  2. Hi, Just about to post my prelim letter to Abbey for bank charges. I have a little Dilemna. Can I include prior to the 6 years in my initial claim?? I opened my account with Abbey in April 2001, can I include April to August 2001 in my claim or must I claim for this in a seperate claim?? Please help!!!!! Jaye
  3. Help!!!!!!!!!!!! Hi Just about to send letter to ABBEY to claim back bank charges. Can I include over the six years ie it starts april 2001 or do I have to include this as a seperate claim and start initially from August 2001??
  4. Yes I was surprised by this as I had geared myself up for Court claim. I had broken it down into 2 claims due to it being 2 bank accounts, one for £755 and the other for £1145. Maybe this helped?? Who knows?? The offer came through after the LBA. Id left it a while (about 1 month) as I had some familly problems and I put on the back burner. I had to ring them a few times as they were getting silly with my overdraft and spoke to them quoting some of the bumpf I picked up from this forum basically threatening them with a complaint to the OFT as they were in breach of their terms and conditions and subsequent court action as I had not had the courtesy of a response after the LBA and they were trying to take away my overdraft. Saturday 3 letters landed on my doorstep, 2 from them and a partial refund from Cap One (already accepted part payment but written back asking for the rest) I might just give them a call on Tuesday and see if I can get anywhere on the default side. If no joy Ill take the money and run. Ive just received my statements from the Abbey and will now start that this weekend. Thats the big one!!
  5. HELP. Part Victory I can see the light!!!!!!!!!! I have received an offer for the full amount of my claim for £1900.00. It is a "goodwill" payment as in their words "We are, however, mindful of the management time and recoverable legal costs that may be incurred in relatio to such a claim. For those reasons alone and without any admission of liability whatsoever, we are prepared to make a payment to you for the sum of £1900.00 in full and final settlement of this matter" What it doesnt cover is the default removal which is also important. What should I do next. Should I accept it or do I take it to the next stage and maybe lose everything??? I have searched through the archieves to see if I can find a template to accept their offer but only on condition of removal of the defaults. Anyone any ideas!! :confused:

  7. Wow, Now Im nerveous!! Had planned to file my case in Worcester this week but need to make sure Ive dotted all my I's and T's.. Ive made the decision to carry on and do it as Im sure that we all should. If Im not successful then it will go to appeal!! One thing worries me. After the LBA is sent out if it goes over the 14 days Ive given them is there a cut off point as to when I can sue or do I have to go through the whole process again. I dont want to lose my case on a technicality before I start. I sent the LBA on the 3rd April and because of personal problems couldnt go any further until now. Is it too late. I dont want to be at the end of a pedantic Judge who takes the Birmingham ruling as a Bench mark as its not a million miles away from Worcester!!!!
  8. Im probably in the wrong place but HELP!! Have had some personal problems so pushed my claim against HSBC to one side. I got as far as sending an LBA to them on the 3rd April and didnt get any Further, I gave them 14 days.. Is it too late to go to the small claims court with this now? If so do I need to restart the whole process or can I send them another LBA? Does anyone know? Hopefully Jayenevin
  9. Hi, Looking for some advice. In the process of taking HSBC to small claims court but thats a different story. In the research I have done on this site I have discovered that I may have been sold 2 ppi single policies when I shouldnt have. I initially took out a loan for 10K and was sold a PPI single policy. I was self employed at the time and HSBC knew this as I business banked with them. The policy was added to my loan and I paid interest on it. I then refinanced a to a larger loan 17.5K and again my PPI policy was added to my loan and interest paid. I was still self employed at the time and again HSBC knew this. Since then I longer work for myself but for a large company. I am still repaying the second loan. My Questions are. Can I claim back the PPi and interest on both loans, even though I am no longer self employed? If so how do I get this information from HSBC as I have since lost the paperwork as I moved House. Do I a submit DPA request? If so how do I word this? Are there template letters somewhere on this site? I really dont want to let HSBC away with this as they have conned me and oh Yes the money would come in handy. Hope you can help:? Jaye
  10. Hi All, I hope some of you can help. I was sold a PPi policy with a loan that I had with HSBC. I was self employed at the time and HSBC knew this as my business accounts were with them. I then Refinanced this loan for a higher amount and again was sold the PPI policy even though I was self employed. I am now no longer self employed and work for a large company. I am still paying this loan. My Question is, I know that I can claim for mis selling on the original loan but can i do the same on the second loan that I took out even though I am no longer self employed?? Regards Jaye
  11. Hi Guys. I too am tire of the banks beating me up every foot i place wrong!!! I have sent subject Access requests to HSBC, Capital One and Abbey. I have also sent Pre lim Letter to HSBC (GBP1975.00). These specify a period of time in which the banks have to respond which is 40 days for the subject access requests and 14 days for the pre lim letter. Are these working days or actual days? Ie with the subject access request is it 8 weeks or just over 5?
