  1. Hi I so far behind on state of whats happening with bank charges claim. Basically my information is as follows 24th April 2007 Original claim to HSBC 3rd July 2007 HSBC offer - declined 1st August 2007 - claim with Moneyclaim started 6th August 2007 - Notice of Service of claim 18th Sept 2007 - request to change to my home Court 1st Oct 2007 - notification of change to home court 24th Oct 2007 - Order that action stayed until final decision on OFT case 8th July 2011 - notice of hearing received from home court. HSBC (DG Solicitors claim it should be struck out on no reasoanble grounds for cliams based on Supreme court ruling of OFT case) Please can anyone advise if I am still entitled to claim or the case is now null ?   3. Hi all, Just completing my CMI and will be delivering today hopefully to Leeds for 28th hearing. Quick question - what is the standard time for the claimant in person costs for questions 35 and 36 ?? I have spoken to Court today and they suggested I sent a latest schedule of charges, updated from my original claim way back in January - would you add to the bottom line either the court fee and the claimant in person costs or both ??   5. Hi all, I am there too on 28th June (not sure what number). Just wanted to clarify, as I getting bogged down in talk of bundles and CMI's among the rest : What do I actually need to do now - I have recieved the letter from the court - Do I prepare a CMI and a full Court Bundle based on my case ? Or just a CMI ? Ive come this far - dont want to mess it up now ! Cheers Fair

  7. Thanks Caro, I have not got a date from Mercantile Court - in fact nothing since a note it was transferred almost 3 weeks ago - should i contact them? Also i received notification from Northampton Court before it was transferred that it was dispensing with AQ. I am trying to find out what to do next with my claim, in terms of altering it for claims beyond six years, or leaving it and starting another claim. I have just sent a rejection to both offers from the bank basically saying no thanks and I want the full amount plus any interest to the date it completes etc. Do i need to do anything with regards the court, and is it simple and not too time consuming to change my existing claim if i have the statements ? I have received a confirmation that the hearing is moved to Mercantile Court Leeds a couple of weeks ago, but have not got a date yet.   9. Ok I am just writing the letter to reject. Can i mention that i intend to claim the interest from the date of my claim, or is that understood ? My claim was sent back in January, so there is another 4 months worth of outstanding interest. Thanks Fair
  10. So i will send one letter rejecting both offers I have received, sending the one cheque back. Does that seem ok ? Did you mention accepting it as partial payment or just a straight rejection ? Do you inform YB that you have changed the claim , and do you need to advise the courts too ? How do I do this ? I just want to make sure I do the right thing and not mess it up before I start sending letters out etc. Regards, Fair.

Thanks faz, I have read your thread with interest. 1) Do you have a standard rejection letter for their offer ? 2) How can i work out the interest since the original claim was made and how do i inform YB i intend to claim this interest ? 3) I have charges going back before this six year period (which i think i have the records of) - should I add them to this claim - or start another separate one ? And if I do alter this existing claim how do I let YB know ? Can I do all this in one ltter to YB ? And do i have to let the courts know if i change the claim amount ? It was all so easy but this full and final settlement stuff is getting me confused !!! Cheer Fair.
  12. Thanks PJ, So just clarify I have received a second offer but with no cheque, just 2 identical documents to sign as full and final settlement. Should i write to them to accept this as a partial payment (I have no cheque to cash) or do i write to refuse their offer, or do i just do nothing and wait for courts/another offer ? Also do i need to write to refuse their first offer some time back, and send the cheque back, or is this now superseded by their second offer ? Its just this last bit thats a bit confusing to me - everything else has gone along ok, albeit slowly, so far. Also I have not received anything from Mercantile Court - will they send me this Allocation Questionnaire ? Ta Fair
  13. Hi there all, New to this forum so bear with me. I am quite a way down the line with this process but am looking for a little last minute advice if anyone can please help. The history is : 1) Wrote to YB in December asking for all charges details 2) I eventually send a letter with costs attached for approx £3500 (inc interest) on 7th Feb 07 3) 1st March 07 YB send cheque for approx £1400 (I still have it but never sent a response) 4) 6th March i file with Moneyclaim for the amount stated plus costs 5) 9th March Acknowledgment of service recieved 6) 5th April YB send letter enclosing defence (similar to one from Miss P posted on this site) 7) 10th April I receive Notice of Transfer of Proceedings 8) 13th April I receive letter of Transfer to Mercantile Court 9) 26th April YB letter (recieved 30th April) for Without Prejudice save as to costs. Offer of approx £2900 (inc costs) requesting I sign letter and Notice of Discontinuance. This is just a letter - no cheque attached. This acceptance is for full and final settlement. I believe I want to carry on for the remaining approx 20%, but would like some advice as to my position. Can i write back and accept this offer as a partial payment - i.e not as full and final settlement ????? If so is there a standard letter ?? And if I can, where would I stand with this as I have no cheque for this amount ??? And if i can Is there a time limit on replying to accept ??? Also I have not yet received a revised court date - should i contact the Mercantile court to find out what is happening, or wait to hear from them ? Sorry its a bit long winded - I feel I am nearly there, but just want to make sure !!! Cheers, Fair
