  2. Demon - after any reasonable length of time and being stalled by Insurers no court in the land could really argue against making some form of contact - you are simply checking facts ... "have you really said it wasn't your fault " " I was thinking Tesco must have their files mixed up ..." "can you help me ? " "how would you feel if it were you" sob, sob .... In the absence of an insurance contract any motor accident would fall under commom law. The fact Insurers and others are involved is of course relevant but what options do you have ? Not many and its reasonable to follow all those available.
  3. My advice is 1. If you have the NIce Lady's telephone number ring her up and ask her is he really denying it was her fault (she went in the back of you) ? 2. Can't see how she can avoid accepting fault and when she does ask her to write,phone,fax,email (whichever) Tesco to ask them to admit the claim. 3. Norwich Union are pretty poor at the moment but they have (and most Insurers are the same) no real interest in persuing recovery against the other Insurer and its a low priority - however continue to chase them and as suggested try and deal locally (good news on this point - NU have said in the press they are bring some of the call centres back to the UK) 4. Check with the Post Office - as the agent did they provide you with a Motor Legal Expenses cover/policy ? If so contact them - they persue what is known as Uninsured Loss which in this case is your policy excess you paid and any injury (???) 5. Get a local broker next time you insure - we'll help you !!

Craig Walton has given the best advise so far - Loss adjusters are OK in my view and I have (in my 25 odd years og broking) yet to come across an adjuster who (although paid by the Insurer) does not err on the side of the policyholder in cases such as these - they do however become rather different animals when they smell a rat on a dodgy claim and they are usually good at that too. This claim will not probably be settled in full - it should be one the Insurer contributes toward - if she were my client I would get her a reasonable settlement as Craig says by getting your own builder to put forward a valid statement to substantiate the cause of at least some of the damage - also check the cover - does she have accidental damage - this helps. Lastly - if all else fails ask for an ex gratia payment - this is where you agree with the Insurer to accept the loss is not covered but pay it anyway in view of the special circumstances - its a goodwill gesture on their part and is something Insurers used to do regular years ago ...
  5. Thanks for the info Is it easy to check your details with these agencies ? I didn't know it lists applications too. What about emails on the internet that you might have responded to ? I'm sure I completed an online form which did not ask any real questions about bank details, salary, etc that sort of thing and they wrote and offered me a loan with a form ... Ocean Finance they were called and all I was trying to do was get some comparable rates before a meeting with the "facist bully boy" (bank) to sort out some borrowing ....
  6. No issue of identity theft - just the worry & concern I've had cards from MBNA in the past and perhaps they got her details from there ? However they did it, she never applied (and yes it is a real card with her name on - we also had a PIN number)
  7. My wife recently received a credit card through the post. She had not applied for it either by phone or filling in a form. On contacting MBNA they confirmed my wife had not applied for it and that it was something they did all the time - don't worry they said destroy it and that will be the end of it. My concern was how did manage to do this, send her a card with an activation number on it which may have got lost in the post and possibly cost her. Is this practice legal ? Should I complain further ?
  8. Hi - just joined. Reason being that I've had an issue with Clydes Financial Services and the level of their charge for an Arrears Letter - £22.50 - I have a store card account arranged through them and because I either missed a payment or it arrived late they have charged me - its happened a number of times over the years and has cost me about £100 - is it worth while persuing ? If so do I proceed in the same manner as you do with bank charges saying whilst I accept the charge its not proportionate ???
