  2. you could call them and ask them to refund the charge and stop any others that are due if it was the first time that you have gone OD.If they refuse use the templates on here and claim back all charges since July-2001

Hi Irishlass Send them your LBA letter giving them 14 days to pay up and state that after this 14 day period you will instigate court action without further warning to them, you may get lucky and get another nonsensical reply off them but I doubt it. There is lots of help on here so you will be fine and you will get your money back eventually. Forgot to add, make sure you send your "Account In Dispute" letter off to them as well just in case you haven't

Hello to all again Firstly let me apologise for posting this first of all in the Successful Claims thread, I was just so excited to be back on here ha ha Anyway round three for me after two full claims settled in 2007, I am gunning for an old account here and going back until 1999 (well gonna try). Waiting for my statements to come through then will get a lovely letter off to Abbey and email to Inga asking for my money back. Does anyone know if you can claim back PPI, See if credit cards and loans are actually enforceable even if the accounts are now closed, I remember my CC issuers charging £30 a pop late fee blah blah before 2006 and I want that back too.   6. Hello to all After a couple of years away I am back again with Abbey, on to the third claim for an account that was not claimed for when I issued proceedings on the last two. This time though i am going back as far as I can (just waiting on statements), I want to fight for the lot !!! ha ha . I am curious, is anybody aware if you can claim on credit cards and loans that have been paid off and accounts closed, I remember my credit cards had loads of charges in early 2002 at £30 per go, (am aware that as of 2006 was set at £12) or even better see if the agreements where actually enforcable at all. As always thanks so much for the advise
  7. Can anybody give me any pointers in the right direction. I have succesfully claimed £2500 from Abbey, however Halifax are prooving to be a pain in the a***. I requested statements on 15th May this year and received nothing, i had given them 40 days, then weeks later I called them to be told that the banking com is aware that they are delayed in sending out statments due to the number of claims. I sent them the SAQ failure form 3 weeks ago and still have nothing and the cheeky gets have banked my cheque for £20 on 19th May( i am claiming for 2 accounts) Where do i go from here??????
  8. Course you can, abbey acknowledged my mcol claim on 27th april and defended on 24th May, Emailed inga on 3rd june thought it was worth a shot and it paid off, i would do the same again!! In fact i have a second claim for £795 for charges applied since i started my claim, so when this cheque has cleared i will send a LBA BY RECORDED post and also email inga, you never know. Who knows how these banks work. Good luck Stuart

Well to say iam supprised is an understatement. was still waiting for northampton to allocate to my local court, not AQ or court bundle yet. emailed inga on 3rd june with up to date statement of charges(CLAIM FOR 2300). She offered my £1850 straight away, i emailed on 6th stateing iam only charging her 8% interest and not 16.39 so i want the full amount. She has settled today for £2300. Now being sceptical i asked for scan of cheque to be sent and it arrived today. So i've won, no court no aq no hassle. Have another claim ready to send off for charges added since, i don't think this will be as easy though. Thanks everybody for your help, donation on way as soon as cheque is cleared. excellent web site
  10. Congrats, won my today as well. Without any allocation questionnaire or court bundle, was still waiting for mcol to allocate my local court after their defence

  13. sorry for starting a new thread, i can't figure out how to change my title. waiting for northampton to allocate to my court, sent a up to date spreadsheet to court and inga by email with charges. never received an offer so far, my claim is £2300 inc court fee, not done a AQ or sent any court bundle. though i would send to inga to see what would happen and below is what she has sent to me, help really needed as its more or less fopr the full amount, should i send a emaoil saying i want the full. "Without Prejudice" Thank you for your email. I am instructed to make an offer to you in the sum of £1841.13 Payment would be made without admission of liability by Abbey. Payment would be in full and final settlement of your claim. Payment would be made into your account (if open) or posted to you. Upon receipt of the settlement monies we would ask you to please write to the Court withdrawing your claim and provide to us a copy of your letter.   15. [Thanks KnellyK I will print these off then add add them to all my stuff, starting to get a court bundle together just in case. So Far i have all the corespondance sent to abbey by post and email, statements latest schedule of charges(sent another one off today to abbey and court as still waiting for them to let me know where this is going) and all the stuff from the court bundle link. I am not sure wether i have to include any "witness statements", not sure what this means, is it a list of cases that have been settle with names and case numbers.
