  2. hi pete, thanks for you reply. when this came today i thought what the hell.....hopefuly it is what you say it is.so what do i do now?.....just wait?...they are still phoning.....i am just ignoring their call. what amazes me is that they want to help now with an affordable repayment plan but they wouldnt take an 80 quid payment when it was offered.......
  3. ok well just recieved a letter back from link this morning dear ******* unfortunately at this time we are unable to supply you a opy of your agreement however the Financial Ombudsman Service have made it clear that in situations such as this it is not unreasonable for us to continue reporting a default if it is a accurate reflection of how the account has been paid. The Infomation Commissioners Office have also made it clear that ifa default on a credit file 'accurately reflects payments on the account' then the fourth principle of the Data Protection Act 1998 has been complied with and therefore the continuation of reporting the account is acceptable.They also state: "...the failure of a creditor to produce a copy of the signed credit agreement is not, on its own, evidence that your debt does not exist or that it is not enforceable and should therefore not appear on your credit file.If the credit grantor can supply some other evidence of the agreement and you have no evidence to the contradict this then it is likely to be proper for the debt to continue to be recorded on your credit reference file" Therefore if an agreement is not available it does not mean the account is unenforceable and should be deleted from your credit file.The payments you have made towards your account are proof an agreement exists. please fill in and return the personal budget plan, whih has been sent to you seperately today so an affordable repayment plan can be organised. if you have any questions or queries in relation to this letter please feel free to contact me directly on ********* yours sincerely ms j pearcey ok so what does this all mean?......help please.....
  4. really......even without a tenancy agreement?....also isnt it a bit of a big increase.....225quid extra a month, isnt there only a certain percentage it can be raised by?
  5. my friend lives in a 3 bed terraced house. she has lived there over 3 years now. when she first moved in the tenancy agreement was done through a letting agent, she signed a 6 month contract. anyway after the 6 months was up, the landlord said he wasnt going to go back to the letting agent so to save himself some money. a new cntract was never signed. this week my friend recieved a letter from the landlords wife stating that she has gone to a new letting agent & the rent will increase in november in course with the other rental property prices in the area.now the increase is 225 a month.can she do this? any help would be great, thanks
  6. i have recently separated from my partner, although we were not living together it has left me in a lot of mess financially. i have a mortgage in my name, i have 2 children & a job with less than 16 hours a week. i am now at a point of what do i do for the best. my home is up for sale as i know i cant pay the mortgage and all the bills. until it sells what should i do?.....can i get help with paying my mortgage, ? if i cant get help will my home be reposessed? should i leave my job & go on to benefits?.....i am in one hell of a mess & dont know where to turn. all help greatly appreciated.

  11. i am not disputing that i owe the money, i just want to be able to make a payment to them. i will write a letter including a cheque. what happens if they dont accept it?
  12. what it was we had a joint account with lloyds,they gave us this loan because of our account so from what i can remember we both had the loan im sure. sorry what is a cca?
  13. hi eastendboy...well it was for a unsecured loan with lloyds about 6 years ago. it was being paid on time to lloyds. it was passed over due to my ex not paying it (he was getting the money for it, but not paying the bills) been dealing with link since about 2005, regular payments were set up each month. got into some financial difficulty with being self employed. so i have missed a few payments this year. they wanted 120 a month i wasnt able to pay, they tried to bully me into 100 a month, eventually got it down to 68 a month. thanks for your response ps, im sure your michael caine was great lol
  14. ok i have a debt with link financial that i have been trying to pay every month the best i can. i have missed a few payments on my account. i phoned last month to make a payment of 80 pound, the man on the phone was very rude & said they will not take the payment from me as i had missed some. i tried to explain my situation, & the reason why i had missed payments he said not our problem, because i had missed payments they want the amount in full......by this time i was getting very frustrated & angry with this pompus little **** i said fine you wont take my ayment take me to court!.......the day after i got a call from them again saying that if i dont pay 280 quid before the end of the month (tomorrow) they will ave no choice but to take the matter further. again i offered the 80 pound payment, he wouldnt accept it. i told him i couldnt get that money together & he said not our problem, it has to be paid. ok so can they really do this??.....i thought they had to accept any offer of payment, i still dont have enough to pay tomorrow & i am worried what they will do, can anybody please give me some advice for when i phone them tomorrow. thanks (did start this thread in a different section but only had 1 response all day also strated it in the wrong group..sorry:oops:)
  15. thanks debbbsy, i have sat reading through various topics relating to my question all day. all of it very helpful. however i still have noi idea what to say tomorrow whe link tell me i have to stump up 280 quid! i have decided to tell them i cannot afford this amount & will offer 100 quid, to which if they refuse i will pay anyway, also if they refuse i will ask them to send me in writing that they have declined my payment. they are trying to bully me into agreeing to get myself into even more debt by paying them what i cannot afford. as this is not a priority debt they will have to take my payment or take me to court.:mad:
  16. i found this.... When creditors refuse payments, it's usually because company policy prohibits it. It can't hurt to ask and if your first offer is declined, ask what they feel is an acceptable payment. You may have to negotiate for awhile and what ever you do, DO NOT agree to terms that you cannot afford. Agreeing to terms you cannot afford is dangerous and only leads to another broken promise down the road and ruins your creditability. now this says ..DO NOT agree to terms that you cannot afford, how can you not agree when the company wont accept payment, & bullies you into accepting their terms or else..!!

  19. hi all, thanks for all your help.ok today i recieved bank statements from jan 05-jan07 as asked for in my telephone conversation on the 9th of feb.dont need to get any more statements as these started three months after my account was opened.now after reading through & highlighting all my charges it totals 1629.00!!!!! these charges started in sept 05 , this first month being the biggest with charges totalling 332.00 for one month!!! i cant believe they could charge me that for one month.anyway now i have my total, im off to write them a lovely letter asking for my money back. fingers crossed they dont get to arsey.xxxxxxxx
  20. OK, ITS BEEN 11 DAYS & STILL NO LETTER SO I PHONED THEM AGAIN. THE ADVISOR I SPOKE TO SAID THAT THERE WAS NO REQUEST PUT ON MY ACCOUNT FOR THE SUMMARY OF CHARGES, & IT TAKES 5-6 WEEKS ANYWAY.SO THE ADVISOR PUT IN ANOTHER REQUEST TODAY & SAID THE INFO WAS HELD IN MICROFICHE BUT IT DOESNT ALWAYS TAKE 5-6 WEEK BUT AS THE DEMAND IS SO HIGH AT THE MOMENT I WILL JUST HAVE TO WAIT. SO DO I WAIT OR DO I START SENDING THE LETTERS OUT.
  21. ok, well i phoned the abbey this morning and asked them for a summary of all my bank charges since i opened my account & they said no problem, so just waiting now.

HI, i have been an account holder with abbey since aug/sept 2005.i wasnt aware that i could claim back my bank charges until this morning.just started using internet banking when i looked over my last 3 months statements i found that this month i have had 6 bank charges amounting to 140quid, last month 3 charges 90quid.now usually i wouldnt have thought anything of it other than robbing so n so's, but i dread to think how much i have been charged since i have been with the abbey.the charges are for unauthorised overdraft, unpaid & cleared direct debits.am i entitled to claim? i am also worried about the consequences of making a claim.yes i have read the FAQs & i am still unsure how to go about getting started. any help would be greatly recieved.thanks
  23. hi, i have been with the abbey since sept/aug 2005. only this month i have been charged 5 times amounting to 140 quid, last month i was charged 3 times 90quid.for unauthorised overdraft & unpaid direct debits, i dread to think how much i have been charged since i opened my account.didnt realise that i could claim my money back, so i am now going to try & sort out getting it back, somehow.
