  1. Good Luck all - there is a light at the end of the tunnel - i have just won!!! It took 3 months in total which i think is pretty good going looking at some of yours - i think the thing that swung it for me was that i wrote in the allocation questionnaire that i respectfully requested that the court request the bank to come clean with their charges (which the banks don't want to do) - the bank without any warning then said they would settle the full amount out of court (this was the end of Dec) and when i looked in my bank this morning the money was there!! hoorah! Keep persevering - you will win in the end!
  2. Hi Skbuncks I have had my allocation questionnaire this morning which i am just completing. I have a question that i don't know if you can help with: my claim will obviously be in the small claims court, however in section G (Other Information) would it be prudent to write some of the template which is posted in the step by step instructions you sent me - from "This issue is not a complicated one...through to .....I understand it is the court's discretion to do so" ? want to get this in the bag as it were! Thanks
  3. Hi there Thanks for your reply - yes they filed a defence today! Here begins the journey....! Any help would be invaluable - i will keep you posted when i do anything else/ anything else comes in...
  4. Hi You guys I have "enjoyed" reading your chat as ii myself have this morning received the "Notice that Acknowledgement of Service Has been file" and that SC&M intend to defend all of my claim. It looks like i have a long haul ahead and i will probably need your help as experts in the field!! Would you mind keeping in touch via the email? Many thanks Caroline
  5. I am new to this but am currently writing to A&L who have charged me not a lot, but it's the principal! They have replied saying that the OFT's rulings apply to credit cards, not banks!...suffice to say, they have now received the 2nd letter. Within this letter i have put in there that i will make a claim to the OFT that they are not a 'fit and proper' person to hold a credit licence etc etc. What i would like to know is whether anyone has done this and if so, is there a letter template i can use? If not, is there any particular information i should be putting in this letter if it should go this far?
  6. I am new to this but am currently writing to Lloyds Bank who have charged me a total of nearly £900. They have written back saying sorry you are unhappy, blah, blah, so i have sent the second leatter - Letter Before Action and am awaiting a reply.
  7. Thanks for that - i am a bit useless at all this computer chat - this is the first time i have ever been on a forum - so how / where do i go about finding where i put my question for the lloyds and Alliance & Leicester problem?! Any help is greatly appreciated!!
  8. Hi I am new to this but am currently writing to 2 banks who have charged me a total of nearly £1,000. LOne has written back saying sorry you are unhappy, blah, blah, so i have sent the second leatter - Letter Before Action and am awaiting a reply; the other one replied saying that the OFT's rulings apply to credit cards, not banks!...suffice to say, they have also received the 2nd letter. Within both of these letters i have put in there that i will make a claim to the OFT that they are not a 'fit and proper' person to hold a credit licence etc etc. What i would like to know is whether anyone has done this and if so, is there a letter template i can use? If not, is there any particular information i should be putting in this letter if it should go this far?
