  1. Haven't really got the hang of using Forum threads etc. but just to let you know I have been helping friends with their claim against the Halifax for bank charges - settled in full with 8% interest £3484.05 after issuing a moneyclaim on-line. They acknowledged then paid in full. Donation Made
  2. Thanks for this - I have sent a copy of the spreadsheet to Halifax with a summary of all the charges including interest. I am still in the position where the MCOL has been issued but the Particulars of Claim nd Total Claimed are not the same!! ( as I did not include the back interest per S.69 County Courts Act 1984 of 8% - £393.65 in the Amount Claimed box). The question is - How serious is this - As amending an MCOL once issued does not seem straightforward. ( Complete form N244 & a new N1 form - re-serve on Halifax etc.) If I don't amend the MCOL - might this give Halifax the option of settling the amount of claim without paying the s69 Interest? Advice please
  3. Hi - Sorry two questions!! Prelim letter sent LBA sent MCOL issued 31/10/06 Mistake made in not including S.69 interest (393.65) in the Amount Claimed. So the Total Amount section on claim is £3080 made up of £2960 (Bank Charges) and £120 Court Fee. However, the Particulars of Claim section does include the line 'Claimant claims: ... b) interest per S.69 County Courts Act 1984 of 8% - £393.65 continuing at 8% until judgement or settlement at a daily rate of £0.65' Hence Particulars of Claim total is £3353.65 although not explicitly stated - and is inconsistent with Total Amount. Should I be concerned and make attemps (which appear a little complicated) to have claim amended and re-served? Second question - should I now forward the spreadsheet including interest to the the Court for filing with the claim and/or send a copy to the Halifax?? Thanks to anyone who can advise.
  4. Like everyone else, I would prefer not too but yes I would - and given the publicity around bank charges it is becoming more and more likely that a bank may take that far!!
  5. Helping a friend with his claim against the Halifax. Claiming back just under £3000 in bank charges over 3 years. We have been through preliminary letter and received offer of just over £600 in full and final sttlement. We did not accept this and replied with an LBA as we had not recieved full offer Following fourteen days - yesterday - submitted money claim online. Awaiting next steps One question - as my friend is nervous of going to court - am I able to represent/support him, should it proceed that far? Thanks

  7. I have not incurred a lot of charges on my own accounts but I have decided to help a friend who has been charged nearly £3,000 in just over 3 years by the Halifax. In some months charges have been over £300 for going less than £100 overdrawn. On a quick look, the site seems to be an excellent resource - and I look forward to following the process to help him recover his money. If successful, I will encourage him to donate!
