  2. Hi There, you havent messed up anything yet. The final documents that you submit to the court are the ones that cant be changed and you are nowhere near that yet. What interest are you talking about? Do you mean the 8%?
  3. Well I did call the court and they said that a defence hadnt been filed which is why I asked the court to make a judgement. However...... came home today to a letter from NW saying that they had paid all monies in full into my account, thats the charges, court fee and 8% interest. Yippee Ive won, ive wonm Moderator - please move my thread to a success story and also advise where i donate to. Thanks to everyone who helped me, I couldnt have done it without this site.
  4. Hi Claire, apparently I would have been better off waiting and giving NW another 7 days to file a defence - unfortunately that advice was too late for me but worth keeping in mind for yourself. It would seem to be another delay tactic the banks are using because even if a judge has ruled in my favour, they can then apply for the judgement to be set aside- giving them a period of time to file a defence - delaying my claim even longer. Will let you know how it goes.
  5. OK I have read through the thread and I am not going to panic... yet! I will wait and see if what the judgement is and if the Nationwide request for it to be set aside to give them more time to defend. The worst that can happen at this stage is that Ive given them more time to hold onto my money - well hopefully anyway!!!
  6. Oh no, I had already sent this off before I read the above thread! I will have to see what happens now as its out of my control at this point! How cunning are the banks using this as a way to drag your claim out!

Hey Caroline I read your story with interest, I too had a similar "incident" with NW whereby I was made redundant, I was overdrawn on my flex account and they wanted me to pay the overdraft up in full, because I couldnt, they froze my whole months salary and threatened to put a charge on my house. I went to the CAB, they put the phone down on them twice - so I too have taken great pleasure in getting my own back on them. I am further along than yourself, I submitted my N1 form to court with a copy of my charges (over £1000 worth) and they failed to lodge a defence as of yesterday, so today I have posted my request for a court judgement. Fingers crossed that this goes in my favour! I didnt have the same issue as you trying to obtain the list of charges, sounds to me like just another delay tactic they are using to try and put people off - do not be deterred! Everyone on this website are fantastic, i couldnt have got this far without them. I will watch your case with interest. GOOD LUCK
  8. I had to wait for a final charge to be applied to my account on June 1st before I could submit this to the court. Is anyone in the "know" willing to look at my spreadsheet to check that I have done it correctly as this isnt straightforward due to the TSB paying £750 so I have had to do a "charge split" and I am little unsure that its right. I have completed the N1 and am ready to go on this.
  9. Today is the 5th of June, I called the Court and Nationwide have not defended my claim, therefore I have asked for a judgement to be made. Fingers crossed that it will go in my favour - anyone else at this stage, contact me and let me know how its going/went please. A donation heading its way over the CAG if I win as I couldnt have got this far without this site.
  10. I have now received notification from the court that the Nationwide have until 4th of June to defend my claim. Does anyone know what their current "standard practice" is once they received these claims?
  11. Have submitted my N1 to court via the post, they have banked my cheque but I havent received anything from them. What happens now?

  13. Hey there, I am at the same point as you except I have filed my N1 at court, they have banked my cheque for the court costs and now I am just playing the waiting game. Good luck with your claim.
  14. Thats exactly the same standard letters that I received from them. Press ahead with your claim, but make sure you follow the time guidelines and dont do anything before the deadlines or you will risk losing your claim.
  15. Am about to submit my N1 to the court, can i just check two things 1. Should i send my court bundle along with the N1 and my spreadsheet at this stage? 2. Who do i send a copy of all the papers to at the Lloyds TSB head office?

  17. Help with a quick question please...... Right the 14 days are up so I am going to send my N1 form to the courts. Can anyone please tell me what address I give for the Nationwide please?
  18. Yes its clearer now that you have clarified there are 2 parts to the interest awarded. So am i correct adding the paragraph in as follows, sorry but its not that clear to me exactly what figures i need to insert : "Plus interest pursuant to s.69 county courts act 1984 from date of issue to date of judgement/settlement at £0.09p per day (enter daily rate here - charges + od interest) x 0.00022 = pence per day) or at such rate and for such periods as the court deems just"
  19. Am lost now. As detailed in thread 71 under "value" on the N1 I put the 8% calculation total from the spreadsheet as the interest under S69. It sounds like I need to put that paragraph in if i want to claim the 9p per day as mentioned in thread 73 but what do i need to insert in that paragrah (ie the actual figures)
  20. My typing error, it says £407.27 on the N1. So is that paragraph a different interest claim from the 8% thats on the spreadsheet then?
  21. HELP WITH FINAL QUESTION BEFORE I SUBMIT N1 TO COURT PLEASE Further to my earlier thread, I have decided to submit both spreadsheets as attachments to the N1. One final point i need to clarify though, under the value section of the N1 I have listed the following: +£1047.50 Charges -£750 paid into my account by Lloyds TSB =£297.50 Due +£59.77 Interest under s.69 county courts act 1984 (THIS IS THE 8%) +£50.00 court fee £407.50 TOTAL CLAIMED However, on the helpsheet for the N1 form it says "Plus interest pursuant to s.69 county courts act 1984 from date of issue to date of judgement/settlement at £xxxx per day (enter daily rate here - charges + od interest) x 0.00022 = pence per day) or at such rate and for such periods as the court deems just" I have left this paragraph out completely on my N1 form as i didnt understand it. Will i be putting my claim in doubt if I dont include this?
  22. I am at the stage where I sent the LBA to Nationwide and they have replied saying that their charges are legal and they would not refund me. So, now they have replied, can I now issue court proceedings?:idea:
  23. Have finally got my head around this (I think). FYI I did use the simple spreadsheet that was attached in the above thread. So how should i submitt this to the court? I am thinking of sending two spreadsheets, one showing the original charges with the 8% and the second showing those charges but with the £750 that has already been paid to me in a different colour. There is a partial charge to make this amount correct - how should i show that? Is this definitely ok to send to the court this way? I dont want to get this far for the paperwork to be wrong.
  24. As the TSB have paid £750 into my account, I am submitting my court N1, attaching the spreadsheet which shows the full amount owed (including the 8%) with £750 deducted from the total. Because I cannot get it to tally up, I am not breaking down the actual charges from the 8% on the N1 form -if this is incorrect, can anyone shout now please before i submit it to the court. If it is wrong, i dont see how i can do this.
  25. I didnt realise i could add that amount! I am now stuck on the 8% amount my calculations are as follows: + £1047.50 Actual charges + £83.26 8% - £750 Paid by TSB £380.76 Owed to me But how do i work out what portion of the balance owed to me is charges and what portion is the 8%? Sorry was never very good at maths!!!
