  2. My thoughts exactly. If someone has taken something of mine without my permission in my eyes it is theft. She did sympathise with me, but said there was nothing she could do. I tried expalaining that on previous occasions I had given them permission to take monies from my account, but that was only when I was on the telephone and giving them the card details! Madness.
  3. As you know they received it on the 19th Jan then count that as the first day of the 12. You can send a dispute as of today
  4. Hahaha! The first CAG wedding... fantastic! Getting back to *ahem* matters in hand I have just spoken to Thames Valley Police (groan). They will not give me a crime reference number as they have said it's a civil matter and not a criminal matter. They have said that this is because I have given them permission in the past and that I am having dealings with them with regard to the debt itself. They suggested (haha!!) that I go to CAB. I am going to write to everyone you have said above and see what happens. I am having nothing to do with CSL from now on, I know that much!
  5. Hi Davey (Thank you so much for your help on my threads by the way, you're a star) I am forgetting I have already sent MBNA a dispute letter, and in reply to it was sent all of the jargon above. Should I simply send an Subject Access Request to them? Actually I am going to write to them asking them if that is all they have with regard to the full original agreement, if they don't play ball, then I shall hit them with an SAR.
  6. No DD with them. They just used my card and took an unathorised payment. Cancelled the card got a new one on the way.
  7. Oh darn. That's me done for isn't it then Davey - the payment is the whole reason I discovered CAG in the first place. I am on JSA and was paying £35 a month, I made a late payment to them and they then put it up to £50. I said it was too much. They said TOUGH basically. I then came on here and here I am. I have no idea what to pay them, and as they have now stolen money from my account (see my other thread) I am loathed to pay them anything unless I have to!
  8. Okay, will do. If I SAR them, am I still meant to make payments? I haven't been doing so, although they took an unauthorised payment from my card today, so have had to get on the phone to my bank etc. Nightmare (a whole other thread infact!).

  11. Hi Davey, have you had any luck with your MBNA? I have the dispute all ready to send tomorrow (if I can get to the PO past the snow!) for my nan...do you think I should send an Subject Access Request too? Edited to add: Could they say that the date stamp/signature is all they need to put on it from their side?
  12. That's terrible Sosumi... I don't know what the answer is really. Cash machines tend to be just as bad by the looks of them, so how exactly are we meant to pay for anything?! I guess I could just go into my bank everytime I want money can't I. Seems a bit of an old fashioned way of doing things though. With regard to tonight's episode I am going to complain to OFT about CSL and see what they say. I hope I don't have to wait too long for my cash, and in all honesty if I do have to pay this Barclaycard debt I really do not want to have to deal with CSL, but what can I do if that is who BC have refered it to?!
  13. What a nightmare Goldlady. I can't believe they were able to use an expired card in your case. I just hope I do get my money back, £50 may not seem a huge amount, but as I have only got my JSA coming in it's a massive amount to me at the moment. I am not too sure what to do about CSL though, how dare they just take it...and using my signature too!
  14. Jeez, you don't need this at 10pm on a bloomin' Monday night do you! The bank (HSBC - nothing to do with my CC debt) have cancelled my old card and ordered me a new one. They said the payment was put through online using MY SIGNATURE!! They have raised a dispute with their fraud department and have said the money will be back in my account in 7 days. What do you suggest I do now? This is theft, surely?? I can't believe they have done it to be completely honest, my gob is totally smacked! I am about to SAR CSL/Barclaycard for a real copy of my CCA as they sent me utter crap, hence why I haven't made a payment. I think I will send them a dispute and then the SAR??

  16. No DD agreement with them, I simply used to ring up on the 25th of each month and pay using my Solo card (I used to read out all the details over the phone) and they would take the £37 from it. I did not authorise the payment of £50 as I hadn't rung them to make the payment! They have stored my card details without permission and taken a payment without my permission! I am so bloody angry, I am seething!
  17. Barclaycard have passed my CC debt onto Credit Solutions. I made a late payment to CSL a month or so ago, they told me as my payment was late I had broken my agreement with them and that my payment per month was now going up to £50 from £37 per month. I told them I couldn't afford it and that I was on job Seekers Allowance, they said that was all they could do I made my last payment of £37 and then came on here to moan (I pay over the phone by card normally). I CCA'd them and Barclaycard sent me a copy of my initial application form, no sign of a CCA. I then waited to hear from them again as to be honest i couldn't afford to post a dispute letter at the time! Well, I just checked my bank account and the **edit ** have taken £50 out of my account today!!!!!! They are not meant to hold my card details, let alone take a payment without me being on the phone giving them my card details! Is there anything I can do, this is theft surely? I am now £4.52 overdrawn

  21. The £300 was for thw whole thing! They are a small company that started out in the middle of 2007, hence why their prices are low as they are still building up a portfolio. Their website also gives that information. I rang Royal Mail today to see if the letter had been signed for (I sent it recorded) and they said they have no record of it being delivered. Typical. I have no idea what to do now then??? £300 might not seem a lot of money, but it's a massive amount to my sister. In actual fact the photos were so bad she'd rather have the money back! (They have proofs, normal sized photos with a perm marker crossed on them)

In summary I have sent CCA requests 77/78 to all of the above. With MBNA we received nothing back. I sent a dispute letter on my nan's behalf. We then received a copy of what appears to be the original agreement with just my nan's signature on it (this was an internet application) but not their signature. We have therefore assumed that as they have not sent the agreement with *their* signature *and* my nan's signature that they have not complied with out request and the account was still in dispute. Davey has now pointed out to me that as I sent them a CCA 77/78 that they do not have to send the signed original agreement (I think, I get confused!!). Davey kindly send me in the direction of this thread: http://www.consumeractiongroup.co.uk/forum/legal-issues/173201-why-you-shouldnt-use.html This seems to say that basically the 77/78 is a waste of time as they do not have to send you anything. When I read the thread it seems to be that use should use a different letter when it comes to creditors as the 77/78 will get you nowhere. However the letter that is recommended on that thread (31.16) would seem to be the first step in taking them to court to obtain information??? (Please someone correct me if I am wrong??) Can someone please tell me that having done what we have done and received what we have received what I should do now with regards to my nan and MBNA (especially). She will *not* want to go to court to request the correct documentation. She has a very bad heart condition and this is putting enough strain on her as it is. If someone could help/explain things to me it would really help. Thank you.
