I recieved a letter today to say moorcroft want £40 a week to repay £680 left of my overdraft. however i explained i have a stay with abbey in the small claims court and read out the following letter from portsmouth court dated august 2007. 1. The claim be allocated to the small claims track 2. The claim be stayed until 2008 top await outcome of the OFT test case in the High Court. If no application to extend or lift the stay is filled by 4pm on 21st april the claim will be deemed settled and struck out automatically 3. Liberty to appply 4. This order has been made without a hearing under rule 3.3 and any party affected by it may apply within 14 days of service order so moorcroft are happy at the moment. however when i requested the stay to be lifted i was declined. What do I do now before april
  4. Hello there I am started to worry now as I recieved a letter from moorcroft debt recovery saying they want £620 from me to pay Abbey National back. I explained Abbey national have paid myself back nearly £1100 as a gesture of good will and I am now waiting for the bank charge court case against the 6 banks to then continue my small claim as the court have stayed my claim until the results come through as Abbey requested. I refused to pay the £40 requested by moorcroft and they now say thje will add their charges to the abbey claim which will be aprixamately £250. Please can anyone help what do I do now?

  8. Defenately 100% of your claim, Im going through this myself had an offer of £1070 however the total balance is £2722.70 I have been reading others story here In the cosumer action group and all I read have won full amount so far
  9. Hi I went to Money claims on line only on Friday and filled in the form already the Courts have sent this to abbey. Yippee. So Abbey have already Received Notice of Issue from court they have until 19th of May to reply. GoodLuck Everyone

I have sent abbey the last letter before action to which Abbey have writing to me to say their research is taking longer than expected as they want to make sure a full investigation is done beforehand then they will write to me again in 4 weeks time to let me know how they are getting on. What do I do now??? Also at the same time I have recieved a letter from Dept Managent Recovery Service requesting payment in full of my overdraft £1871.32 and to say a default on my account has been applied? HELP?
