  1. thanks GuidoT so i guess they wait to sse if you are going to send them the court bundle etc to see if you are seriously going to go for it and then act accordingly... skinty
  2. can anyone tell me are sc&m likely to contact me before 17th may with offer? or should i assume i will only hear from them once i have sent the court bundle through to them. this has to be with them by the 3rd skinty
  3. help panic has struck the skint ones household... first the mcol have sent me a form notifying transfer of proceedings to my local court as SC&m are going to defend, full notes of their defence are available if necessary, then today i have received from local court notice of allocation to small claims track although claim is for nearly 10K inc interest, the judge has dispensed with AQ's is this normal??? and the hearing to take place on 17th may i have to deliver to the court and SC&m copies of all docs and any experts report... am now unsure of my pos... any help / advice greatfully received... skinty..

  5. just been to mcol and see that sc&m are going to defend... i take it this is usual??? what should i start doing now??? what is the timescale likely to be before things start hotting up??? now all is in motion how long do these things generally take? the claim was regarded as served on the bank on 12th march. any info / advice greatly received skinty
  6. my manager topld me that they are settling all claims b4 court action now got my letter from them 2 days after lba ran out skinty
  7. righty then off we go again, won case vs nat west, case vs lloyds underway now lets get at the barclays lot... worked out they took £2,302.50 so off we go, get the buggers while we can skinty
  8. thanks GuidoT filled out on line and sent today. what is likely to happen next? the claim is for £9,701.40, have LLoyds started taking the nat west tack of settling before going legal? or do they push it all the way? also just starting off the third process against barclays for an account that closed some 3 years back, sent off the data protection letter over the 40 days ago with as much details of the account as possible including account name, branch address and acount managers name, nothing back from them, whats next to do with this one??? skinty
  9. just a note to let you know it is all worth it.... i was speaking to the manager at my local natwest branch the other day and he told me that a special branch is now in place to deal with the refunding of charges before even the court letter goes out. how right he was as i received today my refund of £5235 charges after only the LBA... just a positive for you and really to say good luck and stick with it.... right now off to get started on the barclays claim... skinty
  10. :o Thoroughly amazing:o turn up for the books.... was just today in the process of filling out the N1 today and lo and behold, what comes through the letter box but a offer of full and final settlement of the claim at guess what.... full value. :grin: :grin: :grin:. Whilst in my local branch last week, i spoke to the manager and said what i was doing, guess what... he said he is doing the same vs his old bank.....Lloyds tsb theres a turn up for the books a bank manager going for the banks... whatever next... now i just have to wait for my payment to be debited hoooooorayyyyy just to let you all know the claim was settled for £5235 ands was settled after the letter before action
  11. just realised that the lba and prelim letters i used are the consumer ones and not business, should i re-send business ones before i send the n1? or am i ok to continue and just fill the ni1 out as business.... just wondered as i have had no response whatsoever from nat west. the account i am claiming on was a sole trader account and my name t/a blah, blah, blah opened the letter with just my name closing the letter, any help appreciated as i dont want to pay for the n1 and have it thrown out on a technicality cheers skinty
  12. just checked, all unpaid dd, s/o or returned cheques nowt else
  13. had no response from them so LBA now gone off, will see what happens... do they often not bother to reply ???
  14. right LBA is now sent, and guess what, received a letter from debbie gilbert today, the standard rejection letter blah blah blah.... and this evening the bank phoned me and said they are going to start action against me as the charges they have applied have put me over our overdraft limit... the cheek... should i write to them reference this??? any advice anyone..... also should i now start to fill out the court paperwork? advice from those who know gladly accepted Skinty
  15. Cheers for that would just ad also that the suprising total being claimed is £8160.00 plus interest of £1800 if it gets that far

  18. right folks, here we go properly now, received my statements back today, have done the calc with the spreadsheet and :o nearly fell over the gits have had £5235.00 off of me:x , have modded the prelim letter to suit my needs as i havent had an overdraft with them removed that bit and the letter is now printed with a copy of the spreadsheet attatched see how we go with that.... off in the post recored delivery tomorrow morning to the bishopsgate address (hope its the right one) Skinty...

  21. right here we go, was a trading as (sole trader account) with direct business banking, am horrified to think how much the fianl figure amy be but it is a lot!!! have sent off the data protection act letter requesting info for claim sent with cheque for fees, also doing same thing with lloyds tsb for personal account....
  22. right thats it then off we go! sent off data protection letter for copies of charges, sent recorded delivery, and also done same with my old business account... lets see how long they take
