  2. I know she is female - had to phone them last week and spoke to her - was gonna ask her for her autograph cause she's so famous - then realised i alredy had it on my offer letter

DizzyDora, Just read your post - a £40 charge sounds like a fee of £12 for a Royalties Gold Account per month (This you can't claim back) and an illegal penalty charge of £28 for being overdrawn on the account. You can claim back the £28 pounds just subtract the royalties charge form the £40 charges you have to work out how much you can claim back from them. As to the question where you send your letter some people send to head office others to their branch - I personally sent mine to my branch (posted Royal mail recorded delivery so I had proof they had been recieved) which I think helped my case as by the sounds of it my branch were hasseling Edinburgh. I got a phone call from my branch the day they recieved my Letter Before Action (2nd letter sent 14 days after my preliminary letter). Saying that I should have had an offer of settlement in full from Edinburgh, low and behold the next day I had a letter waiting for me when got in from work offering me exactly what I had asked for. As T4FF has stated above - your better using the templates from this site (I did so I know it definately works). Also do read up about it, foolow some peoples posts so you know the proceedure - this will help you feel more confident about battling with the RBS. Hope this helps Brian
  4. Where did you send your LBA to? I sen't mine to my branch - so I think they may have been chasing up Sandy Watt to get it resolved, I got a phone call at work from my branch the day they recieved my LBA and I know that the lady I had spoke to had contacted the Customer Relations Unit to chase it up and find out what was happening. I'm guessing thats why I had such a prompt response.
  5. Well done starting your claim for justice agains't them, Put my first claim in a couple of weeks ago - they offered me a full settlement after recieving my LBA so hopefully shouldn't take you too long to recoup the money your owed.

  7. OK, sen't my own letter of acceptance last night - in their pre-paid 2nd class envelope - making £9.2bn you'd think they could afford 1st class for their reply envelopes. Now all I have to do is wait for it being credited, then i'll fill in my survey, make a donation and then start all over again for the next set.
  8. Slightly off topic but i didn't think it was worth starting a nnew post for - for those of you that have settled how long to RBS take to credit your account with the refund?
  9. On my letter of acceptance - I wrote my own saying I was happy to settle for charges made from the period xxx to xxx as listed on my schedule of charges. As I wan't to claim more from that account. Posted it yesturday, lets see if Sandy accepts my acceptance letter.

Well spoke to Sandy Watt today, not sure why but I thought Sandy was a guy was a bit thrown when she introduced herself as Sandy Watt, looks like she's gonna offer me the full amount - Offer in the post - all I need to do is sign and return (or in my case write my own acceptance letter on MY terms). Hopefully shouldn't be long till this ones settled then on to the next set
  11. I'm just intrested in what they say - won't give them any extra time for promises made on the phone, unless the offer is in black and white i'll proceed to the next stage on the time scale that I gave them
  12. I used recorded delivery at £1 to send my letters to my branch (just opposite the PO as it happens lol). You can get a scan of the signature a few days later.
  13. I sent mine to the branch, never heard anything after prelim letter but had a phone call earlier today now they recieved my LBA. I sent both recorded delivery so I can prove they have been recieved. The girl that phoned said it had been passed to the relevant department but i should have had an offer of what I was looking for sent out. If I don't recieve the offer by Tuesday I'm to phone a girl at my local branch, although not sure what she'll be able to do for me. However deadline still ticking for filing my claim through court
  14. LBA sent recorded delivery on 26th Feb. Recieved a phone call at work from a girl from my local branch today saying that an offer of what i was asking for had been posted out to me, if I don't recieve it by Tuesday I'm to give her a call. Well hopefully they'll settle before court to save me running around doing more work. If I get a successful settlement i'll go after the rest of the charges from then when this has completed (i.e The funds are in my hand).

Thanks texel, well I'll phone the branch if I don't hear anything by Tuesday - The girl on the phone sounded quite nervous about getting my LBA, not sure how many the Kilmarnock branch of RBS have recieved before. Was a similar to when I went to the branch a while ago to get copy statements, girls running around asking each other what they have to do.

I've never had a default on my credit history from RBS, I had a phone call from my local branch saying that they sent me out an offer on 12th February (Doubtful) I didn't send my Prelim letter till that date so wouldn't have been recieved by them till 13th, They recievied my LBA today - hence the phone call - I was told to phone back the woman at the branch on Tuesday if I still hadn't recieved the offer. However deadline is still ticking no offer the to the courts it goes. So hopefully won't be long till first set of charges is settled then its on to the second set. I'll update my own thread with the details tonight - I'm on my lunch break just now
  17. Many thanks, 2 claims should do it - was going to keep them seperate anyway, 1st claim is for £736 - LBA sent yesturday. See how I get on with that before going for the remaining £500ish claim. Do you know anywhere where I might get some advice in filling the court papers in (no getting ahead of myself just want to make sure I can keep to my deadlines I stated to them - 13 days before I start court action against them if i don't get a settlement. I'm not too bothered about the intrest on either claim just be nice to get the charges back- the first claim will clear the overdraft I have RBS and the second will pay for a well deserved holiday and a donation to the site from both obviously ;-)
  18. Was to do with cost I wanted to keep it in small claims - its ok claiming the charges back - but i'm not fortunate to have £150 spare waiting for it to be claimed back. I could only afford to do that for maybe 2 weks if it went any longer i'd have to miss bills that need paid

  21. Well i'll be off home for lunch in under an hour to check if postie has brought me anything from RBS which I doubt. If not its off to the P.O after lunch to send my LBA recorded delivery.
  22. Sent prelim letter to my Branch as well recorded delivery - kept a copy of the signature from Royal Mails website. Not heard anything from them - LBA will be sent recorded delivery today. Wonder if i'll get strange looks in P.O. today when I ask for recoreded delivery - the branch is opposite the P.O. - £1 delivery for someone to take it acrross the road - lol Well hopefully won't be too long before the offers start pooring in
  23. Has anyone done a small claim (under £750 in Scotland) I'm looking for help filling out the form for court. Also if any of you that have been to Kilmarnock Sheriff court has done it that would be even better as thats where I will go. Will be claiming 2 sets from RBOS one for £750 and one for around £500
  24. Not heard anything back at all - thought i may have had a letter saying that they recieved mine - was sent recorded delivery so i know the did recieve it - well i'll get a LBA letter posted on Monday
  25. Hi all, Well finally started getting round to starting the claim process, just about to send of my preliminary letter to RBS with a schedule of the charges that i'm claiming. Total i'm claiming is £736.00 from Feb 2003 - Nov 2005. I will be claiming in Scotland so I have a £750 limit to go through small claims court, I'll look at claiming the rest of the charges back if this is successful. Fingers crossed this will be straight forward Brian
