  1. I have just been on the Information Commissioners Office website and read an article they have written in Feb 2006 regarding the outcome of the Durant case. From reading it, it seems clear that the Information Commissioners Office are of the opinion that any information held in a manual filing system in Chronological order would not be a 'relevant filing system'. As BC hold their microfiche info in chronological order they seem to be within their rights to charge extra on the basis of it not being a 'relevant filing system'. I think i will just go ahead with the info I have and see what happens. If anyone wants to check the info it can be viewed on their website www.ico.gov.uk under Technical Guidance Notes in the 'Your Legal Obligations' section of the Data Protection Menu. Titled 'The Durant Guidance and its impact on the interpretation of the Data Protection Act 1998'. Hope this helps to clarify a few points. R
  2. From my experience the ref should relate to your account number and the address I have used is: Legal Compliance Specialist Capital One Bank (Europe) Plc Trent House Station Street Nottingham NG2 3HX You could always try asking the solicitors to confirm your account number.
  3. Sorry to be dim again but about the balance of account at time of interest column? My bank statment gives a running total for the balance after each transaction should I use this as the balance?
  4. Hi Me and my husband both had Capital One cards that ended up being defaulted due entirely to and admin error on their part (not admitted though). We have paid and closed the account now but are we atill entitled to claim? Similar applies to my Barclaycard although that one is still active? I want to ask them to remove the defaults as part of this action too. R
  5. Hi Wonder if someone can help me? Not sure about the interest column in the excel spreadsheet? Do I put in all interest charged on my overdraft even if I was in it through my own fault not because of charges? Sorry to sound a bit dim! Am hoping to claim against Abbey, Barclaycard and Capital One who also defaulted on me and my husband. Their error as they didn't update their systems with change of addresses.

    Hi Trakka I'm a beginner too! Had enough of Abbey charging me for being overdrawn, making me go overdrawn and charging me again!!!! It's good to read all the success stories out there. GL and don't give up
