  1. Express insurance apparently no longer use Close Premium - they told me today that from September they changed to Barclays. I am having problems with them at present as they were made aware that my husband has 9 years of TRADE insurance with no claims but are now refusing to use this as his no claims bonus. they decided this 15 days after policy was taken out - 1 day after I would be eligible to claim my deposit back!! thelady today says i owe them £98 cancellation charges for windscreen cover and courtesy car but they would waive the £50 standard charge. I asked her why i was paying for the windscreen and her reply was that I am paying for the 12 months cover initially agreed in my insurance - so the insurnce is void in itself but I am paing for windscreen and courtesy car for Sept 11 to Sept 12. I asked if in 6 months time my windscreen cracks, who do I call for a replacement and she said " whoever you are insured with at the time" - surely if Iam paying for windscreen cover and courtesy car cover until Spet 12, I am entitled to claim on it? She says no - I said that she is then fraudulently tking my money as she has no intention of supplying the service I am paying for - she said she would have to check with her manager!! xx
  2. My hubby is a garage owner and won't even change pads singly - pretty pointless seeing as you pay for them form any supplier as a pair!! I would contact Kwik Fit and tell them your brakes are faulty afte htem fitting them - unless they can prove it is a wapred disc and a fault of the manufacturere, they have an obligaiton to correctt heproblem within your warantee. Be aware thoughthat they should have advised you no harsh braking for a minimum of 200 miles (may only be my hubby who does this though) and could tryt o sayt he brake fault is yours for braking excessively while the surfaces were wearing in
  3. Hi Guys We are having some major wories with Cap one nad Debitas right now. My husband nad I have just passed all of our debts to Sterling Green Debt management company. We have had Capitla One problems for some itme now but have never managed to sort out enough paperwork with them to take it to court due tot hem robbing us blind. Our card is only £200 limit, we have already paid them in excess of £600 and they are demanding a further £503.92 from us. Because we have refused to pay them and no longer have the debt with us, they have passed over to Debitas. The lady who keeps ringing us is a total evil witch - she shouts at me, hangs up on me when I tryt o speak to her and even though I have tried to explain to her that Sterling Green have advised us to make no further payments to them until they make contact, she continually contacts me asking me for money. I have explained via the telephone that she is breaching Sec. 4 of the Telecommunicaitons act as per oyur letter here about harrassment but she baiscally said "I don't care, I want you to pay us". I have sent htem the letter today but it is getting ridiculous now - she is ringing us at least 30 times a day, Sunday afternoons at 6pm whent he office isn't even open for me to ring nad speak to them! Please can anyone offer any further advice aboutt he situation before I go crazy or my husband gets into trouble for screaming at her on the phone when she is disturbing him at work every 10 minutes

  6. I recently sent a subject access request to MBNA. Today I received a letter form them - I shall type the letter out so I can get your opinions on it We refer to your recent correspondance concernign default fees on your account. I would like to clarify the situation form our perspective. We have always set out precisely what our charges are and in out agreement with you, as they are an itegral part of the terms and conditions under which we are prepared to provide credit facilities. When customers pay late, we incur substantial costs in dealing with their default. Similarly, we have set credit limits carefully for each customer and for good reason. We expect every customer to respect thier credit limit. If a customer goes over thier credit limit, he or she is using the card in a way that is not allowed, in effect obtaining unauthorised borrowing. We, therefore, lend more than we agreed to, and take on risks, which weere never accepted in the first place. In the case of both late payments and overlimit usage, and also where a cheque is retunred unpaid, we look at the portfolio as a whole and set uniform charges reflecting our costs and dealing with such defaults of customers overall, as do all other major credit card providers. This approcah allows us to be clear and upfront about all default charges and the basis on which they are applied. Our view is therefore that the charges you agreed to are valid, fair and enforcable. Term 3b of your credit agreement with us clearly states that you must pay £25 every time your payment has not reched your account within 1 day of your payment due date, or when you exceed your credit limit, or a cheque is returned unpaid. You will find at the end of this letter details of all relevant charges as to your account (and any associated credits). On this occasion, we have provided the information to you free of charge; therefore, your cheque for £10.00 has been credited to your account as a payment. Should this information not be sufficient, and you wish to make a full data subject access request under section 7 of the DPA 1998, please complete and return the attached form. Please ensure you enclose a fee of £10 and appropriate ID. We do value your custom and so we would like to resolve this matter. I have therefore credited your account with a goodwill payment of £370.00 on the basis that this is full and final settlement of your complaint. You may know that the Office of Fair Trading has recently issued guidelines for the level of credit card default charges. MBNA disagrees with the OFT's interpretation of the law and continues to maintain that its default charges have always been fair, legal and transparent. However, we have decided to reduce our default charges to £12 with effect form 28th June for late payments and returned payments, ans 28 July for overlimit fees. You will have received notification of the changes to the terms and conditions. We expect you to honour the terms of your agreement with us. If you do not do so, we will have no alternative but to cancel your card and formally terminate your credit agreement. Why did they not accpet my first letter as being a full subject access request? 2. What do I do now? They haven't even let me send a prelim letter and are offering half of what they owe us - do I now send them a prelimn letter telling them I will accept their £370 but shall go after the rest through court if necessary?? Any help is much appreciated

  8. Captial one were very very good regaring copies of statements and stuff - got them all off them within 5 working days. We estimate that the charges form start of account to present have been approx £800. What i am wondring is which letter do I send next? Is it the prliminary letter and if so do I change the wording to make it for a credit card and not a bank account? None of the other companies I contatced have bothered to respond as yet - once it hits the 40 days, what do I do? Many thanks in advance for any help you can offer me
  9. Thanks Dolly :) I have sent DPA's to all but Natwest as they are being a little shirty over who we should send it to! I wanted to ask a little advice too regarding the barclays businees current account. Going over some of the statements, I notice a lot of interrest and commission charges being taken out every 3 months or so - sometimes as much as £1000!! Can anyone tell me why and what this is for? Thanks
  10. We had the account with them 2 years ago - just before we switched to Barclays. I am very nervous about it all - my husband has nearly lost his business over Barclays kicking us at every oppurtunity time to kick back I reckon :) I am going to chase the NAtwest up though and see what happens. Hopefully my husband can regian a bit of cash from the bank after they have crippled him financially lol

Thank you Miss P :) I can't really move until Tuesday of next week when we will receive our figures from our accountant for the last 2 years of Barclays which is the date we joined them but I would easily estimate that they have had a good few thousand in charges so far!! Also have to have dealings with Natwest bank even though we left them when we joined Barclays. The only problem Ihave is that I may face a wall when I try to get info from them as we closed the account - do they legally have to keep a full record of our statement information for a certian period of time?   12. I found the site via a friends advice. My husband and I own a small business and have been having problems a lot over the last 18 months or so. we have been really trying hard to pay the charges and keep the accounts in good order but havne't managed very well of late! Now that I know we stand a good chance of being able to claim a little something back i feel a lot better :) Companies in question that I shall be sending a prelim letter to are Barclays Bank Barclaycard Natwest bank (old accont closed but within 6 years) Capital One MBNA Fingers crossed we may get a good result :)

Hi all I have had a good read through the FAQ's and a lot of the Barclays section of the site this morning :) My husband and I run our businaess through Barclays and as a result of their charges and charges for charges etc we are now faced with extensive money problems which for some time we have seen no way out of. I have now discovered some light at the end of the tunnel via this forum and the advice here so a big thank you to those who obviously work so hard to help others :) Our accountant has got all of the barclays statements ready for me - we have only been with them for 2 years. I am going to send a prelim letter on Tuesday after I collect the relevant figures form the accountant. Wish me luck
  14. If it was randomly cutting out of it's own accord during speeds like that, I would maybe lean towards an ECU fault or some sort of injection problem??? By right the garage who replaced your camshaft should be rectifying the problem - have you tried going back there and explaining? Hope that helps a bit :)
