  1. Right I have written out a statement from me outlining everything that has passed between me and the mortgage company, got the form filled in Im off to try to get it submitted, I might have left it too long and have to go tomorrow morning...
  2. Hi Lea Ive been on the phone to the court and what a loverly woman I talked to. What I have been told to do is... try to fax over the stuff to the mortgage company if I wish, but she said at this late time I need to get the N244 in, but she said to take my time with it, dont complicate things and dont fill in anything Im unsure about. They can help me in the morning if there is anything that needs to be done. because I have the letter of authority from my Mum, I can fill out a Lay representitive form to go before the judge so that I can look after her interests, and he will make a desission whether to let me go ahead or to just suspend the eviction. She also said that take the letter of authority, the letter from her consultant, and any other bits I think would help the desission and the judge can over rule the eviction and put an order in place... I dont quite understand this bit mind you. I know that her benefits have been started up again and there should be a payment of back dated money on the way to the mortage company, I can pay the whole mortgage, for the next couple of months at least and let the other pay off the arrears. Its going to stretch me financially but if it means that I may be able to sort stuff out then Im happy to do it. I would really like my mum to come home and then for us to reassess whats going on and either try to sort out staying here or moving, but at the moment Im really stuck. Right, the mortgage company make me want to hit my head up against a brick wall, they have been no help what so ever, and even now they are trying to put blocks in the way. Im really upset about all of this. one thing aside, the consultant wrote to my mums GP, and Ive picked up sick notes from them this morning to put in to the DWP for her benefits this morning, I got a copy of those would it be worth copying them as well to take with me tomorrow?

Ive just got off the phone, this is getting hillarious., they will not accept anytihing by email, I have to fax the information to them they want a FULL medical disclosure which I didnt think they could ask for, and all I have is a letter from the consultant saying that my mum is in hospital at the moment, and she is her consultant... which I was told should be enough god what a nightmare...

Hi Everyone thats been helping just a fast update before i phone capstone I have just got a letter of authority, its caused more problems than its been worth, but never mind, I will try to phone capstone now, then the court then see where I stand I have been told that I have to fax the letter through to them , however that means going out to the post office Im going to see if they will accept a scan and it emailed. Im in the middle of scanning it now. God everywhere has taken longer this morning... however another good note is that the benefits have been restarted and the amount owing for mortgage payments should be sent today... I need to phone to get figures so I know what to tell them. what a complete nightmare, and mum had a bit of an episode last night so it goes from bad to worse. I might not need a house soon if she keeps going the way she is... right I will update in ten mins now

Nightmare, If my mum was an organised person who filed everything then finding figures shouldnt be a problem. however, her problem is that shes not, she also has a fear of letters and if I dont get to the post before her and watch her open it she either files it (there are bags and boxes of unopened letters Ive found over the last two weeks, there must be thousands of them and from what I can gather dating back twenty years) she also distroys them as well if she doesnt like the look of them.. Ive been trying to sort it out but its been a long process, just trying to get them all into one place... ive found uncashed postal orders dating back ten years and all kinds of stuff... so for proper figures Im going to need them from the mortgage comany I have talked to her consultant about the letters in the past, because shes missed a couple of appointments, no idea where those letters went, and she now marks anything from her with a mark on the back of the envelope so my mum opens them. Im so pleased that you agree with the consultant, i thought the mortgage company was being intrusive demanding a full medical disclosure. right I feel more postitve now, Im going to try to see what I can sort out for the morning thanks for all your help..

Ell-enn this has been the problem, I havent been able to get a letter from her, however, Ive talked to her consultant again, printed one out and im going to try to get it signed tomorrow.. all I have said on it is when she is in hospitial I have her authority to act on her behalf in financial and other matters I will ring asap, I have an appointment for me first thing in the morning, but I will try to do it before I go to the doctors and i can log onto here from my phone... not ideal but I dont know how long I will be in the docs waiting room.. My mums consultant asked me not to try to get her signature, it sets her off... and i really dont want to upset her any more but not having a house to come out to is not going to be easy either.. this is whats been causing all of the problems. i do have a letter from the doctor, stating shes in hospital, and that she is a patient of her consultant. I am waiting for all the copies of letters to the doctor to arrive from her as well, so that you can see its an ongoing situation ..

Quixotic I am using my Mams account, Ive only just found this site, and shes used it in the past, replied to you because the ASOS interview and its results have been a part of our life...but what I would say is that over today everyone has been sooo nice, Ive had loads of help that I would never have believed... i hope it goes well for you on Friday, i wish you luck
  9. Hi Quixotic We are living in a complete nightmare at the moment, but its going to get better one way or the other. Your doctor was right, my Mum was on Anti Dep''s straight away, and the Doctor put her onto the waiting list. basically though she had a psych evaluation and then referred, then got put on medication that was right for her condition .. her doctor told her that he couldnt prescribe certain drugs and only a consultant could. Medication is also not enough, my mums on another waiiting list to see a councillor well she was until she ended up in hospital. but her consultant says that it will take up to 6 months to be seen but she needs it on top of the medication. I understand what you are going through, but just be yourself in the interview, and be as honest as you can be. it will work out in the end. but I would go back to your gp for a print out of your meds if you can get one before friday.. if not do you still have the other sides of the prescriptions you have been given,. because that should have it written on.
  10. Go back and ask to be refered it took my mum 18 months on the waiting list before she got to see her phychatratrist and not a day too early

Hi Lea Ok, I have a letter from the hospital to me to give to the mortgage company, they asked for it, and wanted a full breakdown of what was wrong with her etc, however, the consultant told me that shes has the same data protection act and Medical confidetiallity as everyone else to adhere to. however, she did write me a letter stating that although she couldnt discuss my mothers case in a letter to the mortgage company she could confirm that she was her consultant and my mum was in hospital. The mortgage company now says that its no good and they still cant do anythiing. Ive asked that if they could look at the case without discussing it with me and pospone the eviction until I could get legal help. and I would pay the mortgage. I am working though the form, Ive printed it off and Im trying to put stuff in but its getting bogged down... I will keep going though with it. I also have the reciepts for the payments I made, I made them directly into the mortgage companies bank so they can see I have made them and no my mum. I know for a fact that all of the arrears are not arrears but costs and insurance payments which I suppose are arrears, but I also know that they charged my mum for buildings insurance without her knowledge, and the second time they did this was after the new insurance company wrote to them to tell them that she was insured with them.. and Im sure that these have been added as well. Ok Im going to sit with a bit of paper and pen.. thank you sooooooo much for your help you have no idea just how good its been to talk to somebody thats given me advice rather than ... sorry nothing we can do to help

  14. just a quick ps.. My Mum takes the anti depressants when her consultant thinks she should go back onto them, but there are times that she is off them... and at the time of the interview she was on a period of time when she wasnt taking them.. so she didnt tell the doctor about them.. which was a mistake because three weeks later she was back on them.. and there is no record of her being on them at the time of the interview... so even if you take stuff once in a while tell the doctor that you take them as part of your treatment so its recorded..
  15. Hi My Mum had a nightmare of a time with the ATOS interview, and the doctor didnt listen and its now going to tribunal. Can I just give you a couple of pointers. Take somebody with you, I hadnt realised that I could go in to the interview with my Mum, so I took her there went for a coffee and met her back outside. Which was mistake number 1. she didnt get a pink booklet, or any information, what she did get was a letter telling her that she had missed her appointment and could she phone them, so she got told the time and place and date over the phone, the confirmation letter arrived a week after the interview. Anyway, you are going to need to be brave. My Mum is Bipolar, she goes to her concultant each month and is on medication. What you need to take with you is... any letters from your doctor or consultant, showing diagnosis, or treatment or appointments. all of your medication, it doesnt matter what you take and when you take it and on which days, you need to take all of it, and if its on repeat prescription take one of those as well. Make sure you have the inserts that come in the box as well for side effects. different meds have different side effects.. make sure you can tell the doctor the side effects you suffer from if you are scared before you go in and clam up write it down so you remember.. the recording device tip is a fantastic idea, wish I had thought of that so my mum could take one in with her. As its now her word against the doctors. get the person that goes with you to make notes while you are there to the questions as well so that you have a better idea to what has happened you also may need them when your filling in your appeal forms. make sure if you suffer from panic attacks or anxeity attacks, you are able to describe exactly what happens to you. your going to be asked if you have been hospitailsed when you have an attack and if you have more than one a day... your also going to be asked silly things like can you make a coffee, can you dress yourself, can you make a meal, can you use a computer, can you read, do you read how often do you read, do you need prompting to do things, can you pop to your corner shop, can you get to a supermarket, who goes with you or can you do it alone... You really need to tell the worst case senario. I have the doctors transcript from my Mums interview and it bears no resemblence to what i know she would have said... she is on Depokate, and her side effects are blurred vision (not all of the time and it the one thing that really gets to her because she cant drive at those times) insomnia, shes listless, tired, and at times when its mixed with anti depressants pain killers, and everything else she takes she can be zombiefied. she has also had a pretty big weight gain, and what did the doctor put as side effects... weight gain... nothing else. keep asking questions, and make sure always give worst case senario, and dont say you have good days and bad days because they will put this down wrong as well.. I hope that this helps and you get a sympathetic doctor, I know that there are some out there and its sorted easily Hol
  16. One question that has just popped to mind. Can I go and represent my Mum with a letter of authority and her signing the N244 form, because shes not going to be let out. Also until I get the figures, Im convinced that they are trying for all of the charges as well in with the arrears. I may be able to get most of the arrears together if there were no charges on top... How do I get a breakdown of them.. and is it too late
  17. Hi Lea I was looking at the N244 I have it up on screen now. and I have started to fill it in. I will try to sort it out best I can. Im no good at writing stuff thats my only problem. Im not that bright and I get muddled really easily. Im falling apart because on top of this my Mum is trying her best to kill herself, and Im scared every time the phone rings or anything. Im using my mums account because I automatically logged me in and well I thought it kepps it all together. Im feeling sick. We are going to loose that house, I know that, BUT like Ive said before, I just need time, I cant, work, visit the hospital find somewhere else to live and try keep everything going. I will give the form a go and print it off ready, I need all my ducks in a row for tomorrow morning so that I can at least get armed to sort it all out.
  18. Hi Lea Ive asked that question and been told that they cant help. Ok I will re read it and see what I can do, its a nightmare, and I contacted the mortgage company to inform them eight weeks ago that I had a problem. I got told that it would be ok and nothing would happen. I know there is an arrangement in place, but I dont know how much for, I dont have access to her bank eiither, I have put money in there to cover stuff such as the mortgage but dont know if its gone out or not. thanks again
  19. Hi Lea I have been back and forwards for the last three weeks, and Im going to end up in the bed next to her. Because I cant get a letter of authorisation I cant talk to anybody. I cant talk to the mortgage company, I cant talk to the CAB I cant talk to a solicitor in her place non of it. The mortgage company gave me three phone numnbers to call to get help, phoned them and guess what. The consultant is doing what she can but it takes time. I dont know if its too late to file an N233 or what ever, as I llive in the property, but if I can have I enough time to submit it. I dont know. Ive been searching the web and on the phone for three weeks solid trying to sort something out. The ESA will be backdated but havent had a tribunal date yet and Im trying to pull all of the evidence together for that. I no longer know where to turn.. I will give the doctor / mortgage company another go tomorrow. and solicitor. I just need a back up plan, if I can get a signed letter then I can put in an N233 or what ever tomorrow, but it needs sorting tonight so Im there first thing in the morning.. God panic... Ive been like this for the last three weeks... well since the 15th or March anyway.Ive had two weeks... god not enough time to turn arround. I have paid the mortgage though this month and paid it last as well to try to stop this happening, but I dont think I paid enough with the benefits stopping.. anyway thanks for you replies
  20. 7 My mum is in no fit state to appoint a solicitor at the moment and Ive been told by three lawyers that she needed to be in a fit state of mind to do it.

  23. I have tried to get a power of attorney but its all taking time at the moment, I can pay this months installment and have said this to the mortgage commpany and I paid last months as far as I know.
