  2. Hi Buck Rogers What exactly did you say on the phone to them to get them to pay up the extra? My friend filed her claim over a week ago, she received a letter from the halifax saying the were going to defend, a few days later they are offering £1300 instead of £1700 Any help much appreciated Thanks Nikki

Hi My friend filed her claim via moneyclaim.gov a week or so ago and she has just had a letter saying they will repay £1300 instead of £1700, after they sent a letter saying they were going to defend all of the claim, the amount on the claim is £1700, so should'nt they be paying this amount? Anyone else had the same letter? What should she do now? Inform the court? She does'nt want to accept the £1300 she wants the full £1700 Please get me back to me asap??? Received my letter from the courts yesterday, a notice of issue, says claim issued 25th Aug, court sent it to defendant 07 sept, and it will be deemed to be served on the 10th sept, the defendant has until 25th sept to reply. Will I be waiting until 25th sept? Has anyone had to wait so long? Many thanks in advance Nikki

  5. Congrats bagsnballs! Just out of curiousity who is Rachel Hinchcliffe? I filed my claim at my local county court last friday and have not heard anything, ahh all this waiting is driving me crazy! Phoned the court just now and have been told they are short staffed and will be dealing with last weeks claims next week, dont they know what they are doing to me?! The kind lady who helped me with my claim said I would hear this week but now it's going to be another 2 weeks probably. Anyway will hopefully be posting I have won soon Happy spending Nikki x
  6. Well done Lee! Happy spending I went down to the courts and filed my claim last friday, they said I'd hear this week, but nothing so I phoned them and they are short staffed and wont be looking at it until next week, grr! Hopefully be posting Nikki's won soon though Good luck everyone Nikki x
  7. Thanks tinkerbelle, very helpful, I am currently paying an amount to each of them every month but do I have to wait until they are all completely settled before sending the requests to remove the defaults from file? Regards Nikki
  8. Hi Can I send these letters off requesting removal of a default even if I have not paid in full? Or do I have to pay in full then request removal? As it says at the beginning not to bother paying in full?? I'm lost please help me, also can we do this with a ccj? I have 1 ccj and 3 defaults, because I left my partner 6 years ago and he never forwarded any mail to me, he should have paid the debts as they were his responsibility too but he didn't so here I am Hope you can help me guys, no way I can go for a mortgage with these hanging over my head Thanks in advance Nikki

  10. Hi guys How is everyone getting on with this? I am ready to submit my claim to moneyclaim.gov.uk, how does it work? Do I need to submit and wait for them to contact me? Will they ask me to send them my spreadsheet of charges etc? I just tried to submit but it is saying error cannot submit due to technical error please try again later, is that because it's a weekend do you think? How long before you hear from them? And does anybody know how long before you get a result? Thanks guys, you've all been great Nikki

  13. just been reading the guide and step by step instructions to filing the claim with moneyclaim and am wondering whether the particulars of claim bit (I posted earlier) is the wrong one to use on the online form, should I use this one instead - IN THE ANYWHERE COUNTY COURT BETWEEN JOE BLOGGS CLAIMANT And GRABBBIT BANK LTD DEFENDANT PARTICULARS OF CLAIM 1. The Claimant [has] [had] an account 1 ("the Account") with the Defendant which was opened on or around 2 [and closed on or around 2 ] 2. During the period in which the Account [has been] [was] operating the Defendant debited numerous charges to the Account in respect of purported breaches of contract on the part of the Claimant and also charged interest on the charges once applied. The Claimant understands that the Defendant contends that the charges were debited in accordance with the terms of the contract between itself and the Claimant. 3. A list of the charges applied is attached to these particulars of claim. 4. The Claimant contends that: a) The charges debited to the Account are punitive in nature; are not a genuine pre-estimate of cost incurred by the Defendant; exceed any alleged actual loss to the Defendant in respect of any breaches of contract on the part of the Claimant; and are not intended to represent or related to any alleged actual loss, but instead unduly enrich the Defendant which exercises the contractual term in respect of such charges with a view to profit. b) The contractual provision that permits the Defendant to levy such charges is unenforceable by virtue of the Unfair Contract Terms in Consumer Contracts Regulations (1999), the Unfair Contract Terms Act 1977 and the common law. 5. Accordingly the Claimant claims: a) the return of the amounts debited in respect of charges in the sum of £ 3 and any interest charged thereon; b) a declaration from this honourable court that the term of the contract leading to the application of the charges is unenforceable; c) Court costs; d) Interest pursuant to section 69 County Courts Act as set out on the attached list of charges or at such rate and for such periods as the court deems just. I have no list of charges, just my statements and spreadsheet of interest debited, I'm starting to think I'm doing this all wrong, can someone help and I can email them my spreadsheet please?
