I too have received a demand from Robinson way. Firstly these important looking envelopes I think are already harrassement and impersonating a court order. They are not court orders and you have nothing to worry about. It is highly unlikely they are nothing more than chancing it. I agree that sending a formal cca request is the way forwards recorded delivery so you can track it and with a £1 post office cheque. Can anybody advise me on what to do when the account that Robinson-way are chasing is currently in default with Capquest..?

Okay, leaving the Capquest Abbey account until i can geta scan of the docs. They haven't been in touch for a while so i guess it's in the system somewhere..? Onto another Capquest acc. The account has aleady been placed in default by myself following a failure to provide the cca. I have now received a strong letter from a 'Robinson way' Ltd and am unsure about the best approach. Either i send another CCA Request safe in the knowledge that the cca is lost in action! or should istart screaming about the proccesing of an account that is in dispute.. any thoughts from you lovely people.

where's everybody gone..? reposting the links to the documents capquest have sent in reply to my cca request. They have included a statment of payments to the account and 2 terms daterd '08 and '09. okay, hello everybody, need bit of help now, Capquest have returned with a faxed copy of my original agreement and a signed Directdebit instruction. This puts us all back at square one doesn't it.? they now have a legally binding document ? And I have 14 days to reply. I don't think they'll get too heavy, I can demonstate an inability to pay off my debts.. do i accept this and start making token gesture payments..? Is it correct that the 6 years gets restarted when you make a payment or acknowledge the debt, cos this one was started in 2005.. I have made token gesture payments on the account before , before it was sold.

okay,RI, I hear you and I agree that the system is corrupt from top to bottom; In your case that's really unlawful and if any one has a case m8 it's you. So has anybody here threatened legal proceedings and got defaults removed. A guy from the states suggests a 3 throng approach rangig from polite requests to threatening litegation.. I want to clean up my file but admit it looks, well totally confusing. I do understand however that if a CCA is not produced then it seems unlawful for the DCA to be processing data.. -
mmm, has anyone actually threatened to take them to court? Have received another letter from Lowell stating ''After this time limit has expired' (the 12 days) '...no collection activities will take place until such a time as the requested document is provided.' Is this correct, i can't see that in the Act but it does make sense..? P.S. 2 acc now in default, one returned 'withdrawn by client?' and 1 more due to go into default on mon, thanks everybody, thus far so good. Will get involved in the CRA debate...

hello everybody, new developments ,,, the 2 summits of my mountain are owned by lowell, an old 2005 cap 1 cc, and, capquest an 11grand loan. the first, lowell's is now in default and i received a letter last week stating that they haven't received a cca from cap 1 but that cap1 are looking for it 'retreiving the paperwork,' and once they Lowell receive it they'll post me a copy and want payment in full. So can they do that.? secondly, i have asked capquest for a cca, they go into default today and they're letter states 'we can confirm we are in receipt of the' cca and 'in accordance with the data protection Act 1998' require me to contact them to confirm 'important security information. We will be unable to send' ..'until you have doen this.' Do I call i'm not into telephone calls and will not undersign a debt by giving my date of birth to these guys, but do they have a legal standpoint here? thankyou as always.. w

i'll look into my statements and add up the charges, this will take a while cos theyre in boxes.. Need that credit file... so i can see who has defaulted my file in the past and when. and when they might stop affecting things.. So a debt may just stay around until 6 years old? also if a DCA commits an offence what does it mean..?

Okay, thanks all once m ore for your support, couldn't do this without you. So far no credit file has arrived, Experian no response and equifax 2 seperate requests to confirm my new address... only sent call credit last week so,, that's okay. any advice on an appropriate way to chase my credit file at experian..? have sent a default letter today to Lowell concerning the Cap 1 debt. Am thinking I will chase Cap 1 for charges to be repaid. ( I had some luck with reclaiming abbey charges 3 years ago b4 the test case etc..) If they don't respond is it likely they'll remove entries on my credit file, can i force them ? If the debt is in default, which it now is, hooray! and they cannot sell it on or claim on it,, what happens next..?? thanks all again... the journey continues but am excited now instead of lost..
