  1. Hi all I'm using v1.1 for a Natwest CCD claim of about 1k and will be claiming CI. Am I right in that on the left hand side the date shown is the actual statement date, any charges shown on that statement are entered here, and the interest in that statement month also shown on the right hand side. Balance is the actual statement balance and the amount repaid is from the following month's statement. In completing the spready I notice that following one particular month where the whole balance was repaid, the interest paid on penalties becomes a negative figure. I assume that the figure entered for interest paid, Statement Balance and amount repaid next month should be shown as positive figures. Any thoughts. BTW - great advice & support!
  2. We've recently applied directly to Abbey by telephone for a 5 year fixed rate BTL mortgage. Initially we were going to add the £999 fee to the loan but in the end decided to pay it up front along with the valuation fee. We were gazumped on the property and decided not to proceed. At this point we had received only an illustration and no mortgage offer. Four weeks ago Abbey returned our ID papers and said that any refunds due would follow but to date we have yet to receive anything. We are claiming back £999 arrangement fee and £265 valuation fee. The valuation has not been carried out. If the fees had been added to the loan and then it did not go ahead, Abbey would not have our money - as we have paid up front it will be difficult to reclaim it. Any thoughts or experience of this situation and the best way to resolve it. Thanks in advance

  4. Yhanks for the quick response but not too sure what you mean? I have already cut & paste it into a word document to make the changes - didn't know how to show that on the forum so just cut & paste again from my word doc to show what I had put together.
  5. I am working on the basis that if I had taken funds unauthorised from NatWest the interest would be charged at this rate. I liked Mindzai & Lucid's appreach to the MCOL with three options for the court to consider - the unauthorised rate, authoriased rate or the statutory one for the judge to select from sghould it go that far. I also understand that if I do not claim contractural interest then the hjudge would not be able to award this after the event. I think I would rather fight the corner on the basis of reciprocity of contract rather than elect to claim a statutory 8% through MCOL should it go that far. I guess only time will tell whether this will be successful.

  7. I read that to be the interest charged on the charges rather than the interest I would levy on the unauthorised borrowing that Natwest had taken from the account. Thank you for the clarification.
  8. Hi, I'm just starting off a NatWest claim for £1470 of charges on my girlfriend's account and have been reading with interest Mindzai vs Lloyds and taylormandy vs Nationwide, both of which are going for contractural interest. Will be interesting ot see the outcome.
  9. Hi all, After a bit of a false start obtaining statements etc we're on the hunt for misappropriated funds from my girlfriend's account, currently being looked after by NatWest. The charges amount to £1,479, and having read on the forum the argument for contracturat interest versus statutory interest, we have decided the former option to be appropriate, especially with taylormandy's success against Nationwide. I'm drafting the preliminary letter, based on the one in the library, and would be grateful for any suggestions for the wording to claim contractural interest. Many thanks
  10. Have now calculated charges applied to the current account at £1479. Having read the various postings I favour the route of claiming contractural interest at NatWest's own unauthorised rate of 28.69%, which gives an additional £669.90 of my g/f hard earned cash back to her. I am just finishing off the preliminary letter and would be welcome for any suggestions as to how this reclaim of the contractural interest has been worded by others.
  11. Hi all, I'm taking up the cause on behalf of my girlfriend who has accumulated unfair charges of almost £1600. Copy statements received and now a letter to be sent to demand repayment. Here goes...
