  1. In my SAR (sent December 1st), I asked Lloyds for statements going back 6 years and they automatically sent out statements dating back to '97, when the a/c was first opened. x
  2. Hi, I've been meaning to write to them about the fees too. I keep seeing people up in arms over BT's £4.50/quarter charge (quite right too!) and wishing that's all it was costing me! Anyway, congratulations. Did you use a template letter, and if so, where might I find it? Also, I was wondering how it works with it having been Telewest previously: do Virgin pay back all the non D/D fees you ever paid, or just those in the few months since they took over? Thanks
  3. Thanks GuidoT. I think I was just a bit unsure of my position as they had paid part of the money on the same day I filed my claim. Their letter was basically (I won't type it all out, as much of it is standard): "...We've already explained that we believe it is fair to charge you for extra services... ...It's easy to keep a running check on how much is in your account... ...Generally we don't agree to adjust any of these charges, but I can tell you that on this occasion we are prepared to repay you £XX. Unfotunately it is not the banks policy to refund interest payments. You may have read that we and the other banks are discussing overdraft charges with the Office of Fair Trading. Meanwhile we do consider each cutomer's position individually, and we are making you this offer because the amount you're asking for is less than the cost we might face in dealing with your complaint if you took it any further. I need to let you know that this does not mean we consider we have any legal obligation to do so. This sum will be credited to your account in the next few days. ...As I've explained, these charges are avoidable... ...You've mentioned the new guidelines from the OFT...don't agree with... ...Credit Card complaints are not dealt with in Andover. A copy of your letter has been forwarded to Brighton Customer Services Recovery and they will be in touch with you shortly. This letter is the bank's final response...Financial Ombudsman Service.." I've responded using rejection letter 3, altered slightly to include balance of full claim including credit card, and pointing out that they responded outside the 14 day time limit. Does that seem OK? (It's not that i wasn't prepared, I just hadn't expected them to do this now, if you see what I mean ) x
  4. First of all, thanks, LivelyLad for your reply. Everything's been hectic here or I'd have replied sooner - sorry to seem rude! Anyway, I was due to file my claim on the 6th, but it looked like they were going to charge my visa for accidentally paying £80 instead of £81. They did. So I held off to include the new charge in my initial claim. So, the story so far is: 1st Dec - S.A.R - (Subject Access Request) 5th Jan - Prelim (They dragged their feet on the S.A.R - (Subject Access Request)) 22nd Jan - LBA 15th Feb - Filed claim at county court (Giving Lloyds an extra 9 days to respond to my LBA) Today (16th), I came home to find a letter from them, posted on the 9th, saying: "...believe it is fair to charge....on this occasion we are prepared to pay you £xxx. Unfortunately it is not the bank's policy to refund interest payments.....This sum will be credited to you account in the next few days..." They go on to say they don't deal with credit cards, so that has been passed on to Brighton. I'm not willing to accept a partial offer, and the interest they won't pay is the interest they took, not the added contractual interest. The thing is, I checked my account and they actually paid the money in yesterday (the same day I filed the claim). So what's my best course of action? It's only a partial refund, and they didn't even send the letter until after the 14 days were up. Obviously it will cost me an extra (non-claimable) £30 to amend my court claim, which I don't see why I should have to do, as they haven't responded in the time-scale. I'm thinking I should write to them explaining that I received the letter today, pointing out that they responded late and that I won't accept a partial offer, and enclose a cheque for the amount. Does this sound right? Does anyone else have experience of this situation? Anyway, sorry for the long-winded post (it seems to be the only kind I do!), but any help would be much appreciated!   5. Morning! I hope everyone's well, not too cold etc... I was just wondering if anyone knows, what's the position on charges applied to your a/c after you've filed your claim with the courts? Can these be added to the amount claimed, or would that entail paying the courts a (non-claimable) £35 to amend the claim? I'd guess others must have been in this position; what did you do about it? Thanks! x
  6. Hi there, Yes, you claim back the interest they took for the charge as well. You include this interest in your preliminary letter. To work out the interest they've taken on each of your charges, use Vampiress' fab spreadsheets: http://www.consumeractiongroup.co.uk/forum/general/6964-spreadsheet-interest.html (I actually did my own spreadsheet as I enjoy doing things like that. Plus, it was fairly simple as I've been permanently overdrawn for 6 years!) Hope this helps x
  7. I'm hoping someone might be able to give me a bit of advice regarding my £1300 RBS overdraft...please! OK: In 2004, I opened up a student account with RBS, complete with £1250 interest-free O/D. However, due to ill-health, had to drop out of uni, which meant no student loan going into the a/c and I ended up living off the O/D. I ran it up to £150-ish over the limit and didn't do anything about it for a few months (silly I know, but wasn't well and just couldn't deal with it...) Anyway, after 2 or 3 months, in March 2005, I agreed to repay £20 a month. By this time, according to the lady I dealt with, my account was closed, so I was literally just paying £20 off the balance each month until it was cleared. No interest. Well, (thought I) that's fair enough. However... I now find out that my a/c isn't closed, they've just cancelled the overdraft facility and are taking (I estimate) around £16.50 a month interest out of my £20 payment. I had no idea because they haven't sent me a statement since February (of course not, I thought, as my a/c was closed!) Obviously I'm writing to them to enquire as to the interest rate, and get a list of payment in and out since I started the payment plan. But it all seems slightly dubious to me. Are they just taking a chance to make money where they can? (Yes, I know, they're a bank!) Basically, have I got any redress against them? I don't have a problem with paying back the money that I borrowed, but charging that much interest on an account they said was closed seems extortionate. I'm sorry for the long (and boring) post, but any help would be greatly appreciated. Many Thanks in advance! x
  8. Hello to everyone, and what a great title for my first ever post! I first found about about all this in mid-November, and as well as claiming for myself (Lloyds TSB), offered to sort out my boyfriend's NatWest claim too. Originally he wasn't sure if it was worth the £10 for his S.A.R - (Subject Access Request), as he's always been pretty good at arguing back his bank charges as they've happened. Anyway, in the end he decided to go for it, so... SAR - 1st Dec - turned out including interest (and 4 months interest on an "interest-free" student overdraft!) the total came to £400.61 Preliminary Letter - 15th Dec Response received - 29th Dec - Partial offer for 3/4 of the amount LBA - 5th Jan - "Thanks but no thanks, I want all of what you've taken..." Response received - 10th Jan - Offer of full amount with NO T&C's, acceptance posted same day Money paid into account - 13th January - Under a month from start to finish!!! It's probably because in terms of most people's claims it's a relatively small amount, but I had expected it to take much longer, start the court process etc. And I certainly thought that after the full offer was accepted it would take a couple of weeks at least for them to pay the money in. Could Natwest finally be getting the message that people won't just give up and go away?! Now I've just got to wait for Lloyds to respond to my preliminary letter (dragging their feet with it all, so only got it sent on 5th Jan). Oh well... Love 'n' Luck to you all, WhatMoney? x
