  4. I am about to submit my claim against Barclaycard to my local county court but I do not know what the charges were prior to 2006 as shown in the claim template. ...... (d) In addition the Defendant was entitled to charge default fees (“the Charges”) where the Claimant exceeded the Limit, did not pay on the due date or had a payment returned. The Charges are currently £12 for each transgression. Prior to 2006 the Charges were £xx. I know that Barclaycard have charged me £15 for late payment and £15 for overdraft limit together (£30 in month) all the time in question. Thanks

Thanks Sea-Sidelady I have replied to stating that if they do not accept my conditions for acceptance, or they do not respond within 10 days, the money transfered to my account should not be viewed as my acceptance and I hereby authorise them to remove this sum accordingly. This should make the claim lot simpler Thanks a lot
  6. I have been refunded by Barclays card approximately £82 out of total charges of £527.68 which comprises of £380 in charges and £147.68 in interest charges. Now if I were to issue county court claim how do I workout how much to claim. Shall I simply enter the total amount of charges (£527.68) less the refund (£82) and enter the original interest amount of £147.68? Or do I workout the percentage of charges relative to the total amount as well as total interest and produce a ratio to reduce both charges by. So for example this will reduce the total amount to £305.51 and total interest to £138.17 Please help if you have any experiencing with these nightmare calculations.

I don't think it will take 4-6 months but its likely that you will be contacted round about mid March 14-15 by Abbey solicitor in Milton Keynes to state all further contacts should be addressed to them. From there on I estimate that it may take them another 15-20 days to think about their appalling behaviour before coming back to say they will settle your claim. Of course I am speaking from my experience as your claim is much higher than mine so anticipate that it could take bit longer.

Many thanks for the quick advise Louis I will now resort to fix this credit report through Banking Code Standards Board though I think the Financial Ombudsman Service works for the interest of banks rather customers. They were dealing with my case for months before I found this wonderful site and defeated Abbey. Regards
  9. Hi Though I have defeated Abbey on my last quest to reclaim moneis that was been claimed against me. I have just realised that my CREDIT REPORT (through Credit Reports: Get your Credit Report from Experian UK) and also my CREDIT SCORE (through givemecredit - The fast and effective route to your next credit card.) that Abbey have scored series of mispayment from certain period and stated that I have 6 late payment before then stating that I have settled the debt. 1-Do I have the right to appeal? and if they refuse 2-Can I take legal proceedings against them since they have already reimbursted me for payment charges before court? Please kindly help.
  10. I have bought car for Hp from a garage, when I bought the car I had another car which was also Hp—the remaining balance on my car was £3.500 and the one I was about to purchase was £6.898. I have agreed with them by placing deposit of £2000.00, so I would be paying £4.898 and remaining on my current balance for my car will paid to Black Horse finance. I have paid the £2.000 to deposit to the garage and I was asked to come back next day to get the car ready, over the phone I was told that, they don’t deal with black horse finance any more, so is it okay if we recommend you Britannia finance as they are less APR and I said yes —I have been approved by Britannia Finance. When I collected the car, was ask to come back next week as the car navigator chip was missing for replacement, by the way the vehicle is Lexus IS200. Two weeks letter I have received agreement letter from Britannia finance showing that I own £8.898. APR 25.8%. I went back to the garage asking them to refund my deposit—They agreed and was asked to come back the following day and I left the car in the garage.. Following morning I have received a phone call from the garage asking me to collect the car as they will help me to sell it for me, but still I have to make payment to Britannia finance every month –If the Vehicle get a buyer and they will pay less then Britannia is demanding, I have to make up the difference. I was not happy and had no choice, but to try to sell the car private –I couldn’t cause the car mileage was 98.000 and no one would ever buy for that price or near. I made complaint over the phone to Britannia finance the company didn’t want to understand my situation, they where demanding for payment of £253.00 a month as was my previous payment with black horse was £156.00 a month. During the time my car was in garage, my driving mirror was damaged as well as the navigator chip was missing from the day of purchase —I was told to come back next week, when I come back the following week they have moved from their address— I’m now registered as default and refused to make the payment. Can some help me plz – I have been struggling for long time.

  12. Hi I hope i'm not in wrong forum-- I'm new to the sytem. I have sent letter for access to my data protection to Barclaycard on 29.07.06. On 09.08.06 i have received a reply letter from them saying the following : Statements that are prior to this date are not held on a computer sytem or a structred relevent filing sytem as they are stored on michrofiche in date order and therefore, they don't fall under the data protection Act 1998. They can be obtain from customer service department by-------- at cost of £3 per statement . The statement they send me doesn't show me all trasnactions i made-it only shows banks charges. Can some one help me please.

  14. Thanks everyone But no I have not got any accesd at all, mine is £0. Furthermore I have no other car so they are telling me to keep the policy for the rest of year, regardless of my situation (carless or not). What can I do to get my unused premium?
