxing with a pint down the pub I rushed home to check my nationwide account just in case they had returned my money ( - still nothing!), and check up on things with the CAG and I never realised that my post would be vetted for correct use of grammer! Lol - Consider me truly reprimanded.
  8. Just to let you know that if the 28 days from the date deemed served falls on a Saturday or Sunday, the 28 days is not until the Monday following. The cut off is midnight on that day.
  9. Hi, Just wondered if you have your dates right, you say you sent your MCOL on 03/05/07 and your 28 days are up! Just to let you know that my MCOL was issued on 30/04/07 and my Acknowledgement was deemed served by court on the 05/05/07 (even though they acknowledged on 03/05/07), they state on Acknowledgement that they intend to defend all the claim. My 28 days are not up as any bank holidays in that period are not counted also because it should be up tomorrow, Saturday, that does not count either so it goes to the next working date being Monday the 04/06/07. To date, although they say they will defend no defence has been submitted which means that unless they do this by midnight Monday I win by default and can claim judgement by default. Please check your dates again!! If in doubt ask MCOL when the 28 days are up.

In panic mode - just been reading through my particulars of claim which was issued on 30 april, (they have until midnight Monday 5th June to file a defence) and I never made reference to my account number!!! I did however, send schedule of charges to court, and to contact at Eversheds who is dealing with my claim where I did cross reference the court claim number and my account number. Do you think this will be acceptable or are they going to defend on grounds of insufficient information. I did refer to the two previous letters and schedules already sent to Nationwide, so could my argument be that I had already provided all the necessary information?? Please let me know what you think and advise on anything you think I should do. So close to deadline don't want to give them any opportunity to stall further!!!:-|
  11. Hi, They have until midnight on 04/06/07 to cough up - keep checking my account for credits but nothing yet! Expect they will take it to the deadline?

    Congrats! Read that they said they would defend but when did they pay, was it on last day available before you won by default or did they settle sooner?

Hi All, I received my acknowledgement of service letter on 03/05/07, as per the norm, Nationwide are defending all my claim, - is there anyone else at the same stage as me with similar dates, also for those who have passed this stage can you tell me what to expect next. Got a case of the jitters since LlOYDS successfully defended a claim!

Hi all, Received my Acknowledgement of service dated 03/05/07, as per the norm Nationwide are defending all of my claim so have until 31/05/07 to file a defence - is anyone else at same stage as me and have a claim with similar dates, and for those who are passed this stage, what happens next? Got the jitters at moment with Lloyds Bank winning their first claim recently!

I went to the Tsb on Friday and requested details of all charges on my account from Feb 01 to Dec 02 (that is when I closed my account), I was charged the maximum fee of £10 and was told the information would be forwarded to me. I also went to Nationwide (I currently bank with them) and requested details of all charges on my account since it opened in Oct 02 I handed them my request letter and £10 fee and was told there was no charge for a printout of my charges, I asked the girl if she was absolutely certain and she said we charge for duplicate statements but not for a copy of a printout showing charges, she gave me back my £10. Is this a stalling procedure and will they ask at a later date for my £10 and start the 40 day response date start from then?
