  1. I am just extremely frustrated that it happens to be this letter that is seemingly 'lost'. I will wait and then sent the dispute letter. My last payment was due on Dec 1st and I have heard nothing from them which is most odd!

  3. Thanks for your post Taz, I don't feel quite so panicked now! Goodness knows why they haven't been delivered. Hopefully it's just a RM oversight or something. I'll put a note on my Outlook system it's the 23rd Dec and will have the other letter ready to send them. Hope you get it all sorted too - I am not a patient person that's my trouble

I saw you saw working days etc. Could you also point me in the right direction as to where I can find the telephone harrassment letter? Have looked in the templates and can't find it - Got it!   5. Ok, can't find whewre to check on the RM site whether it has been cashed. That link just takes you to a site where it then gives you a link to the RM site, no actual page to check etc. The only way I can check with them to see if they have received it is to ring them and I don't want to go down that route with these people. Not quite sure what to do. Can they actually refuse mail? I suppose thay can do whatever they like can't they. They usually do!
  6. I posted two letters out last Thursday and sent them both recorded delivery. One of them was a bank charges letter, the other my CCA for Credit Solutions. The bank charges letter was received, but apparently Royal Mail have no information on the other letter yet (typically the most important one ) and they say information will appear online when it's been delivered. I have emailed Royal Mail, but if I keep getting this error message I'll have to assume that they have either lost it, or CSL have refused it. What's your advice? To just leave it and see what CSL do? This is an old debt that I have been paying off for goodness knows how long, and my CCA (if anyone has it) would be about 10 yrs old now.

  8. I have just been looking for the letter templates. The ones given letters, wasn't this one N or something? I must be going blind as I can't find them!

  10. Okay, I see. Thank you. So the first thing she should do is send of the CCA request isn't it? Bless her, she sent them a letter today asking them to reduce her payments as they have been pestering her on the phone, I have the telephone harassment letter at the ready!
  11. So if they can still enforce an agreement what is the point in having the 12 days? Where would she stand once she has received the agreement? They are asking her for ridicuolous amounts of money, her monthly interest rate has gone up from 1.5% to 2.5% and she can't afford what they are asking her for. (This is my grandmother by the way) I *think* it may have been a good 5 years ago when she went with them.
  12. I have told a relative about this site, and they would like to know what happens if we ask for the CCA (from MBNA) and they DO have it, but provide it after the 12+2 (does that equate to 14 days by the way? - Sorry - I am new to all of this!)....

  15. So is this letter okay? This letter is a formal request pursuant to s.78 (6) of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide. I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.78 (6) will apply. If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties. Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR). I enclose a postal order for the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose. If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee. I look forward to hearing from you.

  17. Oh goodness this has totally confused me now. I have just printed off a CCA letter to CSL for my Barclaycard. Does this mean the letter is wrong??

  19. Gosh I sound like a right moaning ninny don't I !! So whilst I am waiting for them to get back to me with my CCA the account is on hold as it were and they can't (or shouldn't) pester me for payment?

  21. LOL :grin: Okay, I have got a copy of the CCA request ready to post off, just need to get the PO to go with it. Shall I send that alone, or send a payment also? They know I have only recently started to get my JSA, so if I am sending a payment I could put in the letter about it only being a basic living allowance etc?
  22. Thank you, sound advice indeed. So, do you think I am better off simply sending the £1 PO for the CCA and seeing what they come back with and not sending them my payment due on 1st Dec in a seperate letter?
