I had an email from Talk Talk advising me what to do, this resulted in cancelling credit cards and informing my Bank. My Bank advised me also to register with Experian because the information taken could lead to someone taking a loan in my name. The problem with this is that it could be in the foreseeable future, therefore I have to pay £14.99 a month to keep a check. Talk Talk don't seem to think its their responsibility, but it is with them I have my contracts and them I entrusted my details. I have threatened to terminate my contracts, and don't see why I should pay the penalties, as they are going to cost me over £100, plus the stress of this weekend. Can anyone advise me on how I stand, I have sent a letter to Talk Talk. -
After starting in April going through MCOl, My case was transfered to the local court because HSBC submitted defence. The Judge at my local court put a 28 stay for settlement. I wrote to DG with 2 nudge letters. They did not reply. I have now received a letter from the court saying " The court of its own motion is considering striking out the defence in this action as an abuse of process, The basis for this is the fact that the defendant is settling all claims of this nature where the claimants are seeking the reimbursement of Bank Charges, with no claims proceeding to a contested hearing." He has given them 14 days for a schedule setting out all claims of this type in England and Wales which have proceeded to a ninal contested hearing. He goes on that in the absence of any such objections being filed in time the defence will be struck out and judgement entered for the amount claimed by the claimant. HAS ANYONE RECEIVED ANYTHING LIKE THIS

Need Help. After filing a claim through MCOL, it was transferred to the local court. I was waiting for an allocation questionnair, but received the following from the courts. It is ordered that this claim be stayed for 28 days from the date of service of this order for settlement. The claimant to notify the court of the current position on expiry of the stay. What does this mean? Where will I find the date of service? I was waiting to here from the court to see if there was an allocation questionnair before I gave DG a nudge letter. All I can think of is that this is a period of time to try and get a settlement, and it is my responsibility at the end of the time to let the courts know if we have got anywhere. Does anyone have any suggestion on where to go next.

I have now received a transfer to a local court. Coupled with the HSBC defence. Their defence claims that the account is governed by the defendants personal banking terms and conditions. That the defendant is entitled to make a charge for its services as set out in the price list. The defendant denies that the charges applied to the Claimants account amount to penalties. The charges applied to the Claimants account are reasonable and are properly and fully disclosed in the defendants terms and conditions etc etc Is this a standard defence reply. Also with the notice of transfer I received the following. The allocation questionnaire be dispensed with in this case unless the district judge at the court of transfer orders otherwise. All I am interested in is this standard. I take it that I just wait until I hear from the Local court.

When the details go to my local court, how long is it before I hear, as I go away for a week. I suppose they give you enough time between each process. Also will i be able to see their defence????

I am 60 and I started claiming for my daughter through MCOL, HSBC said they were going to defend, the 28 days were nearly up, but when I checked the MCOL website today, this is what I found. Will they send me a copy of their defence? What happens now The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

Welcome, I am new to this game, I am 60 years old and the modern technology does confuse me sometimes. I am helping my daughter claim back bank charges with the HSBC, and so far have failed with letters, therefore I have claimed through MCOL. They acknowledged on the 13th April, and state that they are going to defend. I take it that we just sit back and wait to see what they do. Is there anything else I should be doing
