  1. Hi chaps - just to say Abbey settled with me in full even before my bundle was due in - it may be worth sending a (Without Prejudice) email to Inga at abbey asking them to settle in full + costs to save everyone hassle. STICK WITH IT - You'll get there soon:rolleyes:
  2. Well done Mad Nick - and thank you in particular for all the help you gave me amongst counteless others on the site. I've just got my cheque from the Shabbey brigade too. Its good to get your charges back isn't it!! ALL THE BEST AND DONATION TO FOLLOW WHEN THE CHEQUE CLEARS!!!!!
  3. As far as I was aware the Statement of Evidence and Witness Statement are different names for the same thing - I hope I'm right on this Karish. As for the linked docs - go on the links and porint them off and incorporate (scan if PDF?) them into your bundle. Abbey have just settled with me 2 weeks prior to the bundle being needed so hopefully you may get the same - however don't leave it to chance. It may be worth sending James / Inga a Without Prejudice email telling them you will only accept a full and final 100% offer + costs and that if not you look forward to seeing them at Court - it worked in my case - but you have to weigh this up yourself. All the best - you'll get there.
  4. Thanks folks - Couldn't of done it ithout you guys! B.T.W. - I phoned the Court to withdraw my claim and confirm everything and their advice to me was "Don't do anything until the cheque has cleared!" I thought "Hmmm probably best not to!" so Abbey will have to wait till the end of the week for their confirmation. Well fair enough I've been waiting ages for MY MONEY BACK!! Donation to this wonderful site on Thursday all being well. ONCE AGAIN THANK YOU ALL AND ALL THE BEST FOR RECLAIMING WHAT IS RIGHTFULLY YOURS!!!!!!
  5. HURRAH - I got home yesterday and there was a letter from Abbey saying they were gonna pay up in full - all charges (£2000)+ 8% interest + court costs of £220. My court bundle was not due in for 2 weeks!!!!!!!!! This has been a process of 7 months effort - but IT PAYS OFF!! STICK WITH IT FOLKS - IT DOES WORK!!!!!!! I've banked the cheque this morning! I CAN'T BELIEVE IT! Thanks to everyone on here, particularly MAD NICK, PHILREAD, LUIS and everyone else who's contributed. DONATION TO C.A.G. TO FOLLOW NEXT WEEK WHEN FUNDS CLEAR!!!!!!!!!
  6. Thanks folks. I'll prob include them anyway just to be sure! We don't want any slip ups do we ABBEY?!
  7. I'm preparing my court bundle and am nearly there I think! BUT 1. Where abouts in my CB shall I mention Cases that Abbey have already settled? 2. How should I include this? As part of my witness statement etc? Thanks again folks, donation to follow SOON all being well! Cheers Shabbey!
  8. Has anyone got a link to the relevant (settled?) case numbers for Abbey and where should i include these ie - should I mention it in the Court Bundle and where abouts. THANKS EVERYONE, NEARLY THERE NOW!
  9. Thank you again chaps - doubtless i'll have some more questions as the day nears. DONATION TO FOLLOW SOON WITH VICTORY!
  10. Hi, Just to clarify a brief point as I'm preparing my Court Bundle. I have a Statement of Evidence included. What exactly is the Case Summary - is this a separate overview of my claim or is it another term fort the same document? Sorry if this is datft but I'm very nearly there with everything and want to have my bundle 100% spot on. NO SLIPS THEN EH MR.ABBEY!!!
  11. Thanks again for all this info folks! I can almost smell the colour of MY money! I'm going to get my bundle prepared in full and then send a Without Prejudice letter for a full settlement! GOOD LUCK EVERYONE, DONATION TO FOLLOW
  12. Alright dawg - timescale for the hearing was an hour - but I think the Judge basically just cpoied this from my Draft Order. Any suggestions for the above? Ie how to go about a Without Prejudice suggested offer letter to Shabbey. MANY THANKS AND GOOD LUCK TOO
  13. Just another quick question. Abbey do not have my contact details ie email e/ mobil number. I was advised giving these out before. IS NOW A GOOD TIME TO PASS THESE ON TO ABBEY? Perhaps in a without prejudice letter asking them to make me an offer? Plus any more tips about getting Abbey to make me a decent offer - ie with up to date costs , expenses etc. ANY ADVICE ON THIS PLEASE!!!!!
  14. Nice on Phil - sounds good. Yeah I'm winning on the Court Bundle just about I think - it's coming along. I didn't realise I could charge for preparation time too. Excellent - I should imagine mine will work out at about 40 hours preparation too - is there any 'standard' for this? How do you come up with the £9.25 figure - is that a 'Shabbey' figure? Heh heh! MANY THANKS, JUST NEED TO KEEP GOING. DONATION TO CAG ON VICTORY DAY.
  15. My claim against Abbey is for £2400 plus interest plus costs. My AQ was submitted 2 weeks ago yet Abbey still hadn't filed by Good Friday which was their deadline. I phoned the Court this Monday (16th April) who told me Abbey STILL had not filed their AQ and the Judge would make his decision and write to me. The Judge seems to have ignored the fact they have not submitted their AQ but followed the Draft Directions I sent him. "District judge BlahBlah has allocated the claim to the small claims track" each party shall deliver to all parties all documents he intends to rely on at the hearing , no later than 14 days before the hearing , hearing is scheduled for May 29th. This means I have until the 15th of May to lodge my Court Bundle with the Court and with Abbey. IS THIS CORRECT? WHAT HAS HAPPENED RE ABBEY's AQ? SHOULD I JUST CARRY ON AND SUBMIT MY BUNDLE AT THE LATEST DATE AS I PLAN TO?
