  1. I managed to find an address so have sent the first letter to them, but a quick question if i may.

     

    The total amount these days is £900 give take a pound or two. We are paying it back at around £30 per month which they are happy with (under limit and more than interest and all). We are asking back for around £440. and this would be a nice amount to reduce this debt, they have also issued a Default notice (which i found yesterday, so after letter sent).

     

    Since a large chunk of the debt is due to charges, could we also ask/request/demand that they remove the DN?

  2. Another question whilst i wait for the statements to arrive, i have used the ones i have and worked out that we are owed around £1500 before any kind of interest, what is the best kind of interest to apply?

     

    as i have seen some use CCI and others do the 8%, which one should i apply? bit lost there and also i cant use the speadsheet for the CCI whilst i am at work

  3. Thanks Wendyb, thats what i figured hence the digging out of our marriage certifcate (and drowing my cat in paperwork in the process).

     

    At least i have enough statements to know the current position, and hopefully i can get the whole ball rolling.

  4. Ello all

     

    I have been an avid fan of the site eversince it helped me win against monument a year ago (how does the time fly :)) so i have started against the wifes, and myselfs Cap 1 Debts, just wanted to query a few things as i am still trying to get my head around it all.

     

    I have done the SAR for both of us, but do i also need to obtain the CCAs as well? if so do we send it to the same address as the SAR?

     

    We got married on the 12 August 06 and have not got around to changing the name on my wifes account (due to not using it really), so do we change it now then start the action, or send in a copy of the Marriage Certificate with the letter to show the change of name?

  5. Well after my win over moanament, i figured i would continue with Barclays as i have an idea how they work, Or not as the case may be.

     

    I have worked out my Claim to £424 + £124 int (at 8% as i cant get my head around CI and to be honest just want the charges back). So that has been sent today recorded delivery so hopefully i will have it back by Feb!!!

  6. Well i won, ish

     

    They sent a solicitor to the court (which i was terrified with) who presented a letter stating that we think your mad however offer to pay all i asked for without liability blah blah blah. So i read it and signed it and went to the judge 5 mins later (that close to the trial) and explained that we had resolved our dispute.

     

    He was great and has made an order to adjourn my matter for 28 days (to make sure they pay) and if they dont than i can go back and he will re-instate and instruct baliffs. Thou he did mention that had they not offered that he would have waited for the court case to go through before ruling, the solicitor stated that that was for banks not credit cards. (but just to check is that right can i still go for my other cards?)

  7. I gather you've:

    1) Got a list of your charges AND statements for the past 6 yrs

    2) worked out your schedule of charges

    2) Sent off your preliminary approach for repayment including your schedule

     

     

    1) i have the list of charges that they sent to me, I did not ask for the statements as i thought it would be sufficient to go with just the list

    2) Yep i have that saved in 4 places so far.

    3) yep again i sent them my letter from this forum as well as my statement, i have also worked out the interest to allow me to have something to "trade" if we could work something out.

     

    However due to having to move from Kent to Brum, i might have to deal it to the middle of August, and it looks like i will have to request my bank statements to have incase i go to court?

  8. I am looking now thanks McIvelli (oh i wish i could do a Prince of Lies on them). My only thought is that i intended to reply to there letter (as it took them only 3 days to say no) to answer there reply about service charges themselves.

     

    Or do i leave it to the 14 day deadline and send the next reply saying you have another 14 days to reconsider or i take you to court?

  9. I wrote to lloyds saying give me back my £1600 please, and there reply is going on about how it is service charges (nice service!) where can i find the next reply that says pull the other one it has bells on?

  10. A few questions for you guys here.

     

    I have got the responce from Natwest about the credt card and i am owed £210 or so from them about charges. They also (i think) defaulted me in 2003.

     

    1) Is it wise to ask for the money back or apply it against the account, as i have a balance on there and couldnt care less if they said that they would only credit the account as that lowers the debt?

    2) in the letter i could send i can ask/demand that they remove the default, it states that it was due to your charging that you applied this. Can i still say this if i am not certain?

Well we had a nice letter explaining that they were concerned that my wife found the charges unlawful (not her you fools the OFT) and various other matters, but they have offered £272 to bring all of the charges in the new amount they have to charge according to the OFT (theres me thinking it was the maximum they could charge).

     

    I have sent off another letter saying i would accept as partial payment, reminding them it is the OFT that decided this not my wife on a whim (no comment from me there). i expect they will say push off

     

    And once we move at the end of July i will take them to court where we live.

     

    Any other advice?

  13. Hi guys

     

    I followed your advice and got the information from Monument reagrding my account (they did not charge me the £10s and send me a table with the charges except for 2007 (which i had statements for)). And i worked it out to be £400. + £50 court fee.

     

    So they had until the 8th May to submit a defence and they did so on the 11th and now it seems i may have to go to court (the court has yet to send me the next bit of paperwork).

     

    any help on what happens next?

  14. Hi Guys looking for some help

     

    I have started the process with the wifes Cap 1 card (they owe £840) and they were give 14 days to pay up or get into contact and they didnt (there letter of the 30 April (the deadline) got here by the 5th May) asking for at least 4 weeks and maybe more).

     

    after talking to my old man it would seem best to allow them the 4 weeks till the 28th may and then go to court if they fail to respond.

     

    how does that seem to you and has anyone else experienced this?
