After issuing my Moneyclaim - Barclaycard then took 12 days to acknowledge the claim - the had to wait another 14 days before I could enter Judgement - just been online to do it and low and behold they have filed a Defence at the last minute disputing the total amount and I understand it will now be transferred to a local County Court - aaarrrggh!! Barclaycard are driving me maddd!! Delaying tactics all along. I sincerely hope they pay up before it gets to Court - why do they do this if they have no intention of going to Court - would it not be better just to pay up well before and save costs - can anyone put my mind at rest here please - I also have another claim again MINT which is through Moneyclaim - I hope that I can get to Tuesday to enter Judgement on that before they acknowledge. Here's hoping one goes my way!!

After sending off Prelim letter on Monday 6th, received letter back from Endeavour personal Finance this morning - stating they are concerned to hear of our complaint and have passed our letter to their solicitors for a full invesigation - even state the solicitors name who is dealing with the matter, who will be in touch within 7 days. I think they were quite speedy to pass it to their solicitors to look at - has anyone else experienced this and would anyone like to comment on this.
  3. Have received an offer from first direct for total of charges - but not anything for the contractual interest I am claiming - what next? The interest amounts to a lot - over £500.00 - do I send off my LBA to claim the interest now - they say they don't pay the interest - only charges - help please anyone:) Do you think I will get the interest if I hold out - don't want to shoot myself in the foot here.

A friend is claiming an ERC from Abbey - after sending preliminary letter she has received the following response:- I am unable to comment on the above cases mentioned in your letter as they have no relevance to your mortgage account., Abbey expects you and your financial advisor, and any solicitors acting for you to have read the terms and conditions of your mortgage carefully, because once your mortgage begins you are legally bound by them. Your terms and conditions clearly states that you would be charged if your mortgage account was repaid within 60 months of it being taken out. Because you went ahead with your mortgage we believe you understood the terms and conditions of the mortgage contract. It is our position that you must have been aware of the need to pay us a early redemption charge if you closed your mortgage account before the date we had agreed on. I can’t agree with the comments that Abbey have acted illegally by making this charge as we haven’t broken the contract made between you and the company, In view of above I can’t agree that you are entitled to a refund of the early repayment charge when your account was repaid in March 2005. Please be assured that I have carried out a full investigation for you. Is this the standard reply? What does she do now - any help would be very much appreciated.

Received letter on 25th October - response to my LBA - they were quick to respond this time after taking so long to get the statements out - still sticking to their guns and saying they are not going to refund the charges - they see that the charges only refer to credit card charges - (how stupid when we know they have refunded other people their bank charges !!) Just waiting until the 14 days are up - have already started my MCOL and will press the submit button once the 14 day dealine is up - countring down the days now

  8. Hello, newbie here. I need some advice about claiming ERC on a Secured Loan.. My wife and I had a secured loan on our property for £45,000.00 which was repaid on 14th July 2006. We still have the settlement letter from the company and as we remortgaged we borrowed enough money to repay the secured loan. We were shocked that in order to settle this loan we had to pay certain early charges back. This was made up as follows:- Interest added to the date of settlement 310.72 Future charges 1,941.79 Amount of Rebate nil Legal sealing fee 120.00 So in total we paid £2,462.51 I understand the sealing fee does have to be paid but why the redemption fee was so high I don’t understand. We only had the loan since November 05 and redeemed in July 06. It was with Endeavour Personal Finance and they say: “The settlement date used in calculation of the rebate is 14th July. It has been calculated in accordance with Regulation 3 of the Consumer Credit (Settlement Information) ?? FUTURE CHARGES The amount of interest charged if the loan had run it’s full term without variation. LESS AMOUNT OF REBATE The amount of interest that is cancelled because the account is being settled early. The difference between the future charges and rebate is the proportion of future interest you pay to settle your account early. The rebate has been calculated in accordance with the Consumer Credit (Settlement information) regulations 2004. This also includes your insurance premium rebate (if applicable) Would I be able to reclaim these charges back? Any help would be most appreciated.
