  5. Hi I'm currently claiming £435 back from barclays and I've completed the allocation questionnaire. I've had a reply back from the court and I need to file and serve the full particulars of each and every unlawful charge from barclays. I'm not sure what to do next, is there any kind of template I can use? Any advice would be grateful. Rich

Hi, I'm trying to claim back 445 from barclays and the additional £50 that I paid for the claim to start court proceedings, they first offered me £200 which I rejected because I wanted the full amount. I have now recieved a letter from the courts saying that they have stated there defence and I now need to fill in an allocation questionnaire and return this to the courts. There defence states that I havent particularised all the charges and still say that they are within their rights. I'm nervous about what to do next, should I try and contact barclays to settle it out of court or continue with the claim? Should i get a solicitor to help me in court? Any advice would be very helpful. Thanks Rich
  11. Hi, I'm in the middle of a claim with Barclays and would like some advice. I am claiming £445, they offered me £200 bout 3 weeks ago which I accepted but said I want the rest as well. Yesterday, (which was only about 4 days after I sent them the lba - very quick reply), they sent me a letter saying they are unwilling to adhere to my request and said that it is with regret that I will now be proceeding to the county court for the full amount. Therefore can someone advise me on what I should do next. Do I file the claim straight away or wait till the 14days is up? How do I take it to court? Any help is appreciated, Thanks, Rich Gilham
  12. Hi all, Barclays bank replied to my preliminary letter by offering me £200 of £435 that they owed. They now owe me £445 because of a referral fee, so I have typed out the letter below. Please give me some advice on whether the letter is suitable and what needs changing as the template for the LBA looks similar to the preliminary approach letter! ''Dear Sir/Madam I would like to accept the £200 you have offered me in respect to unlawful charges you have levied from my account, however I would now like to formally request the rest of the charges to be refunded in full. This is because the regime of fees which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. I would again draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I will also say again that I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I calculate that you have now taken £445.00 from my account. Therefore, following a £200 payment into my account I also require a £245 payment, either separate to the £200 or in one full payment. Additionally you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you or was the result of impecuniosity caused directly by the taking by you of penalty charges which you had applied unlawfully to my account. In addition to full payment of the sum mentioned above I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable. I require repayment in full of this money and removal of the default notice. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus a claim under ss.7 and 13 of the Data Protection Act 1998 plus my costs and without further notice. Furthermore, I shall submit a Consumer Credit Act 1974 complaint to the OFT upon the basis that you have failed to comply with the OFT's direction of 5 April 2006 and are therefore not a 'fit and proper person' to hold a consumer credit licence under the 1974 Act. If you do not understand what this means then seek advice from your legal department. Yours Sincerely...'' Any help would be greatly appreciated as I can then use this letter as a template for friends in the same position. Thanks Rich
  13. Hi all, Just a request for a little help with my claim against Barclays. I sent my preliminary letter on the 3.04.06 and they replied almost straight away saying they would get back to me no later than the 7 May. I have no given them the 14 days that I stated in my letter so what is the next step? Do I send another letter? If so is there a template? Or do I just go straight to the Moneyclaim website and take it from there? Any help would be grateful as I'm new to this and not sure what to do! Cheers Rich
  14. Thanks, So let me get this straight, the 8% interest does not start from when the charge was incurred?? Just from when the claim was started (I.e letter sent)?? Cheers Rich
  15. Hi, I'm also trying to claim against Barclaycard, can I ask what address you sent your letter to? Also they have told me I will have to pay £5 for each statement I request and I need about 30 statements to identify all the charges? (I didn't tell them why I wanted the statements). Is this charge legitimate? How did you get your statements? Cheers Rich
