Thanks so much for your support ☺ After i asked the shop to furnish me with the sellers last name and address and also told them that i woukd be naming them in the suit, they must have discussed it with the seller who then finally contacted me. He said i wouldn't have a leg to stand on but he did agree to finish the deal, so he has his £200 blance and i have my new ring. I was very apologetic though because i do understand his position, i just didn't think it was right that we couldn't compromise or even discuss it. So thanks again
  2. Hi Ericsbrother, Yes ive spoken to the shop via Facebook messages. Theyve been really nice but not helpful, they've basically said i can't sue them as its nothing to do with them because they just rent out the cabinets and that the business has since changed hands so its a different owner, although the seller still has his cabinet there. They also say that they only hold deposits for a certain length of time, but they couldn't tell me how long that is, so i sent them a picture of my receipt that has no t's & c's on it. I told them id be willing to lose some of my deposit but not all of it because its just not right, ive paid 80% of the transaction. I found this on the government website which i think supports my case. Its just that i dont want to sue then be told by the court system that im sueing the wrong person and lose my fee.
  3. Thank you BankFodder, i know the 'reasonable time' is an issue but i really have been seriously ill, so I've tried appeal to the sellers sense of decency or fairness but i havent got anywhere. Anyway im going to take my chances in small claims court not that i want to but i think this could have been resolved without court. So my real query is do i sue him or the shop that houses his cabinet. They gave me the receipt and i think ive got little or no chance of getting the sellers details.

  7. Hi everyone, 15 months ago i put a large deposit on a piece of jewellery in one of those antique places where sellers have their own cabinet. It was for a ring which was app £1300, i gave the seller two of my rings plus £100 & i owed £200. I know 15 months is a long time but i suddenly became seriously ill out of the blue with severe sepis, ecoli and terminal cancer. I wasnt expected to survive but i did and as soon as i was strong enough i contacted the antiques shop & the seller to see if i could still buy it or have a credit note or something. I have the receipt and there are no terms & conditions on it but the seller refuses to take my calls or reply to my text messages so im going to have to take him/them to the small claims court. My question is how do i get his full name and address to serve him, also do i just take him to small claims or do i take the shop that rents him the space to court? I know its bad that ive left it so long & i have apologised & explained what happen but he hasnt replied or answered his phone in weeks now.
  8. Thank you.. No the only reason they give is this 'lettings strategy'. But why on earth can't people have a spare room when they pay rent? Well ive appealed again,so il just have to wait & see. Just wondered if anyone knew if it was legal what theyre saying/doing. I mean i need to downsize & ive already sold one set of bedroom furniture,but ive had a life for the past 45yrs,i need a real place not a shoe box.

  10. Hi everyone, I will try to keep this short as its quite lengthy. I live alone in a 3 bed Wakefield District Housing house,they bought all the housing stock form the local authority. When the Bedroom Tax came into force i was out of work & was hit by it for 2 bedrooms,but ive since re-trained and found employment so im now paying full rent & council tax. Back then i was told by WDH to put this house on the 'Homeswappers' website in order to downsize or get a lodger,so i put the house on the website. 10 months later ive managed to find a family who want to swap to my 3 bed house. They live in a 2 bed WDH terrace house,my daughter & grand daughter live next door,my work is 1 minutes walk away,my brother & his family live on the same street,so it would not only be ideal for me but it would be perfect. I actually listed 30 reasons why the exchange should be allowed. They gave me ONE reason why theyve disallowed it..'Lettings Strategy'.... Basically i either accept a tiny 1 bed flat or i will have to stay here or give up my secure tenancy to private rent a 2 bed house which will be £20 PW more expensive,app £105 PW. My rent is £97 PW & the house id like to swap with is £85 PW,thats a big saving when i only earn £200 PW. They never said i had to look for a 1 bed property 10 months ago so ive wasted all this time & effort. Where in the law does it say i can't have a spare room? If anyone out there could shed some light on this i would really appreciate it. Ive written to my Councillor & they have written to WDH but they say they can't actually reverse or force a decision.   11. Hi everyone, I just wanted to update you on the outcome for future ref. I wrote to DVLA and in the letter i told them that the buyer wouldnt give me the log book back and that i didnt have his contact details and that i had tried the police,basically giving them as much info as possible which wasnt a lot to be honest. Anyway they finally sent me a acknowledgement slip saying that it confirmed that i was no longer the registered keeper of the vehicle registration number ##### and that i have to keep it safe,which i will! I hope this will be the end of it but you never know Thanks for your help
  12. Hi everyone,sorry about the delay in responding. I had another 'dodgy' phone conversation with the buyers girlfriend and she told me that the car was now at a garage in Huddersfield,i phoned them but no answer so decided to phone DVLA. They told me to put it all in writing to them,so i did and sent it off recorded delivery. So im just awaiting my punishment i suppose. They did tell me when i phoned that the car was still in my name :/ For further ref for others in this position and for the people on the thread who have commented i will come back and let you know what happens to me. Thanks Tony No skeletons nope lol..just dont want to be arrested for conspiracy or whatever they call it,but i will be phoning the garage tomorrow and hopefully i can resolve this without it getting out of hand. Il let you know what the outcome is,just hope they havent done a logbook loan against it as ive read we arnt covered against it,anyway we'l see tomorrow thanks again
  14. Thanks Tony..Ive always been an honest person,maybe thats where im going wrong. I bought a car about 6yrs ago from a used car dealer and AGAIN in all the small talk and document swapping,i got half way home in the new car and the dealer foned me to say i hadn't paid for it! So i apologized and went back and paid lol,it was because we were talking. Anyway his girlfriend or someone has just text me to say its at a car dealers in Heckmondwike,West Yorkshire,so il phone them in the morning and see what happens. If your right and law is that he hasnt kept up his side of the sale then il report it stolen i guess? I just dont want to get in trouble. Is that the law then Tony? If it is then il do it. Just that im about to start a new job and there will be a CRB check and conspiracy to 'do whatever it is' wont look good.. But yeh i only have one dad and this would put him back in hospital he's so ill and worries.
