    Hi all thanks for all the replys. I've received another letter from them stating that they are going to send the debt to an external debt collector or consider legal action. On the application form there is no basic terms of rate of interest or no credit limit etc. so am I write in thinking that regardless of what they say it's not enforceable? Should I send them a letter stating that and if so has anybody got a template I could use? Or should I just ignore the letters? The alarming thing for me is how quickly the debt increases with Cabot they seem to add interest/charges for fun. Any responses or help is appreciated. Thanks Suzie

    Hi, I hope somebody can help me again!! Can you please read through this thread that i started over 2 years ago and give me some advice? After not been in contact with me since I last posted on here today I received a letter from Cabot with a copy of my CCA ( well I think it is it's an apllication form)from MBNA from 1998. They've also included a copy of a printed list of transactions. At 19/04/05 the balance was £3816.31 the printed list today states i owe £5915.24 they've continued to add interest, whilst been in dispute is this correct? What do I do now? Will I have to pay the full £5915.24 now they've produced the agreement? Any advice would be gratefully received I feel physically sick. Thanks

    Hello me again seeking advice!! Can you just have a quick read through the thread. Cabot have now sent me another letter, stating that Cabot Financial Group have recently bought my account held with MBNA and that they have tried to contact me recently and that it's vital I contact them to discuss the account. It states if I don't contact them to agree a suitable repayment plan they will move my account to the next stage of collections. Its from Peter Anderson (Customer Laison Manager). What is my next move? Should I contact them??

    Thanks for that. Do I just wait for the next letter from them then? They used to ring me at work all the time, if they ring do i just tell them I'm awaiting a copy of my credit agreement?

    Hi there, hope somebody can help again. If you read the thread you will see that way back in April 07 Cabot defaulted on the CCA,they never sent me any further correspondence and certainly never procduced a copy of my credit agreement. I have heard nothing from them until today that is, when I once again receive a letter from Emma Robertson stating that they have supplied me with the information they believe resolves my dispute, and that they will keep the account on hold for 14 days so I can contact one of there customer advisors to discuss repayment, however if they don't hear from me they will pass it back to there collections department for themto take further action. What should I do next? How come it as taken them 10mths to contact me? Any help would be appreciated. Thanks in advance Suzie P

    Just thought I would bring this back to the top as I haven't received any further correspondence from either MBNA or Cabot, any advice on what steps to take next would be appreciated.

    Just to let you know that today i have written to both MBNA and Cabot. I have informed MBNA that I had already requested a formal SAR and that if they don't responed by thurs 22nd March they are in breach because the 40days are up. I have also SAR Cabot, and told them that I still haven't received a copy of my credit agreement, that they assured me was available. They have another 10days then the 12days + 1 month is up. I will try to keep you informed. Thank You
  12. Hi guys, hope you can help. I sent a SAR request to Lloyds TSB on the 4th Feb 07 by recorded delivery and this was delivered on the 5th Feb 07. On the tracking service it as been signed for. I have yet to receive anything back from them and the 40days passed on Saturday. They haven't cashed the cheque yet and today I got a letter from Commercial Collection Service dated 14th March chasing the debt on behalf of Lloyds. It is a joint debt but they have only issued the letter to me and not my husband and have said they are preparing documents for court action against me, and without a doubt that costs will in favour of there clients. Whats my next move??

Im going to SAR Cabot like suggested,should I write to them and tell them that they are in dispute because they haven't supplied the CCA ro just leave the ball in there court? I will also write to MBNA and tell them that I originally asked for a formal SAR and that they haven't responded. Thanks again, I will try to keep you updated.
  14. Hi guys, Hope somebody can give me some help? I had an original credit card debt with MBNA who in 2004 passed this on to Cabot Financial(UK)Ltd. I have had numerous problems with Cabot, mainly due to the fact that out of all my creditors , they were the only ones who continued to add interest to the debt at an unbelivable rate. They also hardly ever gave me a idea how much the outstanding balance actually was, they would send letters chasing for payment with account details but never gave outstanding balance details. I asked them on quite a few occasions to freeze interest but they never did this. Last September I made a decision that I had to sell my house because the stress was getting too much, I went to live with parents and have negotiated with most of my creditors to pay off the debts with the little amount of equity that I received. Cabot contacted me to chase there debt again, and I asked how much I owed she said £5,780, Im sure when the debt was with MBNA it was only in the low £3000's. She said if I spoke to the underwriters they would come to some agreement for me to clear this, I only had £2562 so this is what I offered them as full and final settlement. They never responded. I then on Jan 16th sent them a CCA request after reading this forum, I also sent a SAR request to MBNA. I received a standard letter back from Cabot on 12th Feb which was already over the 12days stating that they have requested the agreement from MBNA but will not have it in 12days and that Cabot Financial(Europe)Ltd/Kings Hill(No1)Limited are the legal owners of the account. I have not received anything else until yesterday when I received a letter from Cabot Financial(Europe)Ltd,stating with regard to your recent letter regarding the above credit agreement our underwriting dept.are not able to accept £2562, but will accept £3200. No credit agreement!!! What should I do??? Also, on the same day I received a letter from MBNA with some print outs of transactions with no amounts just detail. They also sent the £10 chq back uncashed and a cheque for £140 as a goodwill gesture if I accept as full & final settlement. They said they havent cashed £10 chq because they havent treated my request as a formal data SAR but if I wanted to do this should fill in an attached form and send the cheque back and then they will provide the full details in 40 days. Is this a stalling tactic?? And what should I do with the £140 cheque from them? Sorry to waffle on, any help would be appreciated.
  15. Can you send a CCA request to a DCA who are chasing an old cataloge debt? I only owe £718. The catalogue company originally passed it on to a dca called fredrickson international ltd, i wrote to them in November and offered them £400 for full & final settlement and also told them that my address had changed and that I am now living with parents. I never heard anything from them at all. This morning I have received a letter form another dca S.R.J Debt Recoveries chasing this debt and also saying that they have had to do a trace on me and added £15 to the original debt because they didn't have my new address details. Any help would be appreciated.
  16. Just got a copy of credit report from experian. On there is a debt from lloyds TSB for £617. it says it started in feb 2001 and defaulted in july 2003. It states the amount is still outstanding. Why haven't they chased this? I haven't got a clue what this is, and have recently settled a couple of old debts with TSB and when I contacted them they mentioned the 2 on file but no mention of this one. What should i do because I would like it removed.
  17. Ive received a letter from 1st credit also after sending a CCA request, it states that they will contact there clients but it could take a month. What timescales do i take notice of, the 12 days on the CCA or do i wait til a month like it says on there letter.
  18. Hi all, Can you have more than one default on the same debt? ie. if say lloyds tsb have put a default on your credit file, then they have sold the debt on to dca, can the dca also default you on the same debt? Thanks in advance

  20. Hi, can anybody help? Just had letter from 1st credit to say they have now taken over a lloyds tsb debt. I gave them a call and asked them to supply a copy of my cca, the guy transfered me to a lady, who straight away became very defensive. She asked why I wanted this,was it due to delaying tatics? And that in this day an age they don't have to supply it. She said she would put in a request to TSB for it, I am I wrong in thinking that if they have bought my debt they must have a copy of this. She said this isn't the case and do I really think that lloyds tsb employ people to trial through there archieve looking for these things. Can anybody help!

  22. Wescott told me that they had passed the debt back to Lloyds TSB though, so should i still send CCA even though they no longer have the debt?? Sorry, if i sound dumb. But im new this.
  23. Can anybody give me some advice. I have an outstanding debt that was originally with Lloyds TSB, they passed this debt onto Wescott Credit who then began to chase us for payment, I made some payments but also missed some. My position as changed a little now, so I contacted Wescott to see if I could come to an arrangement to pay the debt off as full and final settlement. They said they had passed the debt back to Lloyds TSB,we contacted Lloyds(this was Nov 06) and they said they had sold the debt on to 1st Credit and that they would be in touch. We still hadn't heard anything as of yesterday, so called Lloyds back only to be sold the same thing again, this time they gave me the telephone number of 1st credit, I contacted them, only to be told that they have no record of me on there system. What do i do??? Im trying to settle the debt, but cannot locate it. Any help would be appreciated.

  25. I had problems with A&L and still am really. We were paying them a reduced amount on a £15000 loan also direct to Global, we didn't miss payments but they said they were taking me to court to get more money. I attended court and the judge suspended it for 6months to see if my circumstances changed, they didn't attend court. After six months I contacted them to tell them my financial situation hadn't changed and could we make another arrangement, they refused to talk to me and said that they had instructed solicitors to get a charging order on the property. I attended court and once again they didn't attend, the judge wasn;t too pleases about it and threw it out because they couldn't be bothered to turn up. Im now living with my parents and had a small amount of equity from the sale of my house. I wanted to try to pay my creditors and after dividing the equity out between them it worked out at 60% of each debt, i would be able to pay. Most of them have accepted this, but A&L will not discusss anything, and have not sent me any corrrespondence at all. What should I do? Is 60% of the full debt, as full & final settlement unreasonable?
